A1 Vacation New Braunfels A Vacation Home Management Company (830) 609-3776, (210) 710-0583, susanphillips1@cs.com POLICIES AND PROCEDURES & Rental Agreement 911 - Call 911 in case of emergency. There is a first aid kit and fire extinguisher in each vacation home. FAIR HOUSING – Vacation Homes New Braunfels complies with all Fair Housing requirements, and will not deny rentals because of race, color, religion, sex, origin, handicap or family status. However, Vacation New Braunfels will not rent to any persons under the age of 25. A responsible party, age 25 or older, must occupy the property during reservation time. This guest will be responsible for all charges, any rules violations and all damages that may occur. This guest will also need to sign and date this agreemnt. We reserve the right to refuse service to anyone. GUEST CONDUCT - Guests must be responsible for their own conduct and that of all their party. Each guest must understand all rules and policies and abide by them. Our homes are often located neighborhoods where neighbors have to get up and go to work. Nudity, profanity, firecrackers, loud music after 11 p.m., a police call or a neighbor’s complaint will result in immediate eviction without refund of deposit or rent. Each vacation home has a guest limit. There will be a $30 charge per additional guest observed by management. LINENS – Each vacation home is fully furnished with linens, pots and pans, appliances, DW detergent, soap, paper towels etc. Guests should leave beds unmade, so the cleaning service will know what needs washing. SAFETY - Security is the sole responsibility of the Guest. Owner(s) or its agent assume no responsibility or liability for the safety or security of the guests, or for injury caused by the criminal acts of other persons. Guests should insure that all doors and windows are locked at all time, and guests must immediately notify Vacation New Braunfels (830) 609-3776 or (210) 710-0583 if any locks become inoperable. Guest should not leave appliances on or AC/heat in use while not on premise. We appreciate your effort to conserve energy. WATER SAFETY – If you are staying in a waterfront property, please do not dive in as the water depths vary. Do not climb or jump off high decks or boathouse roofs. Do not trespass on neighbor’s property. If the property has a hot tub, use at your own risk and keep locked when not in use. PARKING - No more than six vehicles per party. For special events, arrangements may be made with the property manager, Vacation New Braunfels. CANCELLATIONS – A $100 cancellation fee applies for any reservation that is cancelled anytime after booking with Vacation New Braunfels. Cancellation for shortterm rentals is 45 days. Cancellation for long-term rentals (two weeks or more) must be two months in advance. If your cancellation does not fall under these guidelines, you will forfeit your rent and deposit. If your cancellation does fall under these guidelines you will lose your deposit unless Vacation New Braunfels is able to rent to another party. There will be no refunds for shortened stays. Reservations are not contingent on conditions of area lakes, rivers, weather and area attractions. CHECK IN TIME - Check in time is 5 p.m. If you would like to check in earlier, please call Vacation New Braunfels prior to your arrival to ask if it is possible. Check in time is subject to whether the vacation home is rented the night before your arrival. CHECK OUT TIME – Check out time is noon. You will be charged $100 an hour after that until 1:30, at that time you will charged one full night’s rate on your credit card. We need at least 4 to 5 hours to turn a vacation home around for the next guests. NON-SMOKING – All of Vacation New Braunfels homes are non-smoking. Any evidence found of smoking (smell, burns, ashes) will result in the loss of your deposit. There will be a $1 charge per cigarette butt found on the property. PETS – Absolutely no pets are allowed. You will lose your deposit. For long term visitors small pets may allowed subject to the owner/manager’s approval. KEYS – Keys will be on the counter with the door unlocked upon your arrival. Please lock the doors and leave the keys inside when you check out. Please turn up/down AC/Heat. There is a $50 charge for lost keys. GARBAGE PICKUP – Instructions on garbage pickup may vary depending on the location of the vacation home. It is imperative to follow the instructions to avoid having to pay a fee for management to remove garbage. The fee is $20 a can. DEPOSIT – Deposit equal one weekend night’s rent. The deposit is to hold the reservation and for any damages or policy violations that may occur. After an inventory is taken of the vacation home and no damage is found or complaints filed, your deposit will be refunded to you within two weeks of your stay if not sooner. Each home has a complete inventory that Vacation New Braunfels will review upon your checkout. If the damage is over the amount of your deposit, your credit will charged the additional price assessed. REFUNDS – Vacation New Braunfels does not refund money for early departures or cancellations that do not fall under the cancellation guidelines. Vacation New Braunfels is an agent for the owners and does not have the authority to refund money to renters for any reason. CLEANING FEE – There is a one time cleaning fee of $150.00 per vacation home. Management reserves the right to raise or lower the fee depending the size of the home and the amount of guests. SALES TAX – Sales tax will vary depending on whether or not the vacation home is in the city limits. 13% inside New Braunfels and 6% outside. HOME MAINTENANCE – The lawns are cut each week during the summer season. Someone may stop by to water plants, pull weeds and check on the hot tub (if the home has one) during stays lasting four days or longer. Long term renters may request maid service for a fee. RENTAL AGREEMENT & RELEASE AND INDEMNITY AGREEMENT – The responsible guest (age 25 or older) arranging for the reservation, must sign and date the following agreement: Rental & Release and Indemnity Agreement (Your Name)_____________________________________________________________ hereinafter “TENANTS” on the behalf of any and all persons occupying and/or visiting the subject premises located (______________________________________________), during the rental period does forever release, aquit and discharge ___________________ _______________________________________________________________________ and all other persons, firms, or corporations who might be liable, from all claims, demands, charges, costs of court, including attorney’s fees and causes of action of whatever nature from all liabililty and damage of any kind, whether in contract or in tort. The rental period shall be___________________________________________________. Should the owners_________________________________________have a claim made against either or both of them, TENANT(S) agree(s) to indemnify and defend the owners __________________________________________________for any such claim and/or lawsuit. Further in the event that a claim and/or lawsuit arises out of the subject rental, and TENANT(S) has (have) a policy of insurance, owners _______________________shall Be considered insureds, and/or owners_______________________________________ shall enjoy the benefits of such an insurance policy as though they were the named insureds. Any dispute arising from the rental shall be governed and construed by the laws of the State of Texas. venue for any dispute shall be in Comal County, Texas; and any such dispute shall be adjudicated by binding arbitration. The costs and expenses of arbitration shall be shared equally by the parties, and each party shall be responsible it’s own attorney fees. If any part of this Release and Indemnity Agreement is invalid, the remaining portions shall remain in full and effect.
