ECONOMIC STIMULUS PACKAGE LIKELY EARLY NEXT YEAR; WILL IMPACT ALL CONSTRUCTION MARKETS Congressional leaders have talked about an economic stimulus package that could total as much as $500 billion. It is unlikely that it would be taken up before the 111th Congress convenes on January 6, 2009, and it will not be sent to the president before President-elect Barack Obama takes the oath of office on January 20. It is widely expected that the infrastructure investment component of the package could represent 20-30 percent of the total stimulus package. Significant increased investment is expected in transit, airports, schools, roads, bridges, public housing, flood protection and waste water and drinking water infrastructure projects in the stimulus bill. Infrastructure investment is also strongly supported by President-elect Obama, who announced on November 21 a new initiative to save or create 2.5 million jobs in the next two years that includes infrastructure investment, school modernization and new energy policy initiatives. AGC’s CEO Stephen Sandherr and ARTBA’s CEO Pete Ruane, along with other transportation stakeholders, were invited to meet with President-elect Obama’s transportation transition team last week to discuss inclusion of significant transportation infrastructure investment in the economic stimulus legislation that is currently being drafted. Sandherr urged the new Administration to move quickly and decisively to avoid a further downturn in the economy, pointing out that reduced highway construction spending has already caused substantial employment losses and that further layoffs are inevitable unless the market changes. He noted that now is a good time for the government to purchase construction because the increase in the number of firms bidding projects and the decline in construction material prices has resulted in very competitive bids. Ruane specifically suggested establishing accountability processes and standards to quantify the impacts of any stimulus funds provided. He also stressed the new leadership of the U.S. Department of Transportation must be thoroughly briefed on the difficult budget forecast facing the federal highway and transit programs. At a meeting of the National Governors Association on December 2, the nation’s governors requested that the stimulus package include as much as $136 billion worth of road and bridge repair projects that are “ready-to-go.” The governors are also asking for direct aid to states experiencing significant budget deficits and urged President-elect Obama to consider establishing a national infrastructure bank that could issue bonds to finance infrastructure projects as part of the economic stimulus package currently being developed. Governor Joe Manchin told Charleston Gazette reporters that he went to the meeting armed with a list of projects that were ready to be bid, “about $585 million in highway projects could start tomorrow," he said. "He's looking for that -- what's ready to go. He's taken the approach of investing back into America, state by state. There are no giveaway programs. We've been doing this around the world for other nations. It's about time we started doing this for America.” Manchin also said that he approached President-elect Obama with the suggestion that regulations on federal money be eased. “We have so many mandates and conditions,” Manchin said. “Just a little bit of flexibility might get you a long way down the road without having to spend a lot more.”
Below are funding needs AGC has compiled from many owner groups that have been identified as “ready-to-go” projects. • • • Highways and Bridges: At least $30 billion for projects as identified by AASHTO Water Resources: $7 billion - $10 billion in new funding for the Corps of Engineers Drinking Water and Wastewater Treatment Systems: $10 billion for the repair and construction of publicly owned sewage treatment works, $10 billion in new financial aid to the nation’s drinking-water treatment systems Public Transit: $3.6 billion for transit projects already authorized Aviation: $600 million worth of capital improvement projects Dams: $50 million for the dams in greatest need of repair School Construction: $10 billion needed for repairs and new construction Federal Facilities: $1 billion for repair and alterations Public Housing: $1 billion for the Public Housing Capital Fund

