FARM LEASE - CASH OR CROP SHARES
THIS AGREEMENT made effective as of the _____ day of ______________, _______.

1. Description of Premises:
Landlord shall rent to Tenant the Farm described as:

2. Term of Lease:
This lease shall commence on _________________[commencement date] for a term of ______ year(s), and
shall expire on ________________ [expiry date]. This lease shall automatically renew upon expiration
from year to year, upon the same terms and conditions as expressed herein, unless either party gives due
and timely written notice to the other of an election not to renew the lease.

Tenant shall pay to Landlord rent in the amount of $[rental amount] per year. The rent shall be paid [in

calculated based on a rental cost per acre, as set out below:

(a) Landlord and Tenant agree to share in the crop yields in the following proportions:

(b) Records of all expenses and yields will be kept by Tenant and shall be available for inspection by
Landlord, upon request.
(c) Landlord shall determine whether to participate in any program offered through the United
States Department of Agriculture for crop production control or soil conservation. In the event
Landlord elects to participate in such programs, payments from such participation shall be
distributed ______% to Landlord and _____% to Tenant.
4. Use of Premises:
(a) Tenant shall use the Farm for farming or agricultural purposes only. Tenant shall prepare and
plant any crops in a timely fashion.
(b) Tenant shall only be entitled to pasture or plow those portions of the Farm as designated by
(c) Tenant agrees to farm the land in a good and husbandman-like manner, and to seek to obtain the
best crop production that the soil and crop season will allow.
(d) Harvest of any crops planted on the Farm shall be done in a timely fashion. If Tenant fails to do
so, Landlord reserves the right, by himself or designated agents, to enter upon the Farm and
properly care for and harvest all growing crops, charging the cost of care and harvest to Tenant,
as part of the rent.
(a) Tenant shall care for and maintain the Farm including controlling soil erosion through the
maintenance of existing water courses, waterways, ditches, drainage areas, terraces and tile
drains, and Tenant shall abstain from any practice which will cause damage to the Farm.
(b) Tenant shall not remove from the Farm, nor burn, any straw, stalks, stubble, or other similar
plant materials, all of which are recognized as property of Landlord. Tenant, however, may use
such materials upon the Farm for the farming operations.

6. Termination of Lease:
All notices of termination of this lease shall be as provided by State law. Upon proper notification of
termination of this lease, Tenant shall relinquish possession of the Farm to Landlord. In the event that
Tenant fails to do so, Tenant shall pay to Landlord $______ [insert a per diem rate] per day as liquidated
damages until possession is delivered to Landlord. At the time of termination of this lease, Tenant shall
deliver the Farm to Landlord in good order and condition and in substantially the same condition as it
was received by Tenant at the commencement of this lease, except for excusable or insurable loss by fire,
unavoidable accidents, and ordinary wear and tear.
7. Labor and Materials:
Landlord and Tenant agree that each of them shall supply labor and materials to the Farm for purposes of
the farming or agricultural operations in the proportions shown below:
