The contractor shall maintain insurance to protect against all claims under Workmen's Compensation, Comprehensive General Liability and Automobile and shall be subject to approval for adequacy of protection as per the following limits: Worker's Compensation 1. Limits according to Worker's compensation Laws of the State of New Jersey. 2. Contractor's Liability not less than $100,000. Comprehensive General Liability 1. Bodily Injury - $500,000 per person; $1,000,000 per occurrence. 2. Property Damage - $1,000,000 per occurrence. Comprehensive General Liability shall include the following: 1. Coverage for explosion, collapse or underground hazards. 2. Occurrence basis coverage. 3. Broad form property damage coverage. 4. Coverage for personal injury sustained by any person as a result of an offense directly or indirectly related to the employment of such person by the insured. Comprehensive Automobile Liability shall include the following: Business auto liability insurance or its equivalent with a minimum limit of $1,000,000 per accident and including coverage for all of the following: Liability arising out of the ownership, maintenance or use of any auto; Auto non-ownership and hired car coverage. Contractor's Worker's Compensation, Comprehensive General Liability and Comprehensive Automobile Liability arising out of subcontractor's operations shall be identical as that listed above. It is to be understood by the bidder that this bid is submitted on the basis of specifications prepared by the County and the fact that any bidder is not familiar with these specifications or conditions will not be accepted as an excuse. 8. NO BID SECURITY. 9. NO PERFORMANCE BOND 10. Bidders must use the proposal form furnished by the County when submitting their bid. 11. A copy of bidder’s New Jersey Business Registration Certificate must be included with bid. Failure to do so is mandatory cause for rejection of bid. 12. Insert prices for furnishing all of the material and/or labor described or required. Prices shall be net, including any charges for packing, crating, containers, etc. and all transportation charges fully prepaid by the contractor F.O.B. destination and placement at locations specified by the County. No additional charges will be allowed for any transportation costs resulting from partial shipments made at the vendor's convenience when a single shipment is ordered. 13. Payments will be made upon the approval of vouchers submitted by the successful bidders in accordance with the requirements of the Board of Chosen Freeholders and subject to the Board of Freeholders customary procedures. 14. Contract will be awarded on a lump sum basis. 15. In the event that there is a discrepancy between the unit prices and the extended totals, the unit prices shall prevail. In the event there is an error of the summation of the extended totals, the computation by the OWNER of the extended totals shall govern. 16. Award will be made by Ocean County Board of Chosen Freeholders within sixty (60) days after receipt of bids. 17. Prevailing Wage & Labor Laws. The New Jersey Prevailing Wage Act (P.L. 1963, Chapter 150) and provisions of the State Labor Laws must be complied with by the successful bidder, if applicable. 18. Equal or Tie Bids. The County of Ocean reserves the right to award at their discretion to any one of the tie bidders. 19. The County of Ocean is exempt from any State sales tax or Federal excise tax. 20. For purpose of evaluation where an equivalent product is being furnished, bidder must indicate any variation to our specifications no matter how slight. If no variations are indicated, it will be construed that the bid fully complies with our specifications. Page 4 of 44 21. Quantities shown are approximate and the County reserves the right to decrease or omit quantities. The County also reserves the right to increase quantities to twenty (20) percent of the maximum quantities listed at the unit price bid. 22. The contract shall be in effect for one (1) year from date of award or until delivery is complete unless otherwise stated. The County reserves the right to extend the term of the contract pursuant to N.J.S.A.40A:11-15. 23. Bids may be hand delivered or mailed per legal notice to bidders. In the case of mailed bids the County assumes no responsibility for bids received after the designated date and time and will return late bids to the bidder unopened. 24. Delivery shall be made upon receipt of a Purchase Order issued by the Ocean County Department of Purchase, upon which delivery locations and needed quantities shall be indicated. 25. "All contractors must comply with the provisions of New Jersey Statute Title 40A:11-18, when applicable." 