Work Subject to Control of Engineer
The work performed shall in every respect be under and subject to the control and supervision of the
Engineer, and all orders, directions or instructions given by the Engineer to the Contractor with respect to
any aspect of the work performed shall be promptly and efficiently be performed and complied with, to
the Engineer’s specifications.
A competent foreman shall be employed by the Contractor and present at the Site during all working
hours, and shall take orders, directions and instructions from the Engineer. Such foreman shall be
considered the lawful representative of the Contractor, and shall have full power to carry out all orders,
directions and instructions of the Engineer, but this clause shall not relieve the Contractor from its duties
The Contractor is to employ at all times outside of regular working hours a security guard to oversee the
worksite until the Project is completed.
Conduct of Employees
If any person employed on the Project shall be, in the opinion of the Engineer intemperate, disorderly
incompetent, wilfully negligent or dishonest in the performance of his duties, he shall at the discretion
and on the order of the Engineer be forthwith discharged.
Loss or Damage to Work in Progress
The Contractor shall bear the costs of all loss or damage which may occur to the Project or any part
thereof, until the Project shall be accepted as completed by the Engineer, and if any such loss or damage
occurs before such final acceptance, the Contractor shall immediately at its own expense repair and
restore the loss or damage, so that the whole Project shall be completed within the time limited for
completion thereof, and any delay occasioned by the Contractor to any other contractors on the Project or
any interference by the Contractor with the operations of such other contractors which may cause
damage or delay in work on the Project shall be rectified at the cost of the Contractor, and the claim for
damage or delay (if any) shall be charged to the Contractor.
The Contractor shall protect. and shall not remove, alter or destroy, or permit to be removed, altered or
destroyed, any stakes, pins or other markers placed on or about the worksite by the Engineer, and
