    B&R Family Fitness Club Files Lawsuit Challenging L.A. Fitness’ Unfair Business Practices

       Lawsuit Alleges That Rival Fitness Chain is Damaging Health Club’s Reputation, Business with False and
       Misleading Information

       In today’s ailing economy, every client counts. This is particularly true in a marketplace where locally
       owned businesses have to compete against mammoth national chains, so that consumers can continue to
       have options. One local business, Bucks County, Pennsylvania’s B & R Family Fitness Club, is fighting a
       national chain’s unscrupulous attempts to unfairly damage its business. In a complaint filed in the Bucks
       County Court of Common Pleas on December 9, 2008, B & R Family Fitness alleges that California-based
       L.A. Fitness’ Huntington Valley location is interfering with B & R’s prospective business relationships by
       disseminating falsehoods to potential B & R clients.

        The lawsuit claims that, according to witnesses, L.A. Fitness employees attempt to dissuade prospective B
       & R customers by telling them that B & R has declared bankruptcy, is close to declaring bankruptcy, or is
       otherwise having significant financial problems. “B & R is not suffering from financial difficulties,” said
       attorney Michael Eidel, a partner at Fox Rothschild who represents B & R.

        The L.A. Fitness employees further tell prospective customers, according to the complaint, that entering
       into a B & R membership is risky because the health club’s financial woes will render the club unable to
       honor its contracts. But B &R does not have any financial problems and poses no risk to potential clients,
       the complaint states. In fact, B & R has been serving the fitness needs of Bucks County residents for more
       than 30 years and this year was a “Best in Bucks” Philadelphia Inquirer Readers’ Choice Awards winner.
       The lawsuit seeks injunctive and monetary relief for L.A. Fitness’ alleged wrongdoing.

        “It is always unfortunate when a faceless chain engages in conduct designed to drive a locally-owned
       company out of business,” said Eidel. “It is intolerable when a competitor seeks to destroy an established
       company’s reputation by spreading falsehoods among potential clients. We are proud to assist B & R in
       fighting this wrongdoing by L.A. Fitness.”

        B & R’s complaint alleges claims against LA Fitness for intentional interference with prospective business
       relationships, defamation, commercial disparagement, unfair competition, and violations of the Federal
       Lanham Act.

        “Customers of B & R should know that B & R is bonded, which insures that if the company were ever to
       go out of business, members would be refunded for any time remaining on their membership contracts,”
       said attorney Eidel. “B & R offers an 80,000-square-foot facility and award-winning customer service; we
       sincerely hope that this lawsuit will put to rest any falsehoods that have been spread about this upstanding
       Bucks County business.”