Another central component of the stimulus package would be a “green-jobs” program. The program may include home weatherizing, installation of “smart meters” designed to reduce home energy use, tax breaks or direct government subsidies for a variety of clean energy projects, including solar arrays, wind farms, biofuels and clean coal technology. Members of Congress have also talked about spending $100 million or more on energy transmission upgrades. In November, the Senate Finance Committee proposed one-year extensions through 2009 of bonus depreciation and Section 179 elective expensing to help stimulate business investment. The bonus depreciation provision would allow a taxpayer to depreciate 50 percent of the cost of an asset in the year in which the asset was acquired (i.e., 2009). The Section 179 elective expensing provision would allow small businesses to elect, in lieu of depreciation, to deduct up to $250,000 for property acquired and placed into service in 2009. AGC has endorsed the section 179 expensing and has also proposed a full repeal of the 3 percent withholding law set to go into effect in 2011 as part of the stimulus package. In addition, AGC is working with owner groups to identify other tax incentives that would stimulate building improvements and construction such as accelerated depreciation of certain energy efficiency improvements or green building additions. CAWV LEGISLATIVE COMMITTEE TO EVALUATE TOP LEGISLATIVE AND REGULATORY PRIORITIES DECEMBER 9 On December 9 the CAWV Legislative Committee will meet at 2:00 p.m. to evaluate the association’s legislative and regulatory priorities for the 2009 session of the WV Legislature. The committee will evaluate the issues that will impact the industry that will be addressed in the coming year. The meeting will be held at the offices of West Virginia Heating and Plumbing Company, 1339 Smith Street, Charleston, WV. COURT RULES AGAINST PRIEST ON WAGE LAW A Raleigh County judge has denied a Roman Catholic priest's attempt to challenge the way West Virginia sets wages for public projects. Circuit Judge H.L. Kirkpatrick ruled Monday that there is no basis for overturning a Division of Labor rule upholding the prevailing wage. The wage is determined by surveys and inquiries and set on a county-by-county basis. The Rev. Thomas Acker claimed in his lawsuit that the calculation sets an artificially high wage by relying too heavily on surveys of organized labor. Acker is director of Forward Southern West Virginia and former president of Wheeling Jesuit University. The ruling is expected to be appealed.
LIQUID ASSETS AIRING STATEWIDE ON DECEMBER 15 WV Public Broadcasting will air Liquid Assets: The Story of Our Water Infrastructure statewide on December 15 at 9:00 p.m. The 90-minute documentary will be followed by a roundtable discussion on the state of West Virginia’s water and sewer infrastructure. Liquid Assets tells the story of essential infrastructure systems: drinking water, wastewater and stormwater. The film explores the deteriorated and neglected state of the nation’s complex water and sewer systems which are in need of urgent attention. “The goal is to raise grassroots awareness of water infrastructure investment needs,” WVUCA President Dave Alvarez said. “Liquid Assets is a tool to inform lawmakers, the public and industry professionals of the water infrastructure needs at both the state and local levels. WVUCA is working diligently to bring clean water to all of West Virginia and this documentary will help people understand what issues we are facing.” Members are asked to inform their employees of the broadcast to help spread the word about the substandard state of water and sewer infrastructure and the lack of funding to correct it. CAWV COLLECTING TOYS AND FOOD AT OPEN HOUSE ON DECEMBER 9 As a weak economy forces area residents to tighten their belts, the local Salvation Army has received a record amount of requests for Christmas assistance. The CAWV is partnering with The Salvation Army’s annual Toys for Kids and food pantry program and asks that members attending the December 9 Holiday Open House bring either canned food or an unwrapped gift for a child in need. The Holiday Open House will be held on Tuesday, December 9, at CAWV Headquarters, from 4:00 p.m. to 6:00 p.m. CAWV members and staff will enjoy light hors d'oeuvres and conversation during the evening event. This has historically been a great opportunity for members to get together and network in a comfortable environment, as a large number of members come to the association for the holiday festivities. CONSTRUCTION FIGURES FOR OCTOBER 2008 Contracts for future construction in October 2008 were down 1 percent from October 2007 figures. Nonresidential construction decreased from $29 million in October 2007 to $28 million in October 2008, a 5 percent decrease. Residential construction was down from $59 million in October 2007 to $37.9 million in October 2008. Nonbuilding construction was at $48.8 million in October 2007 versus $70 million in October 2008, a 45 percent increase. Nonbuilding construction includes roads, bridges, water and sewer facilities, dams and airports. 