“There is no fundamental change in the terms of the contract from the successful 1998 version
of the contract”, said Mr Wilhelm Harnisch, Chief Executive Officer, Master Builders Australia.
“The 2005 version contains streamlined drafting and up-to-date GST provisions.
“In this form of project delivery, the Principal takes an active role in the project with a team
“The CM2 2005 pro forma contract should be entered into as early as possible after design
drawings have been commissioned by the principal or even at the stage of completion of draft
design drawings. This is so the Construction Manager can assess the “buildability” of the
project. Construction Managers will prove their worth by helping to create the most cost
effective design that will benefit the Principal, designers and trades consultants.
“CM2 emphasises the team based approach to building the project. This approach generally
ensures that the principal’s higher risk from this form of contract, when compared with
traditional methods of delivery, will be offset by increased productivity from co-operative effort.
“The CM2 model is based upon the Construction Manager acting as the agent of the Principal
and essentially being concerned with monitoring and controlling progress through appropriate
construction programs and budgeted cost plans”.
