Notice is hereby given to all interested persons or firms that sealed bids will be accepted
at the Calhoun County Clerk of Court Office located at the Calhoun County Courthouse,
20859 Central Avenue East, Room 130, Blountstown, Florida 32424 NO LATER
THAN 12:00 P.M. (CT) on Tuesday, April 7, 2009 for the following project:

BID NAME: Request for Bid for the annual supply of Greases & Oils

DESCRIPTION: The Calhoun County Board of Commissioners is seeking qualified
vendors to respond to this Request for Bid for the annual supply of various types of
lubricants.

BID OPENING:

Bids will be opened and recorded by the Calhoun County Board of County
Commissioners on Tuesday, April 7, 2009 at 2:00 P.M. (CT).

Specifications and General Conditions may be obtained from the Emergency
Management Office between the hours of 7:00 A.M. (CT) and 4:00 P.M. Monday
through Friday or online at www.calhounflorida.org. Information or inquiries may be

GENERAL

A.     These documents constitute the complete set of specification requirements and bid
       forms. The bid Proposal including all bid sheets and attachments must be filled in,
       executed and submitted in a sealed envelope bearing the bid name on the outside
       and mailed or presented to the Calhoun County Clerk of Court Office on or before
       the specified time and date. The face envelope shall contain the return address, the
       date and time of bid opening, the bid name and title.

B.     It is the sole responsibility of the bidder to ensure that the bid packet reaches the
       Clerk of Court Office on or before the closing date and time. The County of
       Calhoun shall in no way be responsible for delays, caused by any other
       occurrence. Offers by telephone, telegram or facsimile shall not be accepted
       unless otherwise specified.

C.     All bids must be typewritten or written in ink, and must be signed in ink by an
       officer or employee having authority to bind the company or firm.

D.     Provide two original copies.

E.     Bidders shall not be allowed to modify their bids after the opening time and date.
       Bid files may be examined during normal working hours, after bid opening

F.     The bids will be publicly opened at a regular scheduled meeting of the Calhoun
       County Board of County Commissioners at the Agricultural Extension Office at
       20816 Central Avenue East, Blountstown, Florida 32424.

LEGAL REQUIREMENTS

Bidders are required to comply with all provisions of Federal, State and County laws and
Ordinances, rules and regulations, which are applicable to the items being bid. Lack of
knowledge by the bidder shall in no way be a cause for relief from responsibility, or
constitute a cognizable defense against the legal effect thereof.

Bidder shall also hold a current license to conduct work in the State of Florida. They shall
also maintain “In Effect”, any and all licenses required to successfully accomplish the
task required in the Request for Bid. It is the vendor’s responsibility to ascertain what
licenses are required, and to insure that they in fact currently have or obtain, before start
of work, the proper licensure for the job.

The contractor/vendor shall adhere to all applicable health and safety laws regulations
including, but not limited to, those promulgated by the state and federal government.

PUBLIC ENTITY CRIMES

Any person submitting a bid or proposal in response to this invitation must execute the
enclosed SWORN STATEMENT UNDER SECTION 287.133 (A), FLORIDA
STATUTES, ON PUBLIC ENTITY CRIMES, including proper check(s) in the spaces(s)
provided, and enclose it with the bid/proposal. No award will be executed with any
person affiliate identified on the Department of General Services “Convicted Vendor”
list. This list is defined as consisting of persons and affiliates who are disqualified from
public contracting and purchasing process because they have been found guilty of a
public entity crime. No public entity shall award any contract to, or transact any business
in excess of the threshold amount provided in Section 287.017, Florida Statutes for
Category Two (2) (currently $10,000.00) with any person or affiliate on the “Convicted
Vendor” list for a period of thirty-six (36) months from the date that person or affiliate
was placed on the “Convicted Vendor” list unless that person or affiliate has been
removed from the list pursuant to Section 287.133 (3Xf) Florida Statutes.

PROCUREMENT REGULATIONS

This bid is governed by the Calhoun County procurement Regulations. A copy of the
Procurement Regulations is available for your review at the Clerk of Court Office.

