SPRINGFIELD FLYING CLUB, INC. OPERATING RULES ARTICLE I. USE AND OPERATION OF AIRCRAFT Section 1. Under no circumstances shall Club aircraft be operated in violation of either the Operating Rules contained herein or the FAR. Section 2. Club aircraft will only be flown by a Member, or by a Certified Flight Instructor or FAA Check Pilot whom the Member has engaged to provide him instruction, a biennial flight review, or a proficiency or flight check. Section 3. Aircraft will be used for recreation and pleasure only. Use of the aircraft for profit or hire is absolutely forbidden. Use for profit or hire is assumed to have occurred if the Member receives pay for flying the aircraft, or is reimbursed in excess of the hourly cost of the aircraft. This prohibition does not preclude the payment of Certified Flight Instructors by Members of the Club, whether or not the instructor is a Member of the Club. Specifically, Certified Flight Instructors who are Members of the Club are prohibited from using Club aircraft for the instruction of non-members, whether or not they are paid for such services. Violation of this Section will be cause for immediate suspension of flying privileges. The Member will be presented to the membership for expulsion from the Club. Section 4. Aircraft shall be flown and utilized only as authorized within the insurance policy in effect at the time of the flight. The Secretary shall advise the Members in writing of the restrictions within the policy and of changes, which may occur therein. Section 5. Additional requirements or limitations for the use or operation of Club aircraft may be provided in these Operating Rules and may be more stringent than those required by FAR. ARTICLE II. SCHEDULING Section 1. All flights shall be scheduled through the Club’s current means of scheduling. No unscheduled flights shall be made. Reservations should not be scheduled more than 60 days in advance. Members shall not have more than 3 pending reservations at any one time, cumulative for all aircraft operated by the Club. Section 2. Scheduled time not to be used shall be cancelled as soon as possible. Section 3. If an aircraft is determined to be non-airworthy, it shall be taken out of service by the pilot-in-command. The Member shall affix a red tag to the control column, make an entry of the deficiency in the discrepancy form in the aircraft, and shall advise the Maintenance Officer, or in his absence, one of the other Officers. If it is determined that the aircraft will be out of service for more than a 24-hour period, the Maintenance Officer will update the scheduling service to indicate that the aircraft is down for maintenance. The scheduling service should be updated immediately by the Maintenance Officer upon ascertaining that the aircraft is again in service. These suggested procedures are not meant to relieve Individual Members scheduling aircraft from responsibility for verifying the availability and status of the aircraft prior to flight. Members will not attempt to operate any Club aircraft with a red tag affixed to the control column or ignition key until such aircraft is released as airworthy by the Maintenance Officer or a Certified A&P Mechanic. Date: 12/01/04 1 Section 4. If an aircraft is airworthy, but otherwise in need of maintenance, the pilot-incommand shall notify the Maintenance Officer of the deficiency as soon as possible. Section 5. Scheduling for any Club aircraft shall neither exceed 72 consecutive hours or 10 flight hours unless approved in advance by the Maintenance Officer or, in his absence, by one of the remaining Officers. Cross-country flights are limited to two consecutive weeks or weekends from May 1 through September 30 and may be limited by the Officers during the remaining months if determined to be necessary to provide equitable use of the aircraft. Section 6. Members should allow adequate time upon the completion of their flights for routine servicing including refueling of the aircraft prior to the expiration of their scheduled time. ARTICLE III. FLIGHTS Section 1. No applicant for Club membership shall fly Club aircraft until the Secretary or other Officer advises him or her that they have been accepted for membership. Section 2. No Member may act as pilot-in-command of any Club aircraft unless within the preceding 180 days actual flight time has been logged in an a similar category and class aircraft to the highest performance type to be used. If the Member has not logged the required flight time in the last 180 days, he or she is not current and must complete a f1ight proficiency check with an FAA-approved flight instructor. This requirement is in addition to the recent requirement for carrying passengers as it appears in FAR. Section 3. No Member will fly a Club aircraft as pilot-in-command unless he has an officia1 checkout entry in his flight log for the type and model to be flown and is otherwise current under the FAA requirements and these Operating Rules. An Officer may request to verify such flight log entries. Notwithstanding the foregoing, total time and training minimums required for the Cessna 182 shall be: At least 100 hours total time, of which five (5) hours Dual instruction with a CFI is required, after which ten solo landings AND a checkout by a Springfield Flying Club CFI, if an outside instructor completed such training. This shall be completed before carrying passengers. These minimums shall be in addition to FAA and insurance minimums. Section 4. Solo students will be governed by the limitations set forth by FAR and their Clubapproved instructor. Section 5. The Officers may require a