ROLL CALL MINUTES - July 24, 2007 PUBLIC REQUESTS AND PETITIONS PUBLIC HEARING 1. Ordinance – To adopt the FY 2008 Operating and Capital Improvement Budget – 1st Reading (Bill No. 6096) • As part of the budget process, the Board is required to hold a public hearing to seek public input prior to formal
adoption of the Fiscal Year 2008 Budget. The Board has extensively reviewed the proposed budget during two public meetings held on July 31 and August 7, 2007.
2. Ordinance - Property Tax Levies - Tax Year 2007 (Bill No. 6097) *** General Municipal Purposes *** *** Debt Levy General Obligation Bond Purposes*** *** Special Business District ***
• As part of the budget adoption process, the Board must hold a hearing to seek public input regarding the proposed tax rates.
3. Resolution – Approval of a Conditional Use Permit to Show Me Golf, LLC, to operate a golf academy to be known as Golftec located at 190 Carondelet Plaza. (Res. No. 07-28)
• A conditional use permit is required to operate a golf instruction academy in the High Density Commercial Zoning District. The Plan Commission considered this request at its July 16th meeting and voted unanimously to recommend approval.
REPORT FROM THE CITY MANAGER 1. Ordinance – To approve a revision to Ordinance No. 5963 for an extension of the plat filing deadline for DeMun Pointe. (Bill No. 6098)
• On December 12, 2006, the Board of Aldermen adopted an ordinance approving a Subdivision Plat for the consolidation of five lots commonly addressed as 6435 - 6451 Clayton Road. The plat was adopted in support of the DeMun Pointe project which is currently under construction. As part of the approval the owner must submit to the City Clerk proof of filing showing the book and page from the St. Louis County Recorder of Deeds Office within 45 days of the approval of said plat by the Clayton Board of Aldermen. The applicant has recently discovered that the plat has not been filed and the 45 days has elapsed. Therefore, the applicant is requesting that the initial 45 day requirement be extended until September 14, 2007 and that an ordinance revising Section 3 be adopted by the Board of Aldermen.
2. Ordinance – To approve a contract with Kevin O’Keefe of Curtis, Heinz, Garrett & O’Keefe PC law firm for City Attorney services. (Bill No. 6099)
• This contract renews an agreement between the City of Clayton and Kevin M. O’Keefe and the law firm of Curtis, Heinz, Garrett & O’Keefe PC for City Attorney services.
3. Ordinance – To approve a contract with Gilmore & Bell to provide bond counsel services for the Carondelet Village Project. (Bill No. 6100)
• This contract is to utilize Gilmore & Bell to provide redevelopment and bond counsel services in connection with the proposed Carondelet Village project.
4. Ordinance – To approve a contract with Gilmore & Bell to provide bond counsel services for the 2007 bond issue. (Bill No. 6101)
• Gilmore & Bell has provided bond counsel services in prior issuances. The contract is between the City and Gilmore & Bell to serve as bond counsel for the planned 2007 special obligation bond issue that will refund the 2002 bond issue.
5. Resolution – To authorize the offering for sale of Special Obligation Refunding Bonds. (Res. No. 07-29) • The City issued special obligation bonds in 2002 to pay for the costs associated with the reconstruction of the Shaw Park
pool and the renovations of City Hall/Fire Station. The principal balance is due on December 1, 2007at a cost of $7.375 million. The City has determined that they will refund this debt through a competitive special offering for sale of the bonds.
6. Resolution – To approve a contract with Fence Depot Inc. to replace fencing around DeMun Park. (Res. No. 07-30) • Scheduled for replacement this summer is the fencing that surrounds DeMun Park. Staff compiled bids for this project,
which would make use of a perimeter fence product called Montage Plus, a fusion-welded steel ornamental fence that is maintenance-free and has a twenty year warranty. This fencing has an open and attractive look, while conveying the assurance of strength to keep children contained in a safe, play environment.
7. Motion – To approve the CRSWC FY08 Budget.
• This budget includes revenues and expenses for the period October 1, 2007 through September 30, 2008 for the three CRSWC Funds – Operating, Equipment Replacement and Capital, along with projections through FY 2010. In the Operating Fund, the revenue projection targets a growth of 7.0% amounting to $2,959,547 in FY 2008, compared to the estimated actual of $2,766,799 for FY 2007. The largest source of revenue will continue to be from the sale of membership, daily passes, and programs. Additional income is generated through rentals, food service, child care and other miscellaneous income. The CRSWC Equipment Replacement Fund is utilized for purchases of exercise equipment or other equipment that is enjoyed by the patrons of The Center.
8. Motion – Certification of the August 7, 2007 Election Results.