2007 nonbuilding figures to date include the $1.3 billion Longview Power Plant in Maidsville. If the Longview Power Plant is removed from the data, year-to-date nonbuilding construction is down 13 percent and total construction for 2008 is down 31 percent. MIKE ZIRKLE TO LEAVE CAWV Mike Zirkle, CAWV’s director of member services, has decided to retire. Mike has been with the CAWV for five years and headed up the association’s membership recruitment and retention programs, numerous committees and has been an integral part of the CAWV family. “I would like to express my sincere appreciation and thanks to members of the CAWV, including the Board of Directors, for providing me with the opportunity to work for the association,” said Mike. “Mike did a terrific job for the members of the association and we wish him well in his retirement,” said CAWV Executive Director Mike Clowser. Mike’s last day is December 31. CAWV YOUNG CONTRACTORS COMMITTEE PARTICIPATING IN CANSTRUCTION CAWV Young Contractors Committee Chairman Nate Orders is pleased to announce the group will be participating in the “Canstruction” competition, to be held at the Clay Center on February 25. Canstruction is an annual competition where teams within the design and construction industries compete to build structures made entirely from canned foods. All food is donated to the Covenant House food pantry and the public is invited to view the structures from February 25 to March 1. The first meeting of the Canstruction team will be held on December 9, at 3:00 p.m., at the CAWV Headquarters, just prior to the CAWV Open House. December 5, 2008 MANAGING CRISIS THREATS TO YOUR BUSINESS Part II of Three Part Series Question: What do I do if we have a crisis involving our company? Here are some tips on how to handle the inevitable questions: ! What happened? This question will be the most frequently asked and of utmost importance to answer correctly. First and foremost, develop a plan for response to the media. Identify who is authorized to make statements on behalf of the company. Select a company spokesperson(s). Educate all employees as to who has the authority to talk with the media as company spokesperson and who does not. When speaking, keep it brief. Give only the information you know. As an example: “An incident took place at (time and date) that we are currently investigating. We do not have any details related to the incident that we can report. The investigation will be ongoing for some time. Exactly what happened will be determined after the investigation is complete. We cannot tell you anything more than that at this time. Our company (give name of company) is committed to the highest safety and quality standards and we are doing everything possible to find the cause of this crisis. Thank you for your concern.” Depending on the kind of crisis your company is experiencing, you will what to customize your response to fit the situation. The plan for response to the media is so important. Develop a plan and be prepared to react to any given crisis, before it happens. ! Who was at fault? Never point the finger. Never speak of fault. Do not place blame. Check your emotions. This is a time when you must remain calm and professional. Remember, the investigation is ongoing and no determination as to what happened will be known for some time. How serious is the situation? Be prepared to have media persons quote a statement from others whom they may have already interviewed, when they ask you about how serious the situation is. They may have spoken to other persons who said they were eyewitnesses or “reliable sources.” You can only speak of things you know, not what others may have said they saw or know. Be careful not to call the other person, eyewitnesses, or so called reliable sources a liar, or accuse them of not knowing what they are talking about. Remember, stay focused and be brief. MU 2008-49 December 5, 2008 CAWV JOINT UTILITIES COMMITTEE MEETS TO DISCUSS INDUSTRY ISSUES The CAWV Joint Utilities Committee met Tuesday, December 2, to discuss industry issues. Reports indicate that manufacturers of materials such as PVC, ductile iron or related pipe fittings are reducing shifts and lowering inventories. Availability of materials remains good at this point; however, contractors are encouraged to stay in close contact with suppliers to make sure price quotes and availability of materials are good at the time of shipment. The CAWV will continue to monitor market conditions and report any significant changes. The committee discussed initiatives to get projects funded, in design, out to bid and under construction in a shorter time frame than has historically been the case. Funding agency representatives will establish a task force to study ways to get projects out for bid and under construction sooner. In addition, agency representatives will study how to standardize contract document supplementals in order to streamline the bidding process. Committee members watched a preview of Liquid Assets: the story of our water infrastructure