check flight of any Member. Section 6. The pilot-in-command is responsible for use of an appropriate checklist for the accomplishment of all pre-flight, engine starts, ground operations, flight operations, shutdown, and post flight of the aircraft. Checklists utilized shall be no less complete than those provided in the official flight manuals for the aircraft concerned. Section 7. No aircraft shall be started unless a responsible person is at the controls with brakes applied. No aircraft shall be started in a hangar or with the propeller blast directed toward the interior of the hangar. Date: 12/01/04 2 Section 8. Club Members are responsible at all times for the proper securing of the aircraft after flight and for appropriate precautions against high winds or storms. To avoid condensation, steps should be taken after flight to have gasoline tanks filled, if they are less than half full. Section 9. Members involved in an incident (not requiring notification of NTSB or of FAA) shall make a written report to the Club Officers within 10 days when requested but are not grounded from the use of the Club equipment unless flight privileges are revoked by the Officers. Any incident which may have caused structural damage such as a hard landing shall be cause for grounding the aircraft until it is inspected and released for flight by the Maintenance Officer or Certified A&P Mechanic. Section 10. Members involved in an accident (any mishap requiring notification of NTSB or of FAA) with Club aircraft will automatically be grounded from the use of the Club equipment. There will be an investigation by the Accident Review Committee, under the provisions outlined in Article VIII, Section 4c of these Rules. Section 11. Forced landings must be reported immediately to the Maintenance Officer or, in his absence, to the Safety Officer. No Member will attempt to take off following a forced landing except from a recognized airport. If the landing was due to mechanical malfunction, takeoff will only be attempted after the aircraft has been inspected and certified airworthy by the Maintenance Officer or a Certified A&P Mechanic. Section 12. Accident Hearing: The Board of Directors, upon review of the findings of the Accident Review Committee, shall offer all parties involved in the accident the opportunity of a hearing. After the hearing, or if such hearing is waived by all the parties involved in the accident, the Board of Directors shall decide the financial responsibility. The decision of the Board of Directors shall be final. The Board of Directors shall not impose financial responsibility on any one Member in excess of the current insurance deductible for any one accident, unless the damage results from a violation which is not covered by insurance carried on the aircraft. Members will be liable for the full amount of all damage resulting from an uninsured action. The recommendation of the Board shall be approved by a recorded quorum vote of Club Members at a regular scheduled meeting. All financial obligations imposed on any Member as a result of the decision of the Board shall be satisfied within 30 days of written notice. Section 13. On cross-country flights, a Member is responsible for the expense of returning the aircraft to Capital Airport unless relieved of this responsibility by approval of an Officer. A Member who is weathered-in must update the scheduling service and notify the next person who has a reservation. Section 14. Any Member found in violation of any current Operating Rule governing or applicable to the Club is subject to disciplinary action by the Officers, which may include suspension from flying Club aircraft and the initiation of action to revoke membership. ARTICLE IV. MAINTENANCE OF CLUB AIRCRAFT Section 1. All FAR pertaining to the maintenance, inspection, and airworthiness of aircraft as they apply to their private use under the By-Laws and these Operating Rules are made a part of these Operating Rules. Upon recommendation of the Maintenance Officer and approval of the membership, additional maintenance standards may be adopted as a part of these Operating Rules. Date: 12/01/04 3 Section 2. To facilitate the carrying out of non-maintenance activities in maintaining the cleanliness and condition of aircraft, hangars, and associated supplies and equipment, the President shall appoint a Maintenance Officer. In addition, the Maintenance Officer may assign a Member to assist under coordination of the Maintenance Officer in the performance of such duties. The Maintenance Officer will monitor the condition of the aircraft, the need for maintenance or repair, the due dates for required inspections, and such other tasks as may be assigned. The Maintenance Officer will, if feasible, advise affected Members if the aircraft is to be out of service for more than 24 hours and will advise the Members of problems discovered in utilization or scheduling. Section 3. Set-aside funds for engine overhaul, propeller overhaul, airframe & interior, and avionics are hereby established. The amounts will be set aside in a special fund in the following amounts from the hourly charge receipts of each aircraft: a. C-172 Engine Overhaul Fund C-172 Propeller Overhaul Fund C-172 Airframe & Interior Fund C-172 Avionics Fund b. C-182 Engine Overhaul Fund C-182 Propeller Overhaul Fund C-182 Airframe & Interior Fund C-182 Avionics Fund $7.50/hr $1.75/hr $2.50/hr $3.25/hr $10.50/hr $3.75/hr $2.75/hr $3.50/hr Amounts set aside in the Funds may be used for other than the specified task of the respective aircraft only with the approval of a simple majority of the Members present at