                               Regular Meeting and Public Hearing
                                   Wednesday, April 05, 2000
                     Guilford Community Center, Faulkner Room 7:30 p.m.

Members Present: Fisher, Bartlett, Kingsbury, Guadagno, Dostert and Barry

Alternate Present: Havrda

Excused: Cartier

Absent: Alternate Catardi

Staff Present: George J. Kral, Jr., Town Planner and Reggie Reid, Recording Clerk.

Chairman Kingsbury started the meeting at 7:30 p.m. He introduced members of the
Commission and staff. He noted members Fisher, Bartlett, Kingsbury, Guadagno,
Dostert, Barry and Alternate Havrda would be sitting for this meeting.

Secretary Guadagno read the call of the meeting.

Chairman Kingsbury explained how the Public Hearing would be conducted. First the
applicant would present their application. Members of the Commission would then ask
questions for clarification, followed by questions for clarification from members of the
public present. Next members of the public present who wished to speak in opposition to
the application may do so. Lastly people who wished to speak in favor of the application
would have a chance to be heard.

Public Hearing

A.     Subdivision

1.     PMC Design Build, “Oak Crest Subdivision” Map 78, Lots 6 & 7, Zone R-8. Re-
       Subdivision; transfer area of Lot 7 to Lot 6. (Subdivision Code, Chapter 272)

Maurice Woodworth presented this application. He showed on a copy of the original
Open Space Subdivision map Lots 6 and 7. He explained 1125 square feet of Lot 7 will
be given to Lot 6 for reason the road was constructed in the wrong place along the catch
basin.

Hearing no more questions or comments for or against this application Chairman
Kingsbury closed this portion of the Public Hearing at 7:40 p.m.

B.     Coastal Site Plan
1.     John Terenzi, 1238 Boston Post Road, Map 46, Lot 51, Zone R-6. Coastal Site
       Plan; New Dwelling. Anderson Associates. (Zoning Code § 273-91)

Jonathan Bodwell of Anderson Associates presented this application. He stated the
following;

The site is located off Boston Post Road and Three Mile Course Road. It is a rear lot that
was approved in 1985. The drive for the single-family dwelling is proposed along the
cemetery wall from Boston Post Road. Minor grading is required and a little for the
backup area. The dwelling is as far away from the tidal wetlands as possible (65 feet)
and against the building line of the lot. The soil erosion control line was shown in red
and the sanitary system was shown in light green on the record map.

Guadagno asked how the site line is coming up the hill.

Bodwell stated it is fine.

George Kral stated two letters were received concerning this application. A letter from
Gary Waters, 74 Farm View Drive, is opposed to the application for flooding and wildlife
habitat reasons. A letter from Paul and Gladys Minear, 64 Farm View Drive, asked that
no trees be cut down in the wooded area.

Chairman Kingsbury read Town Engineer Jim Portley’s memo.

Bartlett suggested the Walk Committee walk this site.

Upon a motion by Fisher and seconded by Bartlett it was voted to continue this Public
Hearing to April 19, 2000 to receive a walk report.

ABSTAINED: None

This Public Hearing was continued to April 19, 2000 at 7:47 p.m.


C.      Special Permit

1.      Gene M. Jones, 1294 Route 80, Map 101, Lot 13, Zone R-8. Special Permit;
        Accessory Building in excess of 750 square feet and workshop in building.
        (Zoning Code § 273-36 and § 273-38. B.)

Gene Jones presented his application. He showed the Commission his reproduction of an
antique style barn. He stated the following;

The 23 foot high, 900 square foot, timber frame barn will sit on sona tubes and will be
used for his personal workshop and storage of power saws and equipment. He received a
3-foot variance for the height of the structure. He also showed the Commission pictures
of his house and the existing accessory building.

Chairman Kingsbury read Town Engineer Jim Portley’s memo. Hearing no more
questions or comments for or against this application Chairman Kingsbury closed this
portion of the Public Hearing at 7:55 p.m.