that will be broadcast December 15, at 9:00 p.m. on West Virginia Public Broadcasting stations statewide. The WV PBS broadcast will be followed by a 30 minute round table discussion about the state of West Virginia’s water and wastewater infrastructure. Committee members heard a forecast of Abandoned Mine Lands (AML) Funded Waterline Projects planned to put out for bid in 2009. SCAFFOLDS: SUPPORTED Supported scaffolds consist of one or more platforms supported by outrigger beams, brackets, poles, legs, uprights, posts, frames, or similar rigid support. Supported scaffolds include fabricated frame scaffolds, tube and coupler scaffolds, wall brackets, form brackets, and ladder jack and pump jack scaffolds. Follow these precautions to help provide adequate structural support and fall protection for workers: • Construct scaffolds on a level foundation. Make sure poles, legs, posts, frames, and uprights are set on base plates and mud sills when required. Make sure footings can support the loaded scaffold without settlement or displacement. Inspect scaffolds prior to use to ensure they are stable and secure. A scaffold must be capable of supporting its own weight plus four times the maximum intended load. Plumb or brace legs, posts, frames and uprights to prevent swaying or displacement. Connect frames and panels by cross, horizontal, or diagonal braces, as designed, to secure vertical members together laterally. Do not use unstable objects to support scaffolds or platforms such as boxes, buckets, barrels, etc. Only use scaffold system components. When a supported scaffold reaches a height that is more then four times its minimum base dimension, (4:1), retrain the scaffold by guy wire, ties, or braces to prevent it from tipping. Use fall protection (either a guardrail system or a personal fall arrest system) when working on any scaffold 10 feet or more above a lower level. When working on a suspension scaffold, use both a guardrail and a personal fall arrest system. Inspect all scaffolds prior to use or at least on a daily basis. Always use scaffolds under the oversight of a competent person. Ensure that all workers erecting and using scaffolds are trained in safe work practices and OSHA standards prior to use.

SUPREME COURT RULES ON EMINENT DOMAIN ISSUE In a 3-2 ruling, the West Virginia Supreme Court of Appeals affirmed a Logan County Circuit Court case which upheld the WV Department of Transportation’s ability to condemn property when necessary to accomplish a public purpose. Heeter Construction Company objected to WVDOH’s condemning its property for a waste site for the Route 10 Logan County project. Logan County Circuit Court Judge Eric O’Briant on June 8, 2007 ruled in favor of WVDOH. The WVDOT said it was necessary to condemn the contractor’s property for right-of-way and easement for the construction of the road. Heeter objected and filed a motion to dismiss and requested a preliminary injunction in Logan County. In the November 14, 2008 filing, the state’s high court affirmed the lower court’s ruling. The Supreme Court ruling basically gives WVDOT full ability to do what it did and defines that the department can take land under the circumstances that were presented. The ruling does not address the policy issues that were outlined in the CAWV’s amicus brief filed on behalf of the industry and Heeter Construction. The court also refrained from making any negative comments on either Heeter’s or the CAWV’s arguments. The ruling appears straight forward in that it does not try to restrict the WVDOT’s use of eminent domain. Justices Spike Maynard and Brent Benjamin dissented. JUSTICES BLOCK POCAHONTAS QUARRY All five Supreme Court Justices ruled November 14 to block operation of a 76-acre sandstone quarry in Pocahontas County. On November 14, all five Justices upheld the West Virginia Surface Mine Board, which denied an application of Waco Oil and Gas Company for a quarry permit. The Justices reversed Kanawha Circuit Judge Paul Zakaib Jr. ruling last year that Waco Oil and Gas could operate the quarry. Zakaib held that the Mine Board could not declare a quarry unsuitable for an area without declaring the area unsuitable for any quarry at any time. Justice Larry Starcher wrote that determining whether to ban all quarrying in an area would present an "enormous and inevitably somewhat speculative task. Rather, we conclude that a case by case permit approval/denial process is what the statutes call for," he wrote. The quarry "would have caused substantial damage to the present and future well being of the county, and specifically to local businesses, residents and visitors," he wrote. DOMINION POSTS EXPLORES STATE ROAD FUNDING SHORTAGE The Sunday, November 30, issue of the Morgantown Dominion Post featured an article which explores the funding crisis facing the WV Division of Highways. Titled, “DOH