RULE 83.10 CERTIFICATE OF APPEALABILITY A petitioner wishing to appeal from the denial of a '2254 or '2255 petition must file a timely notice of appeal and should promptly apply to the district judge for a certificate of appealability. The application will be directed in the first instance to the district court judge who refused the writ.