26. Public Works Contractor Registration Act The bidder must comply with the provisions of "The Public Works Contractor Registration Act", if applicable. • All named contractors must be registered with the Department of Labor pursuant to the Public Works Contractor Registration Act at the time the proposal is received, or the proposal will be determined to be non-responsive. • Any non-listed contractor must be registered with the Department of Labor prior to physically starting work. It is the responsibility of the General Contractor to insure that all non-listed contractors comply. • Contractors are encouraged to submit their and all named contractors’ Public Works Contractor Registration Certificates with the bid. 27. This agreement shall not be assigned without the written consent of the County of Ocean. 28. NJ ONE CALL. By presenting a bid, contractor declares that he is aware of and, if required, will comply with the requirements of the "Underground Facility Protection Act (Public Law 1994, Chapter 118)" prior to commencing any intended excavation. The successful bidder will be required to show compliance with this requirement by submitting to the appropriate project coordinator the confirmation number obtained from ONE-CALL before any excavation is undertaken. 29. Special Surety Bid Requirements for Certain Construction Projects. The attention of the bidder is called to the provisions of P.L. 1995, Chapter 384 enacted on January 10, 1996 which requires that the County of Ocean shall only accept performance and payment bonds from surety companies meeting the requirements of that statute. The bidder shall deliver with its bid a Consent of Surety. The Bidder's Surety Company shall complete the "Certificate of Surety Company" which bidder shall submit with its bid. Page 5 of 44 30. New Jersey Business Registration Requirements. N.J.S.A. 52:32-44 imposes the following requirements on contractors and all subcontractors that knowingly provide goods or perform services for a contractor fulfilling this contract: • The contractor must provide written notice to its subcontractors and suppliers to submit proof of business registration to the contractor; • Subcontractors through all tiers of a project must provide written notice to their subcontractors and suppliers to submit proof of business registration and subcontractors must collect such proofs of business registration and maintain them on file; • Prior to receipt of final payment from a contracting agency, a contractor must submit to the contracting agency an accurate list of all subcontractors and suppliers or attest that none was used; and, • During the term of this contract, the contractor and its affiliates must collect and remit, and must notify all subcontractors and their affiliates that they must collect and remit, to the Director, New Jersey Division of Taxation, the use tax due pursuant to the Sales and Use Tax Act, (N.J.S.A. 54:32B-1 et seq.) on all sales of tangible personal property delivered into this State. A contractor, subcontractor or supplier who fails to provide proof of business registration or provides false business registration information shall be liable to a penalty of $25 for each day of violation, not to exceed $50,000 for each business registration not properly provided or maintained under a contract with a contracting agency. The vehicles furnished shall comply with all safety laws, rules and regulations of the State of New Jersey and with standards for automotive vehicles. 33. The vehicles, equipment and accessories shall be new. The bidder shall specify the specific model being bid in each class or type of vehicle. 34. The vehicles, equipment and accessories shall be new and ready for immediate use upon delivery, all service and make-ready having been done prior to delivery. Any vehicle not in such condition will be rejected. All vehicles are to be delivered to the Ocean County Department of Vehicle Services, Chestnut Street, Toms River, New Jersey. 35. The vendor shall furnish for each vehicle delivered, the manufacturer's standard warranty against defects in material, workmanship and design in said vehicles. 36. Bidders must state number of days, after receipt of order, that vehicles will be delivered. 37. The awards will be made on the basis of a comparison of prices of each vehicle listed with standard equipment plus the cost of optional equipment. Page 6 of 44 38. Shop service manuals, Hydraulic Systems manuals, including wiring diagram and electrical trouble shooting guide are to be provided with each vehicle. WARRANTY & SERVICING 43. The authorized Dealer's Warranty shall be for a minimum of one (1) year period from date of acceptance by County for parts and labor on chassis, engine, transmission, body, hydraulics, plows and spreaders. 