This term the US Supreme Court will address the arbitrability of a dispute involving a challenge to the formation of a labor contract. Granite Rock Co v. International Brotherhood of Teamsters (IBT) (No. 08-1214) involves the following issue: "Does a federal court have jurisdiction to determine whether a collective bargaining agreement was formed when it is disputed whether any binding contract exists, but no party makes an independent challenge to the arbitration clause apart from claiming it is inoperative before the contract is established." On July 6, when Granite Rock refused the union's demand to sign a back-to-work agreement, the strike continued. Granite Rock sued Local 287 in federal court for violation of the no-strike clause. Associate Justice Samuel Alito questioned whether the issue of contract ratification in this case is the same as the issue of contract formation.