a regular or special meeting. Section 4. Any maintenance or repair in excess of $1,000.00 (except for a major engine overhaul, covered by the overhaul fund) or the replacement or addition of equipment in excess of $500 shall require the approval of a simple majority of the Members present at a regular or special meeting. Section 5. The Maintenance Officer will advise the membership when each Club aircraft engine has consumed 80% of the hours to major overhaul to insure the appropriate consideration of repair and replacement alternatives before the commitment to overhaul be made. ARTICLE V. LIMITATION ON NUMBER OF MEMBERS Section 1. The total number of Individual Members plus Family Members shall not exceed 15 per certified aircraft. Date: 12/01/04 4 ARTICLE VI. MEMBERSHIP FEES, DUES AND FLIGHT RATES Section 1. Basic membership fees shall be as follows: Individual Membership $500 (flying privileges in all Club aircraft) Family Membership $250 (flying privileges in all Club aircraft) Membership fees are not refundable. Only an Individual Membership is transferable. The Family Membership fee is in addition to the Individual Membership fee and extends use of the Club’s aircraft to one additional person from the Member’s immediate family (i.e., spouse, son, or daughter). Section 2. Club dues shall cover all fixed costs, and flying charges shall cover all variable costs. Fixed costs are defined as those, which occur independently of aircraft usage. Variable costs are defined as those, which occur as a result of aircraft usage. Section 3. Monthly dues shall be $30.00 for Individual Members and $15.00 additional for each Family Member, billed at the beginning of the month to which they apply. The Treasurer and the Maintenance Officer shall not be required to pay the monthly dues applicable to Individual Members. While any Member, who is in good standing, is deployed for extended military duty, said Member may be granted a Military Leave Membership. The Military Leave Membership applies to Members who are assigned to active duty and living away from the Springfield, Illinois area in excess of 30 days. Military Leave Members shall not be required to pay the monthly dues or hull insurance fees during those months while on active duty, and must relinquish any flying privileges during that time. Prior to reinstatement of flying privileges, Member shall be responsible for the payment of the current month’s dues and hull insurance fee. Section 4. Monthly hull insurance charges shall be $20.00 for Individual Members and $10.00 additional for each Family Member, billed at the beginning of the month to which they apply. The hull insurance charges are subject to revision due to increases in hull insurance costs. Section 5. Charges per TACH hour of flight time will be based on the variable costs of operation and the set-aside items listed in Article IV, Section 3. The current charges are as follows: For the C-172 For the C-182 $75.00 per Tach hour $90.00 per Tach hour The above charges will escalate as fuel prices change at the rate of $0.05 per gallon, assuming a 10 gallon/hr usage by the C-172 and a 15 gallon/hr usage by the C-182 as follows: For the C-172 For the C-182 $0.50 per Tach hour $0.75 per Tach hour Date: 12/01/04 5 Section 6. The Member is responsible for the payment of flight instructors and, when away from Capital Airport, for landing fees, hangar fees, tie down fees and other related fees. Section 7. The Club will pay fuel and oil for all flights. The Member will pay for purchases at other than Capital Airport. An original copy of the receipted fuel and oil purchase ticket in the name of the Springfield Flying Club, Inc. or a Member’s original credit card invoice can be presented by the Member, with and applied to, the payment due on the monthly statement. Section 8. Minor maintenance less than $50 required away from home station may be authorized by the Member, and may be paid by him and the receipted invoice submitted and applied to his payment of the next monthly statement. Charges in excess of $50 shall be made only with the approval of the Maintenance Officer or, in his absence, of another Officer. Section 9. Any Member may be considered in default and not in good standing when indebtedness to the Club exceeds 60 days or $200 at the close of billing for any month. A Member in default is prohibited from using Club aircraft and shall be so notified by the Treasurer by mail to his last known address. His membership may be presented for revocation by action of the Officers if payment is not received within 30 days after mailing of such notice. The flying privileges of the Member will not be restored until the Member’s account is paid in full plus interest at the rate of 1% per month. ARTICLE VII. DUTIES OF CLUB OFFICERS Section 1. The President, in addition to the duties prescribed in the By-Laws, shall be responsible for: a. Calling meetings of the Directors as members of the governing board when transacting interim business between meetings of the membership or at the request of one or more of the Directors. b. Monitoring Club activities including the performance of the Officers and committees. Encouraging the timely and proper performance of their assigned tasks. c. Investigating or causing the investigation of misuse of Club property, including aircraft incidents or accidents. d. Remaining aware of general aviation problems at Capital Airport, informing the membership of such matters, and providing a positive avenue for their solution. e. Causing an awareness of all Members in the guidelines provided for in the By-Laws, Operating Rules, and other