44. This agreement shall cover all warranty work, minor warranty and service work at County Facility, upon request of the Director of Vehicle Services. 45. Vehicle transportation for warranty work shall be at the vendor's expense. He shall pick up and deliver back to County of Ocean within seven (7) working days, upon notification from Director, Vehicle Services or his designated shop Foreman, that servicing or warranty work is required. 46. Bidder shall have full service facility stocked with parts capable of performing all warranty and non- warranty repairs, to ensure efficient and economic maintenance of the vehicles and to reduce down time. 47. In the case of any unnecessary delays because of parts availability or service scheduling, the Director of Vehicle Services shall be notified and a replacement vehicle shall be provided upon request. 48. Pay to Play Requirements: The Vendor/Contractor must file an annual political contribution disclosure statement with the New Jersey Election Law Enforcement Commission ("ELEC') pursuant to N.J.S.A. 19:44A-20.13 (P.L. 2005, c.271, s.3) if the Vendor/Contractor receives contracts from public entities totaling in excess of $50,000 in a calendar year. COOLING SYSTEM PROTECTION All vehicles furnished must be protected to –(minus) 20°F (-30°C) with permanent type anti-freeze and summer coolant. AIR CONDITIONING All air conditioning shall be factory installed, support system (cooling, electrical, etc.) shall be upgraded in accordance with factory recommendations. FUEL All vehicles will be delivered with a minimum of one-half (½) tank of fuel. DESIGN Materials shall be of good commercial quality for the intended service and shall be produced by use of current manufacturing processes and treated to resist rust, corrosion and wear. The design of the mechanical member shall be such that the stress imposed through normal shock loads of maximum engine torque, shall not cause rupture or permanent deformation or undue wear on any member. STANDARD EQUIPMENT These specifications include all standard equipment provided for each vehicle unless specifically upgraded or deleted. In the event options are required, the contractor shall provide upgrading of all support systems affected, in accordance with factory recommendations. Page 20 of 44 DEMONSTRATION Bidder shall be prepared to give, prior to bid award, a complete demonstration of the equipment proposed at a County facility or a mutually agreed to location and time within the State of New Jersey. The equipment so demonstrated shall be complete as offered by the bidder. SERVICE Contractor shall be able to service all equipment proposed and include their standard maintenance contract to take effect at the expiration of the guaranty period. The contractor shall maintain a service facility staffed with qualified service personnel and a working inventory of parts. WARRANTY Manufacturers warranty shall apply. There shall be ample room provided to hook up the chains with ease and without interference. _____ _____ All major components of the truck portion of the hitch shall be sandblasted and receive one coat of primer, one coat of enamel, and the color shall be black. _____ _____ Page 38 of 44 ITEM #1 – MODEL YEAR 2010 OR NEWER, FREIGHTLINER 112V CAB/CHASSIS WITH THIELE MODEL 12 DUMP BODY, OR EQUAL (CONT'D) COMPLIANCE YES NO Gledhill High Straight Moldboard "Built-in –Baffle" Snow Plow, or equal MOLDBOARD Shall be engineered, designed and built by a recognized snow plow manufacturer. There shall be a minimum of fifty (50) plows of the exact make and model bid in satisfactory use for a period of not less than three (3) years. Certification as to the above shall be supplied within five (5) working days if requested. _____ _____ The moldboard shall be a minimum of 36" uniform height and 11 ft. long at the cutting edge. The moldboard shall be made of not less than #10 ga. steel, paneled for additional strength with built-in deflector (baffle) of unitized design. _____ _____ The moldboard shall have the built-in baffle design providing a continuation of the moldboard ribs and contour a minimum of 12" overhanging the cutting edge (no bolt-on assemblies permitted). A top reinforcing angle shall be made of not less than 3" x 2" x 3 8 ", running the full length of the moldboard. _____ _____ The vertical ribs shall fully extend to the built-in baffle angle. At the bottom, a one (1) piece structural angle at least 4" x 4" x 3 8 " shall reinforce