PROTESTS OR DISPUTES: Any protests or disputes pursuant to this bid and/or
contract award shall be governed by the procedures noted in the Procurement
Regulations.
FEDERAL AND STATE TAXES

The County of Calhoun is exempt from Federal and State Taxes for tangible personal
property. Clerk of Court Office will supply the successful bidder with an exemption
certificate if required. Vendors or contractors doing business with Calhoun County shall
not be exempted from paying sales tax to their suppliers for materials to fulfill contractual
obligations with the County, nor shall any Vendor/Contractor be authorized to use the
County Tax Exemption Number in securing such materials.

ACCEPTANCE/REJECTION

The County of Calhoun reserves the right to accept or reject any or all bids and make the
award to that bidder, who in the opinion of the County will be in the best interest of
and/or the most advantageous to the County. The County also reserves the right to reject
the bid of any vendor who has previously failed in the proper performance of an award or
to deliver on time contracts of a similar nature or who is not in a position to perform
properly under this award. The County reserves the right to inspect all facilities of
bidders in order to make a determination as to the forgoing. Calhoun County reserves the
right to waive any irregularities and technicalities and may, at its discretion, request a re-
bid.

ALTERNATIVES/APPROVED EQUAL DEVIATIONS

Unless otherwise specified, the mention of the particular manufacture’s brand name or
number in the specifications does not imply that this particular product is the only one
that will be considered for purchase. This reference is intended solely to designate the
type or quality of merchandise that will be acceptable. Alternate offers will be considered
and must include descriptive literature and/or specifications. Failure to provide
descriptive literature and/or specifications with alternate offers may be cause for
disqualification of the bid. The determination as to whether any alternate product or
service is or is not equal shall be made by Calhoun County and such determination shall
be final and binding upon all bidders.

Although Calhoun County provides for the consideration of alternate bids, it reserves the
right to make an award in the best interest of Calhoun County. Such award may not
necessarily be given to the lowest bid offered.

The bidder shall be responsible for reading very carefully, and understanding completely,
the requirements and the specifications of the items bid upon. Any deviation from
specifications listed herein must be clearly indicated, otherwise it will be considered that
items offered are in strict compliance with these specifications, and the successful bidder
will be held responsible therefore; deviations must be explained in detail on an attached
sheet(s) and itemized by number. Any item or items that do not meet County
specifications upon delivery will not be accepted and if the item cannot be brought up to
specifications in a reasonable time, the bidder will be required to compensate the County
for difference in price entailed in going to the next low bidder.
Where more than one item is listed, any items not bid upon shall be indicated by a written
“NO BID” beside the item.

NON-COLLUSION

Bidder certifies that this bid is made without prior understanding, agreement, or
connection with any corporation, firm or person submitting a bid for the same materials,
services, supplies, or equipment and is in all respects fair and without collusion or fraud.

No premiums, rebates or gratuities permitted, with, prior to or after any delivery of
material or provision of service. Any such violation may result in contract cancellation,
return of materials or discontinuation of services and possible removal from the vendor
list(s).

CONFLICT OF INTEREST: The award is subject to provisions of State Statutes and
County Ordinances if any. All bidders must disclose with their bid the name of any
office, director, or agent who is an employee of Calhoun County. Further, all bidders
must disclose the name of any County employee who own, directly or indirectly, an
interest of ten percent (10%) or more in the bidders firm or any of its branches.

UNIFORM COMMERCIAL CODE: The Uniform Commercial Code (Florida
Statutes, Chapter 672) shall prevail as the basis for contractual obligations between the
awarded contractor/vendor and the County for any terms and conditions not specifically
stated in the Invitation to Bid.

MISTAKES: In the event of extension error(s), the unit price will prevail and the
bidder’s total offer will be corrected accordingly. In the event of addition errors, the
extended totals will prevail and the bidder’s total will be corrected accordingly. Bidders
must check their bid proposal where applicable. Failure to do so will be at the bidders
risk. Bids having erasures or corrections must be initialed in blue ink by the bidder.

