In January, US Magistrate Judge Barbara Major in San Diego sanctioned Qualcomm Inc for failing to turn over 46,000 documents in a patent infringement trial against rival chip maker Broadcom Corp. According to Major's ruling, the lawyers assisted Qualcomm in committing this incredible discovery violation by intentionally hiding or recklessly ignoring relevant documents. The sanctioned attorneys then used the lack of evidence to repeatedly and forcefully make false statements and arguments to the court and jury. Qualcomm in January 2006 lost a jury trial over claims that Broadcom infringed its patents on compressing digital video. In the late stages of the trial, a senior software engineer at Qualcomm testified that she had e-mails relevant to the case.