strapped for road funds - Need $350 million more per year, but funds declining,” discusses West Virginians for Better Transportation, the division’s new annual plan formula and the Statewide Transportation Improvement Program. “The DOH’s draft STIP document for 2009 - 2014 shows that funding isn’t likely to improve - in fact, it’s projected to decline,” the article says. “Combined revenue (federal and state) for FY 2009 is $1.131 billion. That will drop to $1.114 billion in 2010, and drop steadily to $1.037 billion in 2014. Because of inflation, the actual purchasing power will be even less. The STIP shows that 2014's $1.037 billion will be worth only $764 million in 2007 dollars,” the article states. “The DOH road fund is projected to be $106 million in the red at the end of FY 2009. DOH strapped for road funds Need $350 million more per year, but funds declining
The Dominion Post, November 30, 2008 The state of West Virginia needs to acquire an extra $350 million per year to keep up with needed maintenance demands and highway construction, W.Va. Division of Highways officials said. “Yes, the DOH is strapped for cash,” said John Walker, state highway engineer of maintenance for the department of transportation. “The costs of construction materials have increased very significantly over the past four years. We have a large number of needed improvement projects that are unfunded. Our limited funding is being used more and more to maintain the existing 37,000 miles of roads and 6,800 bridges in our inventory.” The Statewide Transportation Improvement Program (STIP) document notes that the state road fund budget is about $1 billion for Fiscal Year 2009, but the demand for work exceeds that amount. Monongalia County gets a share of that, but a bad winter could make it difficult to even keep area roads salted, officials said. West Virginians for Better Transportation, a coalition of business leaders and community groups, has conducted an educational outreach program called Keep West Virginia Moving “to express concerns about West Virginia’s transportation crisis and to call on state leaders to develop long-term solutions,” according to its Web site. Studies and reports linked on the site — including the Reason Foundation’s 17th Annual Report on the Performance of State Highway Systems — note that 27 percent of West Virginia’s major roads are in poor or mediocre condition and the state leads the nation in percentage of narrow lanes, with 67 percent of its major roads less than 10 feet wide. During this fiscal year, the DOH began using a new annual plan formula that will increase funding to the 55 counties by 3.5 percent. Monongalia County has seen slight increases in its annual DOH maintenance budget over the past three years, but the increase for fiscal year 2009 (July 1-June 30, 2009), is larger under the new DOH annual plan formula. Maintenance funding for Mon County in fiscal year 2009 is $3,895,097 — a $218,267 increase (5.9 percent) over its 2008 budget of $3,676,830. The 2008 budget reflected a $38,696 (1 percent) increase over the 2007 budget of $3,638,134. The 2007 numbers reflected an increase of $123,029 (3.5 percent) over its 2006 budget of $3,515,105. The new DOH annual plan formula uses these factors to determine each county’s maintenance budget: personnel costs, snow and ice removal, utility and janitorial bills, and miles traveled on the county’s roads. DOH spokeswoman Karen Zamow said that the formula assesses each county’s individual needs. There is no DOH ranking system that allots more maintenance funding to some counties than others. “The previous formula was based on several factors including climate, geology and vehicle density,” she said. “This formula was problematic as it underestimated the maintenance need of county organizations and had to be adjusted frequently. The new formula is much more efficient and better addresses the maintenance needs of DOH county organizations.” For DOH fiscal year 2009 — July 1, 2008 through June 30, 2009 — Mon County’s maintenance funding amounts to about $13,478 per day for labor, materials, equipment, utility bills and janitorial services, said Jeff Pifer, assistant engineer of maintenance for DOH District Four office in Clarksburg. DOH District Four contains six counties with a total 4,850.7 miles: Monongalia, 894.93 miles; Harrison, 929.29 miles; Marion, 789.60 miles; Doddridge, 550.64 miles; Preston, 1,272.25 miles; and Taylor, 413.99 miles. “From July 1 to Nov. 15, we reduce the per day amount to try and come into winter with a 5-percent surplus to cover snow and ice costs which are hard to accurately estimate since we are dealing with Mother Nature,” Pifer said. To gather the surplus, Mon County spends about $11,900 per day during that period — equipment and labor run roughly $11,000, and materials and invoice costs take up the remaining $900.
