Phase ii Permit requirements
Upcoming air quality requirements for Gas
Dispensing Facilities may require permits from
EMD’s Hazardous Materials Division. Both the
UST owner and UST operator are ultimately
responsible for obtaining the required permits. The
following criteria determine whether a permit is
required:
In-Station Diagnostics (ISD):
ISD equipment monitors performance of vapor
recovery systems and triggers an alarm when failures

permit from EMD because the UST leak detection
system must be reprogrammed.

EVR Phase II Systems:
EVR Phase II equipment collects gasoline vapors
that would otherwise escape into the atmosphere
during vehicle refueling. The installation of these
systems does not require a permit from EMD if the
following conditions are met:
     •	 No ground is broken (all work is done above
        grade).
     •	 The UST leak detection console is not
        reprogrammed.
