Procedure of Complaint & Settlement of Trademark Infringement in the Fair
Complaint
Complaint should comply with stipulated conditions
Conditions for Complaint
A. The Appellant:1.Trademark registered owner, his authorized agent; 2. Foreigner who tends to complain about trademark infringement should demonstrate his valid ID and certificates indicating the ownership relations, and entrust recognized agents to carry out the process. 3. All participants of the Fair with valid certificates. B. Documents to be submitted: 1. Registered trade mark certificate; 2. Business license or ID of the registered person (copy true to the origin); 3. Agent who deals with the issues shall be required to provide business license and stamp to proof it is a true copy.
Verification
To examine the validity of submitted documents.
Acceptance
Submission of A Letter of Complaint by the appellant and the C l i C h ll
Settlement
A. The defendant shall send representative with badges to respond investigation of the staff from the Complaint Centre. B. The defendant shall sign on the Letter of Undertaking to commit that no infringing items shall be operated or exhibited during the course of the Fair once such infringement is proven. C. The Centre shall be entitled to deal with the infringing exhibits as per regulations.
Settlement
Staff investigate relevant booth and carry out settlement.
Recording
Detailed recordings for all situations and keep in files then return files to the complaint centre.