AVAILABILITY OF FUNDS

 The obligations of Calhoun County under this award are subject to the availability of
funds lawfully appropriated for its purpose by the State of Florida and Calhoun County.

SUBCONTRACTING: If a vendor subcontracts any portion of a contract for any
reason, he must submit the name and address of the subcontractor and the name of the
person to be contracted. Calhoun County reserves the right to accept or reject any or all
bids wherein a subcontractor is named and to make the award to the bidder, who, in the
opinion of the County, will be in the best interest of and/or most advantageous to the
County. Calhoun County also reserves the right to reject a bid of any bidder if the bid
names a subcontractor who has previously failed in the proper performance of an award
or failed to deliver on time contracts of similar nature, or who is not in a position to
perform properly under this award. Calhoun County reserves the right to make the
determination as to the foregoing.

LOCAL BIDDER PREFERENCE: The basis of an award of a bid contract for goods
or services, if let, will be to the best bidder, as determined by the Board of County
Commissioners, and subject to the provisions County Purchasing Policy. In keeping with
the County’s policy of considering all appropriate contributing factors, including, but not
limited to, prior history of supplying of goods and services to the County, residence and
place of business of the contractor, subcontractor, and suppliers, the County reserves the
right to award any bid to other than the lowest bidder at the County’s discretion on those
items and services (other than road construction and other items and services which are
required by law to be awarded to the County staff, as follows. As to bids awarded or to be
awarded under County Ordinance by the Board itself, the bid of a resident of Calhoun
County, Florida MAY (in the sole discretion of the Board) be granted a give percent (5%)
preference over bids submitted by any nonresident. However, such preference shall
automatically be afforded on items and services of $1,000.00 or more as to which bids
are not awarded by the Board itself, but are awarded or contracted for by county staff. A
resident shall mean an individual or corporation whose primary residence or place of
business is within Calhoun County, Florida, a partnership whose principals are all
residents of Calhoun County, Florida, or another business entity whose principal place of
business is within Calhoun County, Florida, or which maintains a full time business
office open to the public (and having at least one full-time employee) within Calhoun
County, Florida.

QUALIFICATIONS OF BIDDERS: Bids will be considered only from firms engaged
in providing/performing services specified herein. Bidder must have adequate
organization, facilities, equipment and personnel to ensure prompt and efficient service,
or they must be able to show that they have the ways and means to fulfill the obligations
of service or other services related to the product/service. The Board will determine
whether the evidence of ability to perform is satisfactory and reserves the right to reject
bids where evidence submitted, or investigated and evaluation indicated inability of the
bidder to perform.
AWARD OF BID: The Board reserves the right to award any and all bids to the
“Lowest Responsible and Responsive Bidder”. The term Lowest Responsible and
Responsive bidder is defined below. The Board also reserves the right to award the
contract to more than one bidder, as determined to be in the best interest of the County.

       RESPONSIBLE BIDDER: The word “responsible” generally includes attributes
                           of trustworthiness; fitness and capacity of low bidder
                           to satisfactory perform the proposed work, or supply
                           the required materials.

       RESPONSIVE BIDDER: The word “responsive” is generally interpreted to
                          mean the bidder has met the minimum requirements
                          and specifications of the bid solicitation.

destination defined in the Request for Bid packet.

BID NAME: ANNUAL BID FOR GREASES AND OILS


Procedures for having questions answered:

All questions will be directed to the Purchasing Agent unless otherwise indicated.


                SPECIFIC LUBRICANTS RELATED CONDITIONS

This invitation to bid contemplates the furnishing of lubricants on an “AS NEEDED”
basis to Calhoun County to begin upon Board approval and ending one year from original
date of approval. Calhoun County does not guarantee quantities to be purchases during
the period listed herein. The County may, at its sole option, purchase more or less than
the estimates annual consumption from this contract depending upon its needs.

The successful bidder shall deliver the requested lubricants within twenty-four (24) hours
after request. Delivery shall be made to the Calhoun County Road Department Shop at
16203 SE Charlie Wood Road, Blountstown, between the hours of 7:00 A.M. (CT) and
2:30 P.M. (CT), Monday through Friday. No deliveries on Holidays.