2.     Adam Cost, 3120 Durham Road, Map 113, Lot 29, Zone R-8. Special Permit;
       Accessory Apartment and request to waive professionally prepared site plan.
       (Zoning Code § 273-99, § 273-19 & Article X)

Jeff Hocking presented this application. He stated the following;

There is an existing 660 square foot accessory building has been on the lot prior to 1974.
Cost will occupy the accessory building, enlarging it to 998 square feet and build a home
on the lot in the future.

Chairman Kingsbury read Town Engineer Jim Portley’s memo. Hearing no more
questions or comments for or against this application Chairman Kingsbury closed this
portion of the Public Hearing at 8:00 p.m.

3.     LIS Homes, LLC, 749 Long Hill Road, Map 79, Lot 1, Zone R-5. Special Permit;
       PRD 14 Lots and construction of pond. Anderson Associates. (Zoning Code
       Article VIII, Article XI)

The applicant was not present. The Commission discussed continuing this portion of the
Public Hearing.

Upon a motion by Fisher and seconded by Guadagno it was voted to continue this Public
Hearing to April 19, 2000.

ABSTAINED: None

This motion carried 7-0-0.

Chairman Kingsbury explained to the public present that the applicant asked George Kral
to have the Public Hearing continued to the next meeting because attorneys were in
conference, the applicant is not here so the Commission has continued the Public Hearing
to April 19, 2000.

An unidentified woman stated she did not want the hearing continued to April 19th
because it is a school vacation date. Several other unidentified men and women of the
public present also voiced their displeasure with this date.

Fisher motioned and Guadagno seconded to rescind their motion to continue the Public
Hearing on April 19, 2000. Fisher motioned and Guadagno seconded to continue the
Public Hearing to May 03, 2000.

This motion carried 7-0-0.

Harvey Edelstein, the applicant appeared. He was told by the Commission the hearing
was continued to May 3rd. He stated this would create a financial hardship for him.

The Public Hearing portion of the meeting was closed at 8:10 p.m.

Regular Meeting

Upon a motion by Fisher and seconded by Guadagno it was voted to accept the revised
agenda.

A.     Consideration of public hearing of items above

Upon a motion by Fisher and seconded by Bartlett it was;

VOTED:        That the Guilford Planning and Zoning Commission approve a
              Resubdivision of “Oak Crest” Subdivision, Map 78, Lots 6 & 7, Zone R-8,
              for PMC Design Build as shown on “Map Showing Revisions to Property
              Line 6 & 7 Oak Crest Subdivision Catullo Drive Guilford, Connecticut”,
              prepared by Waldo and Woodworth P.C. dated 2/15/00, revised to
              3/20/00.

This application is approved based upon a finding that it conforms with the Zoning and
Subdivision Code of the Town.

This application is approved based upon a finding that it conforms with § 273-36 and
§ 273-38 of the Zoning Code. The Special Permit is effective on April 12, 2000 and
upon filing with the Town Clerk.

Kral noted the applicant could have the accessory building containing an accessory

Upon a motion by Guadagno and seconded by Fisher it was:

              Permit application for an Accessory Apartment for Adam Cost, 3120
              Durham Road, Map 113, Lot 29, Zone R-8 as shown on an application
              dated March 06, 2000.

Commissioner Bartlett recused herself and did not vote.


5.     LIS Homes, LLC, 749 Long Hill Road, Map 79, Lot 1, Zone R-5. Special Permit;
       PRD 14 Lots and construction of pond. Anderson Associates. (Zoning Code
       Article VIII, Article XI)

Chairman Kingsbury spoke of moving the application of LIS Homes, LLC to May. He
noted it is the applicant’s preference as to when an application is heard. The Chairman
stated he felt the Commission puts itself at risk by continuing this hearing to May and by
letting the public determine when a hearing is held.

Barry stated people don’t understand the Commission acts in a quasi-judicial body.
People feel they can come to a meeting and tell the Commission how it should run a
meeting.

