TENANCY DEPOSIT PROTECTION LEGISLATION



In another instance of this Government hurriedly introducing legislation then pulling back, the
introduction of the new Tenancy Deposit Protection legislation, has been delayed from October
this year until April 2007.This was welcomed by Romy Adlington, of the Lettings Department at
Bays Curry McCowen (BCM).



Romy said, "The new launch date will enable the Government to deal with concerns raised by
landlords and letting agents over the release of deposits, where there are rent arrears and
abandonment of tenancies."



The delay will also give more time to inform landlords and tenants about the tenancy deposit
protection.



The purpose of this legislation is to ensure that deposits are not withheld unfairly from tenants
at the termination of an assured shorthold tenancy. The reality is that this does not in fact do
much to improve the present situation and, as usual, the government were trying to introduce it
without sufficient prior planning on the way it will be managed at the point of use.

Another unnecessary and unwelcome outcome will be the likelihood of more legal actions, with
resultant costs for all involved - another bonanza for the lawyers with little improvement in
benefits for either landlord or tenant.