All lubricants must meet or exceed the Chevron Specifications included in this bid. Any
product bid other than the specified Chevron product will include a product data sheet
from the manufacturer.

Successful bidder agrees to deliver products, upon ordering within 24 hours.

Successful bidder agrees to furnish three (3) bulk oil tanks with a capacity of at least 275
gallons and manually operated pumps for each tank. Tanks will be properly labeled as to
the product contained. Vendor will maintain a spare pump for use in the event any of the
other pumps fail to operate.

Calhoun County may at any time have any type of oil analyzed. The sample will be
analyzed by an independent testing agency of the County’s choice. In the event the oil
does not meet specifications, all costs associated with the removal of the lesser quality oil
and the replacement of oil that meets specifications will be paid by the vendor. In the
event of an error resulting in oil being pumped into the incorrect tank, it will be the
responsibility of the vendor to drain the affected tank and replace all oil with the correct
product.
The vendor must immediately report to Calhoun County service personnel all oil spills
that occur during or as a result of vendor’s delivery. Vendors shall be responsible for all
costs associated with an oil spill, including but not limited to site clean up, lab tests,
waste disposal, fines and penalties, and monitoring.

Product drums shall remain the property of the vendor. The vendor may request a deposit
fee for drums, not to exceed twenty (20) dollars per drum. All drum deposits shall be
refundable in full upon return of drums in satisfactory condition.

Materials Safety Data Sheets for all products delivered by the Vendor, shall be provided
by the vendor.

The Calhoun County Board of County Commissioners may, in their sole discretion, make
an equitable adjustment in the contract terms and or pricing if pricing or availability of
supply is affected by extreme and unforeseen volatility in the marketplace, that is, by
circumstances that satisfy all the following criteria: (1) the volatility is due to causes
wholly beyond the successful bidder’s control, (2) the volatility affects the marketplace
or industry, not just the successful bidder’s source of supply, (3) the effect on pricing of
availability of supply is substantial, and (4) the volatility so affects the successful bidder
that continued performance of the contract would result in a substantial loss. Any
adjustment would require irrefutable evidence and approval by the Calhoun County
Board of County Commissioners.

CHEVRON DELO 400 MULTIGRADE
SAE 15W-40

APPLICATIONS:

Chevron Delo 400 Multigrade SAE 15W-40 is a mixed fleet motor oil recommended for
all naturally aspirated and turbocharged four-stroke diesel engines and four-stroke
gasoline engines in which the API CI-4 PLUS grade and SAE 15W-40 viscosity grade
are recommended. It is formulated for engines operating under severe service and a wide
range of climatic conditions.

Delo 400 Multigrade SAE 15W-40 is excellent for use in engines equipped with features
like four-valve heads, supercharging, turbo charging, direct injection, shorter piston
crowns, higher power density, intercooling, full electronic management of fuel and
emissions systems, exhaust gas recirculation, and exhaust particulate traps.

It is formulated for superior performance with Ultra Low Sulfur Diesel but also both

Chevron Hydraulic Oils AW are versatile lubricants available in ISO viscosity grades
from 10 to 68.

ISO 32, 46, and 68 are most commonly used for hydraulics with vane-, piston-, or gear-

lubricate lightly loaded reciprocating compressors and as general-purpose shop lubricants

Chevron Automatic Transmission Fluid DEXRON-VI is designed specifically for use
in all General Motors HydraMatic transmissions produced for Model Year 2006 and
beyond. It is the latest generation technology approved for use by General Motors in
automatic transmissions and automatic transaxles where a DEXRON-VI fluid is
specified. It is also back serviceable in transmissions calling for DEXRON-III or
DEXRON-II fluids.1

Chevron Automatic Transmission Fluid DEXRON-VI is not recommended for use in

Chevron Automatic Transmission Fluid MD-3 is designed for use in most pre-2006
automatic transmissions built by General Motors, Ford Motor Company and other makes
requiring a high performance, multi-purpose, power transmission fluid. It is

MERCON2, and Allison C-4 fluids.