Chairman Kingsbury noted that at the Public Hearing tonight a lot of comments were
made and people were absolutely out of order.

B.     Mandatory Referral

1.     Proposal of Sunset Creek Development for swapping/conveying land on Mill
       Road, Map 46, Lot 66 in exchange for Town owned land on Mill Road, Map 46,
       Lot 60A. Swap land on Cherry Street, Map 46, Lot 57 and an additional sum of
       $25,000.00 for Town owned land on Mill Road, Map 46, Lot 60.

George Kral showed parcel B and the parcel with the house (now or former of Schmidt)
which is to be swapped by Sunset Creek with the Town plus the sum of $25000. He also
showed the Open Space, which borders Town land. He explained the Town would give
the house to the Guilford Interfaith Housing. The developer benefits with access to Mill
Creek lots in the rear. The lot next to Mill Pond is valuable to the Town.

Barry noted the benefit is to Mill Pond, which is a skating center, and more land next to
it.

Kral continued Guilford Interfaith benefits with a better house. Presently they lease
however they have to agree to this (house) also.

Barry affirmed the Town is picking up a unique piece of property on the pond.

Kral stated the developer gains a lot.

Bartlett added the thing that bothers her is there are so many lots and the Town is not
getting much Open Space.

Kral replied the regulations only allow 15%.

Barry explained that looking at the drawing you don’t see that much, but when you
actually go and walk that site you see the value of it.

Upon a motion by Fisher and seconded by Guadagno it was;


VOTED:         That the Guilford Planning and Zoning Commission reports favorably on
               the proposal of Sunset Creek Development for swapping/conveying land
               on Mill Road, Map 46, Lot 66 in exchange for Town owned land on Mill
               Road, Map 46, Lot 60A. Swap land on Cherry Street, Map 46, Lot 57 and

            an additional sum of $25,000.00 for Town owned land on Mill Road, Map

C.     Site Plan

1.     Daniel Carter, 116 Whitfield Street, Map 40, Lot 168, Zone C-1. Site Plan; Hair
       Salon. Receive. (Zoning Code § 273-97 and Article IX)

Upon a motion by Bartlett and seconded by Barry it was unanimously voted to receive
this application.

Daniel Carter presented his application. He stated the following;

His father had a stroke a couple of years ago and no longer uses the building. Daniel’s
wife wants to put in a beauty salon. He showed the site and told of the work they have
already done.

George Kral told the Commission this is a site plan for a change in use.

Barry asked how many customers would be visiting the site.

Carter stated 24 to 30 customers per day, there are 8 parking spots.

Upon a motion by Dostert and seconded by Fisher it was;

VOTED:         That the Guilford Planning and Zoning Commission waive the
               requirement for a professionally prepared Site Plan for Daniel Carter, 116
               Whitfield Street.

Upon a motion by Dostert and seconded by Fisher it was;

VOTED:        That the Guilford Planning and Zoning Commission approve a Site Plan
              application for a Hair Salon for Daniel Carter, 116 Whitfield Street, Map
              40, Lot 168, Zone C1 as shown on an application dated March 22, 2000
              prepared by the applicant. This application is approved with the
              following conditions;

1.     That the existing evergreen plantings along the northerly property line are to
       remain.

2.     That the driveway and parking area will have a crushed stone surface.

This application is approved, based upon a finding that it conforms with the Zoning Code
of the Town.

Upon a motion by Bartlett and seconded by Guadagno it was voted to receive this
application and set a Public Hearing date of May 03, 2000.

F.     Correspondence

1.     Letter from John and Concetta Filardi, 478 Saw Mill Road; Re: Environmental
       concerns of the density of the LIS Homes’ PRD application and the proposed
       pond.

No action taken, for information only.

2.     Letter from Dr. Terrence Macy, SARAH Tuxis Residential Services; Re:
       Response to cease and desist order from Zoning Enforcement Officer and request
       for temporary Certificate of Zoning Compliance to finish site work and septic
       system.

