MOBILE HOME PARK LOT LEASE (SOUTH DAKOTA)

IN CONSIDERATION of Tenant’s payment of rent and agreement to and compliance with the terms and
provisions of this Lease, Landlord hereby leases to Tenant the lot located at [insert lot number]_____
(hereinafter referred to as the “Lot”) in the [insert name of mobile home park] (the “Park”), located in [name
of city or town], South Dakota, for the following home:

2. Term and Termination

The term of this Lease shall be for one (1) year, commencing on __________ [insert date] and ending on
__________ [insert date], subject to earlier termination in accordance with the provisions of this Lease. If
Tenant remains in possession of the Lot with the consent of Landlord after the expiration of the term of
this Lease, a new month-to-month tenancy shall be created between Landlord and Tenant which shall be
subject to all the terms and conditions of this Lease but shall be terminated on thirty (30) days’ written
notice served by either party on the other party.

This Lease shall be a month-to-month lease, commencing on __________ [insert date]. Either party may
terminate the Lease by giving thirty (30) days’ written notice to the other party. Upon termination, Tenant
shall remove the Mobile Home on or before the termination date, after first obtaining any necessary
removal permits as required by law.

All adult occupants dwelling in the Mobile Home must sign this Lease. If any person other than those
listed in this Lease resides in the Mobile Home, Landlord shall have the right to declare Tenant in default
of this Lease or to charge an additional $_________ per month for each additional person. Any new
occupant moving into the Mobile Home must be approved by Landlord and must sign this Lease prior to

4. Lot Rent & Other Charges

Unless other arrangements have been made in advance in writing, all lot rent payments are due
on the first (1st) day of each calendar month and must be paid no later than the fifth (5 th) day of

