Also in the United States District Court for the District of New Jersey, Rex helped design and implement a
global mediation program involving a fifth ephedra manufacturer (Cytodyne Technolgies/Nutaquest) named as a
defendant in more than 100 personal injury and wrongful death actions. This mediation program involved (1)
separate mediation presentations and negotiations establishing a conditional valuation of each case and (2) the
coordination of negotiations among named and unnamed defendants for the payment of the sum total of the
negotiated conditional valuation amounts.

Other Litigation / Proceedings

In addition to the global mediations described above, Rex personally has participated in dozens of mediations
involving the settlement of individual cases involving personal injury claims, creditor claims, and employment
claims.

As either lead litigator or litigation manager, Rex has managed cases to verdict or settlement in state, federal,
administrative, and alternative dispute resolution forums.

As a registered lobbyist, Rex has coordinated negotiations among multiple parties to create, draft, and guide to
passage by the Ohio General Assembly several complex pieces of legislation.


PROFESSIONAL LEGAL EXPERIENCE

May 2000 to Present
Ulmer & Berne LLP
Resident Partner, Columbus, Ohio office, in the Product Liability, Business Litigation and Employment and
Labor Law Groups of a law firm of over 100 attorneys. Practice includes general commercial litigation with an
emphasis in product liability, manufactured housing, employment and zoning issues. He also offers his services
as a mediator in cases involving both simple and complex legal matters.

August 1994 to Present
Outside General Counsel - Ohio Manufactured Homes Association
Outside general counsel to the Ohio Manufactured Homes Association (“OMHA”), a trade association for the
manufactured housing industry in Ohio. Involved in frequent discussions with local officials regarding
manufactured housing issues and disputes involving OMHA members. As a registered Legislative Agent and
Executive Agent for OMHA, the principal industry negotiator and author of recent legislative overhaul of Ohio’s
laws regarding the taxing and zoning of manufactured housing. Conducted extensive negotiations with state
agencies, state and local officials and other interested parties regarding such legislation. Frequent industry
proponent in testimony before the Ohio General Assembly. Involved in frequent contact with state and local
officials regarding manufactured housing issues.

Resident Unit Partner, Columbus, Ohio office, in the litigation department of a law firm of over 160 attorneys.
Started as a resident associate attorney in the Columbus, Ohio office in 1989 and elected a unit partner of the
firm in 1998. Practice included general commercial litigation with an emphasis in product liability, employment
and zoning issues.

SPEAKING ENGAGEMENTS

Frequent speaker to government and trade groups regarding manufactured housing issues. Speaking
engagements include presentations to the Ohio Manufactured Homes Association and local chapters thereof,
the Manufactured Housing Institute (Arlington, VA), the County Auditors Association of Ohio, the County
Commissioners Association of Ohio, the County Treasurers Association of Ohio, the Ohio Clerk of Courts
Association, the Ohio Environmental Health Association, the Mid-Ohio Regional Planning Commission, the
2000 Midwest American Planners Association Conference and the City of Columbus Land Reutilization
Program Seminar.

Since May 2000, frequent speaker at seminars conducted by the Council on Education in Management. Past
speaking topics included legal issues arising from the Americans with Disabilities Act, the Family Medical Leave
Act, the Pregnancy Discrimination Act, Title VII and Ohio’s Workers’ Compensation Act.
