The untimely sending of a validation notice and the improper verification of a debt by third-party debt collectors constitute violations under the FDCPA. Common mistakes in complying with the validation and verification provisions of the FDCPA can be corrected by making appropriate modifications to a collection agency's comprehensive compliance program.Upon receipt of the consumer's written request for verification within the 30-day validation period, the FDCPA requires debt collectors to cease collection activity until verification is provided to the consumer. ACA's Code of Ethics indefinitely extends the 30-day validation period, allowing consumers to request verification at any time during the collection process. Under the Code of Ethics, members who are unable to provide verification must report the debt as disputed or remove the debt from the consumer's credit report if furnishing data to consumer reporting agencies.