in the Park Rules and Regulations. Except in emergency situations, Tenant shall be given thirty
(30) days written notice of Landlord’s intent to perform services for which an additional charge
will be levied. Additional charges are due in full no later than thirty (30) days from the Tenant’s
receipt of a written invoice from the Landlord.
(e) Except as otherwise provided by law, the rental amount shall remain in effect for a period of not
less than one (1) year from the effective date of this Lease.
5. Security Deposit
A security deposit of __________________ dollars ($________) shall be paid by Tenant at the
commencement of this Lease. Landlord shall refund the full amount of the security deposit upon
termination of this Lease agreement, and upon surrender of the Lot, provided all terms, conditions,
covenants, and agreements made herein have been performed by Tenant, their successors, and/or
Landlord may retain all or any portion of the security deposit only for the following reasons (which must
be provided to Tenant in written form itemizing any such deductions): (a) non-payment of lot rent; (b)
damage to the Lot, other than as a result of normal wear and tear; (c) non-payment of utility or other
charges which are normally paid to the Landlord; and/or (d) expenses for removal from the Lot of any
property abandoned by Tenant.
6. Dishonored Check Fees
In each instance that Tenant presents a check to Landlord for lot rent or any other amount due hereunder
which is dishonored by Tenant’s bank for insufficient funds, “stop payment” or any other reason, a
service charge of _____________ dollars ($____________) will be assessed.
Tenant shall not assign this Lease Agreement or sublet the mobile home or Lot without the written
consent of Landlord, which consent shall not be unreasonably withheld.
8. Use of Mobile Home
The mobile home shall be primarily used for private residential purposes only. However, the Tenant may
use a minor portion of the mobile home for an occupation which is customary in residential areas, which
use is clearly secondary to the use of the mobile home for living purposes, and which does not change the
character thereof or affect the operation of the Park for health, safety or aesthetic reasons. Such use must
be in compliance with applicable law, including all appropriate ordinances, rules and regulations of any
appropriate governmental authority, and must be approved, in writing, by Landlord.
The mobile home shall be installed (set-up and tied-down) in accordance with any applicable government
statutes, ordinances, rules, or regulations. Such installation shall be Tenant’s responsibility and Landlord
shall in no way be held liable or responsible for any improper installation.
10. Maintenance of Mobile Home and Lot
(a) All mobile homes must be skirted with a skirting material of vinyl, plywood or similar materials
of comparable quality and appearance. The skirting must be kept in good repair and painted as
(b) Landlord’s written approval must be obtained prior to construction, installation, or modification
of any mobile home accessory, equipment, or other structure, including, but not limited to
awnings, screened areas, additional rooms, wooden decks, planters, and/or sheds. (Note:
Building permits may be required for certain accessories or installations).
(c) The Tenant shall keep the premises neat, clean and in good repair, and shall use the premises in
such a manner as not to be detrimental to any other resident of the Park or to the operation of the
Park for health, safety or aesthetic reasons. Tenant shall keep the Lot clean and free of weeds, the
lawns cut and grass trimmed around the mobile home.
(d) Plumbing must be kept in good repair and plumbing leaks must be repaired immediately. All
exposed water lines must be properly insulated and/or have operative heat tapes to prevent
freezing from the ground exit forward.
(e) Except in connection with flowerbeds or vegetable gardens, Tenant shall not dig on the Lot
without the prior written consent of the Landlord or verification by authorities of the location of
underground infrastructure systems (electrical, sewer, water, telephone, cable). Any damage
done to an underground utility by the Tenant shall be repaired at the Tenant’s expense.
The Landlord or its agent shall not discriminate against any tenant or prospective tenant on the basis of
race, gender, sexual orientation, age, marital status, religion, color, national origin, disability, or because
such person intends to occupy the Lot with minor children, or is a recipient of public assistance.
12. Tenant’s Responsibilities
(a) The Tenant shall keep the Lot clean, sanitary, free from rats and reasonably free from insects,
vermin and other pests to the extent that failure to maintain the Lot in such condition may affect
the fitness for human habitation of any lot or mobile home.
(b) Household waste and garbage that is placed outside the mobile home shall be stored in
watertight receptacles of metal, rubber or other durable materials with tight fitting covers.
(c) The Tenant shall be responsible for the expense of maintaining the plumbing, electrical and other
utility services to the mobile home, and from the point at which the service surfaces under the
mobile home or connects to the mobile home from a service point.
(d) The Tenant shall not use or occupy, or allow others to use or occupy the mobile home in such a
way as to cause the Lot or any other lot to fail to comply with the terms of this Lease or any State
or local laws or ordinances. The Tenant, members of Tenant’s household, guests and invitees
shall not deliberately or negligently destroy, deface, damage, alter or remove any fixture,
mechanical or utility system, or any other appurtenance on the Lot, on any other lot or in the
common areas of the Park. Tenant shall be responsible to pay for any repairs for damage caused
by Tenant, a member of Tenant’s household, or any guest or invitee of Tenant.
(e) The Tenant shall, and shall ensure that Tenant’s family, guests and invitees, respect the privacy
and lot lines of other tenants’ lots. Tenant, Tenant’s family, guests and invitees shall conduct
themselves in a manner that does not unreasonably disturb other tenants, and shall refrain from
illegal activities anywhere within the Park. Tenant shall be responsible for the actions and
behavior of persons residing with Tenant, and those of Tenant’s guests and invitees.
(f) Tenant is responsible for the maintenance of the Lot, including but not limited to maintenance of
the lawn, driveway and parking area, including snow removal from such areas.
(g) Tenant is responsible for any damage caused by failing to control water leaks within the mobile
home or disposal of items that are not soluble into the sewage system which may cause
blockages, surfacing or sewer back-up.
(h) Tenant shall not block or obstruct any common areas and/or roadways in the Park.
(i) Upon termination of this Lease, Tenant will leave the premises in as good a state of condition as
they were in at the commencement of this Lease, reasonable use, wear and tear, and damage by
the elements excepted.
13. Landlord’s Responsibilities
(a) Landlord will provide the Lot with adequate and safe electrical service. Landlord is responsible
for maintenance of the electrical service to the point at which it surfaces under the mobile home.
(b) Landlord will provide the Lot with potable water at an adequate pressure to meet Tenant’s
standard everyday needs and to prevent a health hazard from back siphonage. Landlord is