George Kral stated at the last meeting the Commission decided to issue a cease and desist
order. SARAH appealed the order and requests a temporary Certificate of Zoning
Compliance.

Barry was in favor of upholding the cease and desist order.

Kral noted the appeal of the cease and desist gives SARAH time.

Fisher agreed that is the process.

Upon a motion by Barry and seconded by Fisher it was voted to deny the temporary
Certificate of Occupancy.

3.     Letter from Gayle Capozzalo-Heil, 110 Lower Road requesting further discussion
       of Crawford Coastal Site Plan, 80 Lower Road.

George Kral explained Joan Rawlings, 101 Lower Road, pointed out two inconsistent
drawings were filed with the Planning and Zoning Commission with a difference of 20
feet. He noted the Rawlings were satisfied as long as the developer stick to the town
ordinance of 35 feet above grade. They were so uncomfortable with the submitted plan,
the builder agreed to come down 4 feet. The Cam line and the 100-foot flood line were
drawn differently with the new drawings. Because of the 34.5 foot house above a 3 foot
foundation with new drawings filed with the town, the Rawlings request the Commission
require the owners show without question that they are not in violation of this height with
an independent surveyor.

Kral further explained the issue comes down to methodology of how to get the average
existing natural grade. 23.25 feet on the existing foundation is the key number. He
showed the Commission how the surveyor has overlaid this drawing on the site plan with
2 foot contours and has done a number of calculations;

1.     At the corners made five readings averaging 19.7 feet

2.     At the distance of 10 feet from the building comes up with 20 feet + or -.

3.     Took 15 elevations scattered around and comes up with 19.5 feet.

So the surveyor’s suggestion is the average grade is 20 feet.

Kral continued this site is sloped so it is bias to do 3 on the upper and 2 on the lower but
if you take the four numbers on the outside it comes up with 19 feet. Chairman
Kingsbury suggested you draw a line around the foundation and if you added all those up
you come up with 18 feet. Now you’re allowed to be 35 feet above 18 feet which equals
53 feet, subtract 23 feet and it is 30 feet.

Maurice Woodworth explained that they take a whole bunch of spot elevations,
interpolate between them, and put them on the map. He shot the elevations on the ground
which are more accurate.

Kral stated what we’re talking about is a foot. It is fairly significant to the builder.

Joan Rawlings stated the house is much too big for the site that it is on.

Chairman Kingsbury noted they can move the house around any way they want on the lot
so long as they meet the setbacks.

Rawlings asked if they can make it bigger?

The Chairman stated yes as long as they meet the setbacks

Nick Rawlings stated the following;

At the presentation (Public Hearing 12/01/99 and 12/15/99) they (Kelly) showed 34.5
feet. What has happened is he showed 31.1 feet to achieve the 35 feet. It is the same
diagram the Commission saw before except the roof shape has changed. Because the
area has been filled in, a bank has been created, the original lot did not have a bank. So
his reading is 17.5 or 18 feet.

Guadagno asked if Rawlings did the measure on the site.

Rawlings stated they were not allowed on the site.

Kral noted they can only rely on the drawing Woodworth made.

Nick Rawlings stated the building will be 20 feet higher than the applicant stated at the
Public Hearing.

Woodworth stated the critical thing is where the flood boundary is so a lot of shots were
taken there.

Dave Kelly, 15 Davis Drive, stated the following;

There was a meeting in the Town Hall about a week ago with George Kral, Bill McAvoy,
Barry Cox, Cathy Crawford and himself. At that meeting George Kral asked for the
average heights around the building. The method Woodworth used was approved by the
Town. Kelly stated he measured the building and made sure it was within the 35 foot
limit using it as an accepted permit approved by the Town. For the height of the house he
used the differential of the elevation of 18 and the 23 foot foundation elevation difference
between the top of the foundation and shots on the ground approved by the Town. He
agreed the total height of the building cannot exceed 35 feet. They changed the pitch of
the roof from 12 feet to 9 feet.