the moldboard. To this angle, a cutting edge backing of 5 8 " x 3" shall be welded and further braced by gussets a minimum of ½" x 2 ½" welded between each cutting edge bolt position. _____ _____ The front face of the cutting edge shall be flush with the moldboard face to prevent snow buildup on the top surface of the blade. _____ _____ The moldboard shall be reinforced with a minimum of six (6) full length vertical ribs of at least ½" x 3" formed steel, continuously welded on both sides of edge to the moldboard sheet. _____ _____ The lower rear cross angle shall be provided with at least ten (10) ears, ¾" thick, for attachment to the table assembly at 5 point minimum with 1" diameter grade 5 pins. _____ _____ The cutting edge shall be of abrasion resistant steel C1090, or equal, with a Brinell hardness of 250 minimum and 325 maximum. It shall be ½" thick x 6" wide and full length of moldboard, AASHO standard punched. _____ _____ TRIPPING MECHANISM Shall be attached to the table and to moldboard and shall consist of at least four (4) extension springs, 4 ½" O.D. x ½" oil tempered spring steel. These springs shall control the trip so that the plow will be held rigid for plowing and will trip automatically when coming in contact with any solid object. _____ _____ The extent of the forward motion of the moldboard shall be controlled by a mechanical telescopic tripping post assembly constructed of at least a 1 ¼" x 2" inside bar, ¾" x 2 ¼" outside bars. The tripping post assembly shall be independent of the springs and shall prevent the top of the moldboard from contacting the road surface. _____ _____ Page 39 of 44 ITEM #1 – MODEL YEAR 2010 OR NEWER, FREIGHTLINER 112V CAB/CHASSIS WITH THIELE MODEL 12 DUMP BODY, OR EQUAL (CONT'D) COMPLIANCE YES NO PLOW HYDRAULIC REVERSING TABLE OR SEMI-CIRCLE Shall have at its front a minimum of ten (10) ears, ¾" thick on 88" hinge point centers for attachment to the moldboard assembly at five (5) points. _____ _____ Attachment pins shall be 1 ¼", 105,000 pounds tensile strength pins. _____ _____ The four (4) tubes comprising the table shall all be a minimum of at least 5" x 5" x 516 " wall tubing. Angle irons not acceptable. _____ _____ Connecting reinforcements from the front tube to the side tubes shall be four (4) 5 8 " thick plates welded together for maximum strength. _____ _____ Additional inside corner reinforcements shall be 3 8 " thick plates. _____ _____ The cylinder hook up points shall be the 5 8 " plates with all cylinder holes to be reinforced with heavy wall tubing of sufficient length so as to not allow more than ¼" cylinder pin to be exposed at the shear point, thus minimizing the chance of pin bending. _____ _____ Table shall also provide positive stop blocks to stop the plow at 35 degrees to relieve the stress on the cylinders. _____ _____ Supporting and reinforcing the front tube shall be ½" 3 ½" flats, ½" x 4" flats and a 5" x 3" angle. _____ _____ Attached to each end will be plates of ½" x 7" material to which carrying devices such as cast shoes or caster wheels can be bolted. _____ _____ The carrying device plates shall be further reinforced by an angle of not less than 4" x 4" x ½" and ½" thick plate steel. _____ _____ Two (2) jockey bar ear attachments will be located on top of the angle reinforcements and shall be at least 1 ¼" x 3 ½" material. These ears shall accept the corresponding jockey bars which in turn connects to the moldboard assembly. _____ _____ The lift chain assembly shall include a zinc plated 7 16 " proof coil chain along with a cast steel chain block to help facilitate reversing the plow from right to left. _____ _____ PLOW A-FRAME A-frame shall consist of four (4) structural tubes a minimum of 4" x 2" x 316 " wall tubing and two (2) 5 8 " thick plates. _____ _____ This configuration shall be as two (2) a-frames, one (1) of which rides above the table and one (1) of which rides below the table, these two (2) being joined in the rear by a full piece of ¾" plate to form a deep "C" type configuration, which straddles the table. _____ _____ The tubing runs from the rear to the front on both top and bottom. The front of the tubing is joined together and reinforced on the top and bottom respectively by 5 8 " plates, which extends from the pivot point back to the reversing cylinder hook up point and acts as an integral part of both of these points. _____ _____ Page 40 of 44 ITEM #1 – MODEL YEAR 2010 OR NEWER, FREIGHTLINER 112V CAB/CHASSIS WITH THIELE MODEL 12 DUMP BODY, OR EQUAL (CONT'D) COMPLIANCE YES NO PLOW A-FRAME (CONT'D) Points are reinforced with heavy wall tubing to provide bearing surface for the pins and