For good consideration given and tendered, in the form of allowing the undersigned the privilege of attending and/or competing in, traveling to and from the above-noted competition, undersigned individual, for himself or herself, his/her personal representatives, heirs, next of kin, assigns and/or other legal representatives in any capacity, acknowledges, agrees and represents that he/she hereby: 1. WAIVES, RELEASES, DISCHARGES AND COVENANTS NOT TO SUE the ___________________________or its successors or assigns; or the promoters of the event, and each of them, and the participants, operators, officials, persons present as invitees, including customers, sponsors, advisors, owners and leasees of the premises and/or any other persons involved in conducting the event, and each of them, their officers and employees, (hereinafter referred to as releasees), from all liability to the undersigned, his personal representatives, assigns, heirs and next of kin and/or legal representatives of any kind, for any and all damage, claim or demands therefore, on account of injury to the person or property, or resulting in death
of the undersigned, whether or not caused by the negligence of releasees, while the undersigned is in or upon any area used for the event, or competing in, officiating, observing, working for, traveling to or from the event. 2. HERBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS, the releasees and each of them from any loss, liability, damage, or cost they may incur due to the presence of the undersigned in or upon the event area or in any way competing, officiating, observing, or working for, or, for any purpose, observing and/or participating in the event, whether or not caused by the negligence of the releasees or otherwise. 3. HEREBY ASSUMES FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to the negligence of releases or otherwise, while in or upon the event area and/or while competing, officiating, observing, or working for or any purpose or manner of participating in the event. 4. EACH OF THE UNDERSIGNED expressly acknowledges and agrees that the activities at the event and attendance at the event or within, around or near the event areas are dangerous and involve risk of serious injury and/or death and/ or property damage. 5. EACH OF THE UNDERSIGNED FURTHER EXPRESSLY AGREES that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the Commonwealth of Pennsylvania, and that if any portion thereof is held invalid, it is agreed that the balance of the agreement shall, notwithstanding, continue in full legal force and effect. Should any provision of this contract be held unenforceable, said provision is severable and said unenforceability shall not affect the applicability and enforceability of the remainder of this contract.
6. THE UNDERSIGNED EXPRESSLY WARRANTS THAT HE/SHE ASSUMES THE RISK OF: travel, lodging, meals, entertainment and/or any other provision of goods, services or materials or equipment; provided, used, employed, ingested or received, enjoyed, observed etc. to from, within, during or after said event and/or shall hold the above-noted releasees, parties, etc. harmless concerning same. 7. THE UNDERSIGNED AGREES TO HOLD HARMLESS the above-noted releasees for any expense incurred by the undersigned, or contracted for by the undersigned, for any transportation, meals, lodging or any other provision used, enjoy, observed, consumed, employed, contracted for etc.; to, from, within, during or after said event.
8. These covenants are governed by the laws of the Commonwealth of Pennsylvania. 9. By signing this agreement, the parties agree that the forum for any lawsuit stemming from, or over, the contents, interpretation, etc. of this contract is the 19th Judicial District of Pennsylvania, the designated US Corporate home for the York Shotokan Karate Club, the International Martial Arts Club and the International Martial Arts College. 10. The undersigned has read and voluntarily signed the release and waiver of liability and indemnity agreement and further agrees that no oral or written representation, statements or inducement apart from that contained in this document have been made to the undersigned and that no parole evidence may be considered relative to any aspect of this agreement. 11. It is further agreed that the undersigned suffers from no incapacity which would render the signatory incapable of understanding the legal effect of this document. Neither has the signatory been threatened or coerced to sign this contract.
