EXCLUSIVE PURCHASER REPRESENTATION AGREEMENT (MAINE)

WHEREAS, Purchaser retains Agency on an exclusive basis in consideration of its efforts to locate and/or assist
Purchaser in the acquisition of real property suitable to Purchaser by way of purchase, exchange, option, lease or
NOW THEREFORE, the parties hereto agree to the following terms and conditions:
1. Term of the Agreement
1.1 This Agreement shall be effective for a period of ____________________________ (____________)

2. Agency’s Responsibilities
2.1 Agency shall provide Purchaser with Agency’s professional skills and resources in locating, negotiating
and closing on property determined by Purchaser to be suitable for Purchaser’s needs.
2.2 If requested by Purchaser, Agency shall assist Purchaser is determining current market value.
2.3 Agency shall not reveal any confidential information obtained from Purchaser to other licensees, except to
the designated broker or his designee for purposes of seeking advice and assistance that would benefit
2.4 If requested, Agency shall assist Purchaser in locating property-related professional assistance, including,
but not limited to, survey, tax, legal, and inspection services. Agency shall also assist Purchaser in any
other areas that Purchaser deems crucial to the transaction.
2.5 Agency shall not be responsible for independently investigating or verifying specific information not
related to the property itself.
2.6 Agency shall not be responsible for independently verifying information supplied by other licensees,
outside professionals or governmental agencies, third party advice or data unless otherwise agreed in
writing by the parties.
3. Purchaser’s Responsibilities
3.1 Purchaser shall work exclusively with Agency, and shall refer all properties of interest and conduct all
negotiations through Agency for any property of interest to Purchaser.
3.2 Purchaser shall provide Agency with all personal and financial information required to verify Purchaser’s
ability to purchase property.
3.3 Purchaser shall consult Agency prior to visiting any open houses, contacting any other agency or visiting
any “For Sale by Owner” properties in order to avoid confusion over the agency relationship or
misunderstanding about liability for commission fees.
3.4 Purchaser shall make independent investigations and determinations regarding what type of neighborhood,
amenities and non-property related issues meet Purchaser’s needs.
3.5 If required, Purchaser shall provide Agency with a written request to investigate or verify any specific
issues related to the purchase of a property and shall receive Agency’s written agreement to do so.
3.6 If the property of interest is a new construction, Purchaser shall retain sole and exclusive responsibility for
evaluating the qualifications of the building and determining if the builder will meet Purchaser’s needs.
4.1 Upon the signing of this Agreement, Purchaser shall pay to Agency a retainer fee of
