     Now comes the Defendant,                              Inc. and respectfully requests this Honorable Court to
preclude any reference by the Plaintiffs to any alleged spoliation of the theater seat in question at this trial. As
grounds herefor, the Defendant states as follows:
1. It is anticipated that the Plaintiffs will attempt to argue, as they did during the District Court trial of this
matter, that the Defendant’s spoliated evidence; to wit, had necessary repairs performed to the seat in question.1
