Commissioner, District 5 Your name was given to me by Karen Geller, Esq., as the contact point for the Martin Downs Property
Owner’s Association. I hope you can assist me in finalizing a matter that has been around for some time.
A sewer line that serves the existing Ruby Tuesday’s Restaurant in Palm City was installed at the time the
restaurant was built, and a utility easement for that line was granted to the County, but for whatever reason
DUNCAN BALLANTYNE the easement was never brought before the Board of County Commissioners for acceptance, or placed of
County Administrator
record. I am trying to correct that situation.

A copy of that original easement grant to Martin County from Southern Land Group, Inc. dated June 30, 2003
is enclosed. Since that time a portion of the land underlying the easement area was conveyed to the Martin
Downs Property Owner’s Association, Inc. Because of that sale, the June 30, 2003 easement grant cannot be
recorded. I now need to obtain easements from each of the two owners of their respective parcels. Please see
the enclosed Ownership and Encumbrance Report dated October 4, 2005 that shows the ownership of the two
parcels.
Also to further your understanding of this matter, I’m enclosing printouts from the Martin County Property
Appraiser’s website showing the two parcels.
Also enclosed are two easement documents. The first is a copy of the easement that has already been signed
by Southern Land Group, Inc., per the courtesy of Ms. Geller. Submitted for your review is the second
easement to be signed by the Martin Downs Property Owner’s Association, Inc. The legal descriptions
attached to the easements clearly show the respective locations of the easements.
I respectfully request that you review the enclosed and if the easement is acceptable, have same signed by the
appropriate signatory for the Martin Downs Property Owner’s Association, Inc., and then return same to me.