bolts. _____ _____ The a-frame to table pivot bolt shall be at least 2" diameter, 1045HR material and furnished with a slotted hex nut. _____ _____ A center cylinder pin common to both cylinders shall be 1 ¼" diameter. _____ _____ Connecting the four (4) push channels shall be the plow portion of the quick hitch. This member consists of a high carbon steel bar 1 516 " diameter cold formed into a "U" shaped loop. _____ _____ The loop shall penetrate into and weld to a 4" car channel which shall in turn be welded to the table push beams. _____ _____ The entire table assembly shall be designed to allow ample raising, lowering and oscillation of the plow. _____ _____ Permissible misalignment in hitching: Loop at rear of plow can be high or low through a range of 6". Truck can be right or left of center through a range of 7". _____ _____ The lift chain assembly shall include a zinc plated 7 16 " proof coil chain, repair link, ½" anchor shackle and a 7 16 " grab hook clevis. _____ _____ PLOW HYDRAULIC REVERSING MECHANISM Shall consist of two (2) double acting hydraulic cylinders of at least 4" inside diameter with piston rods at least 2" diameter with a stroke of at least 12". _____ _____ Cylinder piston rods to be treated with a nitro steel process to help prevent rusting. Chrome piston rods not acceptable. _____ _____ These cylinders shall be capable of reversing the plow from 35 degrees right to 35 degrees left, or hold the plow at any angle within this arc. The cylinder geometry and components of the hydraulic system shall be designed to hold the plow at any desired plowing angle without recourse to a locking device, under maximum load, without overloading rated capacities. _____ _____ SNOW PLOW MARKERS Snow plow to be equipped with two (2) plow markers. Markers to be constructed of high density polyethylene, 1 ¼" OD x 1" ID by 24" long, safety yellow with a flexible joint at the bottom and attached to the plow by means of cotter pins. _____ _____ ACCESSORIES (TO BE INCLUDED WITH PLOW) CARRYING DEVICE: Skid shoe assemblies must be of the hand adjustable type, enclosed and fully lubricated, with replaceable chilled cast iron shoes, mushroom shaped, at least 11" in diameter and 2 ½" thick. The level lifter will hold an equal elevation regardless of height raised above ground and regardless of moldboard plowing angle, whether full right, bulldoze, full left, or anywhere in between. Moldboard plowing angle can be changed to any desired position maintaining equal elevation without first lowering plow, changing plowing angle, and then relifting. Shall be provided with two (2) lifting chains, 16 proof coil chain x 60" long. (No Exception). _____ _____ 7 Under Tailgate spreader Monroe MS966SS, or equal General construction: Unit shall be a 6 inch stainless steel under tailgate spreader and shall be standard manufacture to mount directly onto the body previously specified. Unit shall consist of a 6” auger which can be replaced, if needed. The auger shall be direct drive (No Exception). The inside width shall be 83 and ½", and overall height shall be 36 and ½" and shall fasten to the body using quick disconnect pins for fast mounting and removal without the use of special tools. _____ _____ Stainless steel body: Shall be rigid ¼" end plates and shall be continuously welded to a 316 " steel body shell. (Materials used shall be 304 stainless steel, No Exception). The body is to be framed horizontally with 4" x 2" by 316 " stainless steel rectangular tube and vertically by 4" x 3" by 3 8 " steel angle. The unit will have a 316 " thick, three-point hinged bottom that will expose the entire auger for easy clean out. This hinged bottom shall be held in place by two (2) heavy-duty locks, with a lift handle for a one-man operation. To provide the ultimate safety, the bottom cannot be opened fully without disconnecting the hydraulic hoses. The spinner assembly shall be adjustable, allowing for variable spreading patterns by sliding the hinged frame sideways on the shaft so that the point at which the material hits the spinner disc is varied. The spinner assembly shall be adjustable in height, allowing four (4) different ground clearance settings by means of four (4) bolts. The entire spinner assembly shall be easily removed by pulling two (2) pins and uncoupling to hydraulic quick disconnect hoses. The spinner spread rate shall be compatible with Force America model SC 5100 PC 1 RFL, or equal, spreader control. The polymer spinner disc will be mounted directly on to the hydraulic motor shaft by means of a steel spinner hub. The spinner assembly shall remain horizontal to the road at all angles of the dump body.