Chevron Automatic Transmission Fluid MD-3 is also used as a light oil in compressors,

APPLICATIONS

Chevron Supreme Motor Oils are recommended for all four-stroke gasoline engines used
in passenger cars, light trucks, powerboats, motorcycles, and other mobile and stationary
equipment. They are excellent for high-revving engines in small cars and light trucks. All
grades are specially formulated for use in turbocharged engines.

SAE 5W-20 provides optimum fuel economy and durability performance. It is
recommended for Ford and Honda vehicles specified for this viscosity grade.

SAE 5W-30 is recommended by the majority of auto manufacturers for most of their late
model North American vehicles, under all weather conditions. It also is recommended for
use at very low temperatures involving cold starting, and for high fuel economy.

SAE 10W-30 is recommended for many older vehicles and a few late model cars and
trucks, often those with larger 6-cylinder and V-8 and/or high performance engines. SAE
10W-30 provides improved fuel economy relative to heavier viscosity grades.

SAE 10W-40 is still a very popular viscosity grade in warmer climate, though it is not
recommended by most auto manufacturers for their late model North American vehicles.
It is often recommended for older model cars that see regular high temperature operation.

SAE 20W-50 is recommended primarily for older engines for use in high temperature
and heavy duty operations such as towing heavy trailers at highway speeds or up inclines
for long periods of time. It is also recommended for some high performance engines used
in racing and rallying.

Chevron Supreme Motor Oils SAE 30 and SAE 40 can be used in any engine application
where an SAE 30 or SAE 40 passenger car motor oil of API SM or any previous “S”
category is recommended. They perform exceptionally well in small four-stroke engines
found in lawn mowers, garden tractors, and snow blowers, and in refrigeration or air-
conditioning engines on trucks and buses.

These lubricants are excellent for all types of automotive and industrial bearings and
gears, particularly those operating under severe temperature and load conditions. They
provide excellent wear control even in the presence of small amounts of water. Their
exceptional thermal and oxidation stability, and antiwear performance permit longer gear
life and extended drain intervals.

Chevron Delo Gear Lubricant ESI SAE 80W-90 was field tested in more than 100 on-
highway, Class 8 trucks with drain intervals of 500,000 to 750,000 miles. The product

Chevron Delo Greases EP are designed for extreme duty in a wide variety of on- and off-
highway vehicle and equipment applications.

On-highway heavy-duty trucks – These lubricants are perfect for a wide variety of
Class 8 trucks in all chassis and wheel bearing applications ranging from automatic
centralized greasing systems to wheel bearings operating near the high temperatures of
disc brakes. This product is for all applications, from owner/operators to fleets (especially
those considering extended service intervals).

Off-highway vehicles – Whether the application is in construction, logging, mining,
agriculture or utilities, these greases will perform. Use them in haul trucks, loaders,

APPLICATIONS

Chevron Ultra-Duty Greases EP are recommended for use in automotive and industrial
equipment operating under severe service except where very high operating temperatures
are encountered. Typical applications are: mining equipment, construction equipment,
material handling equipment, marine deck equipment, marine deck cranes, oil field
equipment, offshore marine deck cranes, oil field equipment, offshore drilling equipment,
paper machines, dredging equipment, logging equipment, rock quarry equipment, etc.,
operating in water, mud, or dusty conditions.

Chevron Ultra-Duty Greases EP will provide the needed shock load and rust protection
and, best of all; they stay put which means less frequent regreasing. They are not primary
recommendation for high temperature wheel bearings. Chevron Delo Greases EP,
Chevron RPM Automotive LC Greases EP, or Chevron Black Pearl Greases EP are
preferred for wheel bearing applications.

In industrial service, Chevron Ultra-Duty Greases EP are recommended for use in all
types of plain and antifriction bearings from 1-1/2 inch OD to over 16 inch OD, operating
at speeds from 50 to 3000 rpm, as well as slides, gears, ways, etc.
