							                          TORT CLAIM FILING GUIDELINES


To insure proper filing of tort claim forms, please note the following guidelines:


1.      Give the exact street location of the incident, time, a detailed description of what
        occurred along with photographs, if any taken and include a hand drawing diagram of the
        exact location of the incident. If you do not list a specific street address and a diagram of
        where the incident occurred, your claim will be returned. Also, the name or names of any
        person employed by the City that you spoke with at the time of the incident. If a police
        report was filed, a copy should be included along with the claim form. Incomplete or
        unspecific information may delay the review and processing of your claim.

2.      In case of personal injury, your claim will be forwarded to the Insurance Reserve Fund in
        Columbia, South Carolina. They will contact you directly. Submittal of medical bill(s)
        are required. Please submit the original of all estimates and medical bill(s) only.

3.      In cases where a vehicle used as the primary source of transportation is damaged, the
        Legal Department requires the submittal of three (3) estimates of damages and that the
        damages incurred be repaired at the lowest estimate and the original bill be submitted
        with the claim form. Please note that submittal of the bill for damages does not constitute
        an admission of legal liability on the part of the City or any of its departments.

4.      In golf ball damage cases, please submit a summary cover page of your insurance policy,
        evidencing that the damage is not covered under the insurance policy or that the
        deductible on the insurance policy is higher than the claim.

5.      Have the claim form notarized. If you unable to find a notary, you may bring the claim
        form to the Clerk of Council’s Office where it will be notarized free of charge. YOUR
        CLAIM FORM WILL NOT BE PROCESSED IF IT IS NOT PROPERLY
        NOTARIZED.

6.      Return the original claim to form to:             CLERK OF COUNCIL