regulations or safety practices, cooperating in such endeavors with the other Officers. f. Contacting each new Member to assist in fostering a spirit of cooperation and safety as objectives of the Club. g. Preparing informational letters to the membership as may be desirable in fostering the interests and objectives of the Club. Date: 12/01/04 6 Section 2. The Vice President, in addition to the duties prescribed in the By-Laws, shall be responsible for: a. Assisting the President in monitoring and coordinating the overall activities of the Club as assigned by the President. b. Keeping informed on the status of Club activities so that continuity of Club management is insured in the absence of the President. c. Shall serve as Club’s Safety Officer and shall be responsible for: (i.) Planning programs or written informational summaries for keeping the Members informed of all matters related to aircraft safety including FAR. Operation of aircraft including seasonal problems, emergency procedures, ground handling and operation, maintenance problems and procedures, weather, operation and characteristics of electronic equipment aboard Club aircraft, navigation aids, aircraft control procedures, local traffic regulations and problems, use of published aids to air navigation, observed or reported unsafe practices, or other matters pertaining to safety. (ii.) Monitoring as feasible, the operation, inspection, and maintenance performed by Members to identify unsafe practices, as well as investigating reported unsafe practices for the purpose of evaluating them and alerting the Members, proposing amendments in these rules, or such other action as may be appropriate. (iii.) Acting as liaison for the Club in matters of aircraft safety with the Airport Authority, FAA, the Illinois Department of Aeronautics, or other agencies, organizations or groups concerned with aircraft safety. (iv.) Coordinating the above activities with the advice and assistance of the Educational and Social Committee, Accident Review Committee, or other committees or Officers concerned. Section 3. The Secretary, in addition to the duties prescribed in the By-Laws, shall be responsible for: a. Maintaining a roster of all current members. b. Maintaining a roster of all prospective members or applicants and utilizing a waiting list to fill vacancies, maintaining the appropriate priorities of those on the list. c. Advising applicants when their membership applications are complete, verifying that Article II, Sections 1 and 2 of the By-Laws, and informing the applicants when they are cleared to fly Club aircraft. d. Updating the Club’s scheduling service as necessary. e. Insuring that Members are notified of changes in insurance policy coverage, changes in the By-Laws or these Operating Rules, or temporary policies approved by the Officers or membership. Date: 12/01/04 7 f. Acting as Registered Agent for the Corporation and Filing Form NP-11 with the Secretary of State upon assuming office. g. Filing Articles of Amendment to the Articles of Incorporation (Form NP-35) with the Secretary of State at any time the Articles of Incorporation are amended. Section 4. The Treasurer, in addition to the duties prescribed in the By-Laws, shall be responsible for: a. Collecting and replacing aircraft tachometer log books at end of last day of month. b. Preparing monthly statements from aircraft tachometer log book entries of members at the beginning of the month and mail to each Member. c. Maintaining individual account of each Member. d. Preparing and making bank deposits from Member’s payments and/or any other Club revenue, e.g., insurance proceeds, damages or expense reimbursements. e. Reconciling bank statements. f. Remitting payment of outstanding liabilities incurred by the Club including timely payment of insurance. g. Preparing financial reports for the monthly Club meeting. h. Purchasing and maintaining proper supply of Club stationery, statement forms and envelopes. i. Submitting to the State receipts for fuel purchased for cash on delivery in the State of Illinois with the following form: State of Illinois, Motor Fuel Tax, Aviation Refund Claim, Illinois Form 6042 for motor fuel tax aviation use refund, submitted at treasurer’s discretion within the limit specified for refund. j. Submitting at the beginning of each year to the State the following form State of Illinois, Annual Report, General Not for Profit Corporation Act, Illinois Form NP-63 or 79 for listing new Club officers. k. Submitting yearly to the State the following form and any attendant fee: State of Illinois, Aircraft Registration. l. Submitting yearly to the Federal government the following form: Federal Department of Transportation, Aircraft Registration Form 0MB No. 04-R0185, AC Form 8050-73. m. Submitting at the beginning of each year to the Federal government the following form: Federal Income Tax Report, Income Tax Return of Organization Exempt from Income Tax, Form 990 or other applicable forms as may be required. n. Submitting yearly to the Federal government the following form: Federal Use Tax Return on Civil Aircraft, Form 4638. Date: 12/01/04 8 o. Advising officers of action taken to suspend Members in default. p. For checks greater than $2,500.00 a second signature shall be required. Any Officer may countersign a check. The amount of the check requiring two signatures can be changed by a simple majority vote of the Board of Directors. Section 5. The Maintenance Officer, in addition to the duties prescribed in the By-Laws, shall be responsible for: a. b. c. Coordinating the maintenance and scheduling of aircraft. Monitoring