VACATION RENTAL AGREEMENT
This Vacation Rental Agreement made and entered into by and between
hereinafter called "Tenant" and the Bangeman Family Limited Partnership,
(Johanna Bangeman and W. Lisa Prugh), hereinafter called "Owner."
The Owner hereby leases to Tenant, and Tenant hereby leases from Owner
the following premises at 234 N. Lakeside Blvd., Lakeside, Montana 59922,
(log cabin) ($1,250 per week)
(main house) ($1,600 per week)
(both) ($2600 per week)
from 5 PM on the _____________ day of ___________ , 2009, to 11 AM on the
________________ day of __________________, 2009.
Tenant agrees to pay Owner 30 days prior to occupancy, rent and other
costs for the rental period as specified herein.

PARTIES AGREE TO THE FOLLOWING:
01. The terms of this Vacation Rental Agreement shall be governed by
the Residential Landlord and Tenant Act of 1977, Montana Code
Annotated, Title 70, Chapter 24 as set forth and as amended. In any
litigation relating to this agreement, the proper venue shall be in
Flathead County in the State of Montana.
02. RESERVATIONS: To make a reservation, you need to fill out and sign
the Vacation Rental Agreement and return it to us with a payment of
50% of the rental charges. The house is reserved for you only after we
have received your reservation payment with the signed Vacation Rental
Agreement. Partial reservation payments are not accepted. All payments
must be in United States currency. We accept personal checks, money
orders and traveler's checks. Once we have accepted your reservation
and deposited your check, a copy of the signed Vacation Rental
Agreement will be mailed as a confirmation of your booking.
03. BALANCES DUE: The remaining half of your rental charges and damage
deposit is due no later than 30 days prior to your arrival. Failure to
pay the remaining balance will result in the loss of your reservation,
cancellation of the Vacation Rental Agreement, and forfeiture of your
04. PETS AND SMOKING: Smoking is not allowed in the house, only in the
parking area. Please be respectful of the property and take care of
your butts disposing of them in the outside trash cans, once completely
out. Smoking in the house will result in immediate eviction and loss
of rent and damage deposit. Pets are only allowed with prior approval.
Unauthorized pets on the premises will result in immediate eviction and
loss of rent and damage deposit. Please be considerate of the property
and clean up after your pet, disposing of excrement in outside trash
receptacles. Disregard of this rule will result in loss of your damage
deposit. There is an additional damage deposit for pets.
05. The maximum occupancy for this unit is _____ people.

06. DAMAGE DEPOSIT: A fully refundable $500 damage deposit is collected
with your second payment. Your damage deposit can be used to pay for
lost or missing keys; any cleaning that exceeds the standard turnover
cleaning fee, as well as damage done to the dwelling in excess of
normal wear and tear. (Additional cleaning charges will be deducted
from this deposit only if the home is left unusually dirty). The damage
deposit, minus any deductions, will be returned to you within 14 days
after your stay.
07. INSUFFICIENT FUNDS: A $50.00 service charge will be added to any
returned checks. Insufficient funds will cause your reservation to be
forfeited unless the outstanding balance and service charge are paid
within (4) business days.
08. CANCELLATIONS: In case of a cancellation, a full refund is made if
we are notified at least 60 days in advance of your arrival. If you
cancel within 60 days and we are able to fill your dates, we will
apply your deposit to a future booking or refund your deposit less
$100.00. If your dates reserved cannot be filled, your reservation
payment is forfeited.
09. CHECK-IN AND CHECK-OUT: Check in is at 5:00 PM A family member will
be there to greet you or leave the house open with the keys on the
kitchen counter. There are many sites to see in the area, so enjoy them
while we are preparing the house for your arrival. It will not be ready
for you prior to 5:00 PM Check-out is at 11:00 AM We will be standing
by to enter promptly at 11:00 AM to prepare the house for the next
guests. Please leave the keys on the kitchen counter. There are no
exceptions to the check-out time.
10. KEY REPLACEMENT: A $10.00 fee for each lost or missing key will be
taken out of your damage deposit.
11. FURNITURE AND EQUIPMENT: Each place is fully furnished and equipped
with basic items such as towels, pillows and bedding, pots and pans,
flatware and dishes. The towels provided are for indoor use only;
please bring your own beach towels. For your convenience, we provide
some paper products to get you started, body soap, a washer and dryer
with laundry soap and dryer sheets. We provide a few basic condiments
for cooking. The telephone is a party line and is provided for local
calls only. (Listen briefly first to see if the line is free, but
please interrupt if it is an emergency).
12. MAINTENANCE: Every effort is made to keep equipment such as TVs,
appliances, water systems, etc. in good working order. Please let us
know if anything needs attention. Repairs will be made as soon as
possible. No refunds will be made for malfunction of such equipment.
13. ITEMS LEFT BEHIND: Owners will not be responsible for items left
behind. Owners will make every effort to return items to you at your
01. Tenant and all persons in or about the premises with Tenant's
permission shall comply with the terms listed above.
02. Tenant shall conduct oneself and require other persons on the
premises with Tenant's permission to conduct themselves in a manner
that will not disturbs Tenant's neighbors' peaceful enjoyment of the
premises. Tenant shall use all parts of the premises in a reasonable
manner considering the purposes for which they were designed and
intended. Tenant shall be responsible for damages caused by his/her
negligence and that of his/her family, invitees and guests.
03. If there is noncompliance by Tenant with the Vacation Rental
Agreement, if unauthorized people or pets are resident, if Tenant or
Tenant's guests smoke inside, if Tenant destroys, defaces, damages,
impairs, or removes any part of the premises, this Vacation Rental
Agreement can be terminated immediately by Owner and Tenant's rights of
occupancy can be revoked immediately.
04. Owner will not be liable for any damage or injury to Tenant or any
other person, or to any property. Occurring on the premises, or in
common areas, unless such damage is the legal result of the negligence
or willful misconduct of Owner. (No diving or jumping off the
northeast end of the dock, as there is a large rock that makes it very
shallow and dangerous to do so). Tenant agrees to hold Owner harmless
from any claims for damages, no matter how caused except for injury or
damages caused by negligence or willful misconduct of Owner.
05. If Owner is unable to deliver possession of the premises at the
commencement date set forth in this agreement, Owner will not be liable
for any damage caused, nor will this Vacation Agreement be void or void
able, but Tenant will not be liable for any rent until possession is
delivered within 24 hours of the commencement of the term set forth