“One 10-ton load of blacktop runs almost $800, so the money doesn’t go very far,” Pifer said. “If we have a mild winter, we should have a surplus of money to work with come spring. Conversely, a bad winter will most likely result in very little funding to work with in the spring.” Prices on salt and asphalt have also gone up: Salt was $42 per ton last year and now costs $125 per ton; asphalt was $45 per ton and is now $75 this year, Pifer said. “From a salt standpoint, every state in the country faces a looming salt shortage,” said Department of Transportation spokesman Brent Walker. “We’ve got enough for this season, but salt is going to be a growing problem for the country from a funding standpoint. We will be fine. One area of the state is not going to have to stay frozen. If it’s an extremely tough winter, we will move resources throughout the area.” Construction funds The DOH’s draft STIP document for 2009-2014 shows that funding isn’t likely to improve — in fact, it’s projected to decline. It projects operating in the black at the end of 2011, with a surplus of $7.8 million. The STIP authors note that a shortage of funds is sometimes challenging for the public to understand when the road fund is about $1 billion. “The concepts of fiscal constraints and limitations are frequently difficult for individuals to grasp,” the document says, “when they know that WVDOH has an annual budget of approximately $1 billion. ... A rudimentary tabulation of the needs that exist indicates that highway needs exceed funding available to meet them. The costs associated with some identified needs, such as fixing all deficient bridges, could consume all available state highway funds.” The $1.131 billion gets divided in several ways, according to the STIP. For FY 2009, about $50 million goes to debt service; $68 million goes to administrative costs; $272 million goes to routine road maintenance. A variety of mandatory “set-asides” takes up another nearly $40 million. What’s left — about $264 million from the state and $465 million from the federal government — is available for highway improvements. Most DOH operations are paid for through the annual state road fund, derived from fuel taxes; vehicle registration, title and permit fees; and federal reimbursements distributed to first-priority road projects with a high number of vehicle miles traveled. “Because the division of highways does not have an unlimited budget, it is necessary that construction projects be prioritized to work within the given budget,” Zamow said. “Routes such as interstates and U.S. highways are the most heavily traveled in the state, thus making them first priority for construction and maintenance operations such as snow removal and ice control.” Second-priority routes are county routes and routes with a lesser volume of traffic; third-priority routes have an even smaller amount of traffic, the STIP document says. Mon projects Current Monongalia County roadimprovement projects include constructing a turning lane on BeechurstUniversity Avenue; a W.Va. 705 connector that includes building a road and a bridge; and adding turn lanes on Patteson Drive, according to STIP document. Construction of turning lanes on Beechurst-University Avenue and Patteson Drive are scheduled to begin in spring 2009; the W.Va. 705 connector project is still in the design phase, Zamow said. Monongalia County Commissioner Asel Kennedy, who is chairman of the Morgantown Planning
Organization, said the group is involved in the design work for the University Avenue turning-lane project. The plan does not include removing any University Avenue businesses to make room for the turning lane, he said. Resident concerns In e-mails to The Dominion Post, local residents expressed their concerns about the poor condition of some lower priority roads that receive little attention, and the number of trucks that travel on downtown Morgantown roads. H. Frank Hazelwood, of Morgantown, said parts of Williams and Lawless roads near Kmart, in Morgantown Commons, are in a dangerous state. Hazelwood said he has contacted the DOH several times about maintenance and was told that the repairs are on a project list. “There are seven blind curves, weeds are laying over to the center of both sides to the middle and [there are] very large holes. ... We asked to repair the road ourselves and we were told that we are not allowed to fix anything,” he said. Zamow said that “while citizens may become frustrated, the entire division, including county and district offices, must work within allocated budgets and prioritize improvements accordingly.” Residents who are waiting on road improvements may submit a written request for a traffic study or contact their local government or congressional members in an effort to help the DOH try to secure more funding for road improvement projects, she said. Rick Landenberger, of Morgantown, said the DOH should restrict truck travel in Mon County, so fewer repairs would be needed. “I have been a resident of Morgantown for 15 years and have always been amazed at the amount of heavy truck traffic in the downtown area,” he said. “They have a tremendous impact on the roads by buckling the pavement and creating potholes. Of course, the impact they have on air quality and quality of life [their noise] has significant costs to the community as well.” If a truck is adequately licensed and hauling a load that meets the road’s weight requirement, the DOH cannot restrict truck travel, Pifer said. The DOH is working with the statewide coalition West Virginians for Better Transportation to help spread awareness about the division’s operations and funding challenges. “We have spent a lot of time explaining, educating and collaborating with the Legislature, the general public and anyone else on how the DOH is funded,” Zamow said.
