About This Document: Recent studies have indicated that surgeons have responded to the medical malpractice crisis by changing their practice patterns, avoiding high-risk procedures, and migrating to states with more favorable medical malpractice litigation environments. The American Medical Association has designated 19 states "in crisis" as of 2005 (this was increased to 20 states in 2006).3 Clearly, for surgeons, this has been a major distraction consuming time and effort in obtaining medical malpractice insurance and satisfying its financial burden. Academic medical centers may be less impacted by the additional liability insurance expenses than community based hospitals and physicians in private practice due to more secure financial resources.5,6 There is evidence that the malpractice situation is having demonstrable effects on the supply of specialist physicians in affected areas and their scope of practice, however, the impact is likely more profound upon community-based procedural oriented programs which have more volunteer faculty.2 Accreditation status is a rather crude measure and lacks specificity, however, differences were noted.
