Filing of the Order Denying Respondents’/Appellees’ Motion to Dismiss, Or In

The Alternative, To Transfer For Improper Venue, and Denying

Petitioners’/Appellants’ Ore Tenus Motion to Strike in Rogers, et al. v. Harris, et

al., Palm Beach County Circuit Court Case No. CL 00-10992 AB, entered

November 30, 2000. A copy of the Order is attached hereto as Exhibit “A”. This

order memorializes the ore tenus ruling issued by Judge Labarga in open court on

November 14, 2000, which ore tenus order has been appealed to the Fourth District

Court of Appeal, but is also the subject of the pending certification by the Fourth

District.