Joan Rawlings stated she wants a survey to be done when the house is finished and asked
that a Certificate of Occupancy not be issued unless the height is 35 feet.

Ginny Baltay, who stated she lives across the street from the house, asked how do you
know it is what Maurice says it is?

Chairman Kingsbury stated he is a registered engineer and has a stamp.

Woodworth stated he is a surveyor.

4.    Letter from Garry Waters, 74 Farm View Drive, Re: In opposition to the
      application of John Terenzi, 1238 Boston Post Road

No action taken, for information only.

5.     Letter from Paul and Gladys Minear, 64 Farm View Drive, Re: application of
       John Terenzi, 1238 Boston Post Road, requesting trees be left in the buffer zone
       between their property lines.

No action taken, for information only.

6.     Request from Yesterday’s Treasures, 2311 Boston Post Road to hold their semi-
       annual tent sale April 7, 2000 through April 9, 2000.

Upon a motion by Fisher and seconded by Barry it was;

VOTED:         That the Guilford Planning and Zoning Commission approve a request
               from Yesterday’s Treasures to conduct their annual tent sale at 2311
               Boston Post Road on April 7th, 8th and 9th, 2000.

IN FAVOR: Fisher, Bartlett, Kingsbury, Guadagno, Dostert, Barry and Havrda

OPPOSED: None

ABSTAINED: None

This motion carried 7-0-0.

7.     Letter from Mark Fernandes, agent for Wilber and King Nurseries requesting
       permission to be granted a Certificate of Occupancy prior to completion of the
       driveway and parking lot and a willingness to post an $8000 bond to ensure such
       completion.

George Kral stated it is possible all the driveway stone will not be down by their opening
and the Certificate of Occupancy.

Upon a motion by Fisher and seconded by Guadagno it was;

VOTED:         That the Guilford Planning and Zoning Commission approve a request
               from Wilber & King, 350 Goose Lane, to receive a Certificate of
               Occupancy with the condition that in the event that the driveway is not
               completed Wilber & King Nurseries agrees to post a bond in the amount
               of $8000 to insure completion.

H.     Other Business

1.     Discussion of report on Site Plan review procedure - J. Barry

George Kral stated we’re in the process of doing that. We promised ourselves we would
do that by May 01, 2000.

George Kral told the Commission he heard from Town Counsel that the Town won the
Super 8 Motel appeal.

Dostert reported there will be another public meeting on April 26, 2000.

Guadagno asked about parking for the new Railroad station.

Kral stated it will be on the south side.
Guadagno asked about a land inventory, what has take place in the last 5 years and what
it costs the town with the impact of schools, fire, police etc.?

Kral replied Jerry Silbert and Janice Plaziak are using GIS to calculate how many
building lots can be created with the zones that the lots are in. He doesn’t know where it
is now and that is something they have said they would do, a build out study.

3.     Discussion of advantages and disadvantages of Gozzi property subdivision and
       PRD development plans, West Street, Map 104, Lot 51, Zone R-8 - Anderson
       Associates.

Mr. Gozzi has not received an approval from the North Branford Zoning Board of
Appeals.

4.     Election of officers

Fisher motioned to amend the agenda and hold election of officers, this motion was
seconded by Barry.

IN FAVOR: Fisher, Bartlett, Kingsbury, Guadagno, Dostert, Barry and Havrda
OPPOSED: None

ABSTAINED: None

This motion carried 7-0-0.

The following nominations were made;

Upon a motion by Fisher and seconded by Bartlett it was unanimously voted to elect F.
John Kingsbury as Chairman.

Upon a motion by Kingsbury and seconded by Bartlett it was unanimously voted to elect
David Fisher as Vice Chairman.

Upon a motion by Kingsbury and seconded by Bartlett it was unanimously voted to elect
Robert Guadagno as Secretary.

5.     Walk Committee

Bartlett noted the Walk Committee would walk the Terenzi site Tuesday, April 11, 2000
at 5:30 p.m.