the condition of Club aircraft and the quality of maintenance performed by Members and outside vendors. Monitoring all aircraft for compliance with FAA directives and regulations. ARTICLE VIII. COMMITTEES Section 1. Educational and Social Committee. The purpose of this committee shall be to plan informational or educational programs related to flying and aircraft which may be conducted as a part of regular meetings or at special social events planned by the committee. The President or the Board may, at the beginning of his/their term, appoint up to three Members to serve on this committee. In addition, the Safety Officer shall be an Ex Officio member of the committee. A majority of the members shall constitute a quorum. Section 2. Nominating Committee. The purpose of the nominating committee shall be to recommend candidates for vacancies, which occur among the Directors during the calendar year. The Nominating Committee shall also present at the April meeting, a slate of candidates for Directors. This slate will be considered by the membership and voted upon at the annual meeting in May together with any nominations from the floor. The committee will consider the qualifications of proposed candidates for each office to be filled and will determine their willingness to serve. Their names will then be placed in nomination. Section 3. Finance Committee. The purpose of the committee shall be to review the accounts and financial transactions for the calendar year, to determine the adequacy of accounting for receipts and disbursements, to examine supporting documents for expenditures, to determine the appropriateness of billings of Members which may be done on a spot-check basis, and to carry out such other examinations as its members may deem appropriate. The committee will report its findings to the Treasurer and the membership together with any recommendations for improved accounting procedures or for further audit by an accounting firm if this action is considered to be in the best interest of the Club. The final report will be in writing and copies furnished to the outgoing Treasurer, the incoming Treasurer and to the Secretary for inclusion in the official records of the Club. The committee shall be appointed by the President in April and report at each meeting. Section 4. Special Committees. The following committees will consist of up to three Members appointed by the President for the specific purpose or task assigned and will be dissolved upon completion of the assigned task unless continued by the President to perform additional investigations or tasks related to the specific purpose for which the committee was appointed. Two Members shall constitute a quorum and the President shall name one member to act as chairman. Those committees will report at each meeting. Date: 12/01/04 9 a. Equipment Replacement Planning Committee. The purpose of this committee shall be to evaluate the status of aircraft and component equipment, the utilization thereof by the membership, the needs and desires of the membership, and the availability of funds projected upon the basis of past experience, and to develop priority alternatives for consideration of the membership in terms of the replacement of aircraft and the updating, replacement or addition of electronic, emergency, ground support, and other equipment which will enhance the utilization of aircraft and the safety of flight. Alternative priorities will be proposed for consideration of the membership and amendments in the plan proposed from time to time as considered appropriate. b. Aircraft Utilization Committee. The purpose of this Committee shall be to monitor the use of aircraft, to receive complaints of members about aircraft scheduling or availability, and to recommend policies or procedures, which will insure the most effective utilization of aircraft and the fairest treatment of Members. In terms of scope, the committee may recommend limitations on the hour utilization by Members, limitations on cross country flight, clearance or approval procedures for extended flights scheduling procedures, or any other policy or procedures that will further the purpose of the committee to the benefit of the membership. c. Accident Review Committee. The purpose of this committee shall be to review accidents involving either a Member of the Club or any equipment belonging to the Club, provided such accident resulted in damage to equipment exceeding a sum of Five Hundred dollars ($500.00). The Accident Review Committee shall be comprised of the Safety Officer and two other Members who were not involved in the accident. The Safety Officer will serve as chairman of the committee and appoint Members to the committee. In the event that the Safety Officer is involved in an accident, the President shall appoint the chairman, and the chairman shall appoint the remaining committee members. The findings of the committee shall be presented in writing to the Board of Directors. d. Other Special Committees. The President may establish such other special committees as he feels are necessary for the benefit of the Club, determine their purpose and membership, and dissolve the committees upon completion of their assignments. However, any such committees may become a permanent standing committee only by amendment to these Rules. ARTICLE IX. EFFECTIVE DATE Section 1. These amended Operating Rules will become effective upon approval of a simple majority of the Board Members present at a special meeting. ARTICLE X Section 1. All previous Operating Rules and Amendments are hereby repealed and superceded by this document. Date: 12/01/04 10
