Objective

Taking into account diverse legal and regulatory frameworks in the region, APEC member economies should endeavour to reduce o r eliminate the requirement for
paper documents needed for customs and other cross-border trade administration and other documents and messages relevant to international sea, air and land
transport, where possible, by 2005 for developed and 2010 for developing economies, or as soon as possible thereafter.

Guidelines

Recognising the enormous potential of paperless trading to expand business opportunities, reduce costs, increase efficiency, improve the quality of life and facilitate
the greater participation of small business in global commerce, each APEC economy will:

(a) Establish a timetable for reducing or eliminating paper documents related to international trade.
(b) Provide a favourable environment, including through establishing a sound legal and regulatory framework, for the delivery of paperless trading systems
(c) Ensure that measures to replace paper documents for cross-border trade administration with electronic equivalents are media and technology neutral, secure
and interoperable with and between all parties involved in the international supply chain of goods and services,
(d) Note the important role the business sector plays in providing and using electronic commerce technology, applications, practices and services, and
(e) Co-operate with and enhance the capability of other APEC economies to implement paperless trading systems.

Collective Actions

APEC Economies may take Collective Actions relating to paperless trading in areas to be agreed.

Thailand’s Approach to APEC's Paperless Trading Goals in 2002

The Government of Thailand has encouraged among internet-based communication the government agencies and between government agencies and the private
sector. A number of government including key agencies, such as Department of Foreign Trade, Department of Commercial Registration and Department of Customs,
have applied an EDI infrastructure to communicate with the private sector.

In regards to the legal infrastructure, the Information Technology Laws Development Project, proposed by the Ministry of Science Technology and Environment, was
approved by the Cabinet in December 1998 with the mandate to research and develop Information Technology Laws. The National Information Technology
Committee, chaired by the Deputy Prime Minister in charge of economic and social development, has set up six Sub-Committees to develop IT legal infrastructure.
The National Electronics and Computer Technology Center (NECTEC), a government statuary agency under the auspices of the National Science and Technology
Development Agency in the Ministry of Science Technology and Environment was appointed as secretary of all Sub-Committees. The conceptual framework of the

above-mentioned IT Laws are as follows:

1. Electronic Transaction Law: To recognize the legal effects of data messages by treating them as the functional equivalent of writing or evidence in writing with a
view to promoting electronic transactions to achieve reliability.
2. Electronic Signature Law: To enable reliability of the use of electronic signature.
3. National Information Infrastructure Law (By Law of Section 78 of the Constitution): To provide: information infrastructure thoroughly; equitable universal access via
promotion of more equitable and affordable rights of access to information; and opportunities of access to information infrastructure.
4. Computer Crime Law: To address criminal law against computer systems, networks, or data, and other types of similar misuse.
5. Data Protection Law: To protect rights of privacy in the information society.
6. Electronic Funds Transfer: To facilitate electronic fund transfer.

The development project on IT laws is an initiative to facilitate the environment for electronic commerce activities in Thailand. In addition, these sets of la ws will
promote confidence of foreign investors. Presently, the first two IT Laws, namely the Electronic Transaction Law and Electronic Signature Law, were combined to form
the “Electronic Transactions Law”. The Electronic Transaction Law has been enforced since 3 April 2002. Those bills were drafted in accordance with the guidelines
under the Model Law on Electronic Commerce, and Electronic Signatures of the United Nations Commission on International Trade Law (UNCITRAL). The draft
Universal Access Law was recently approved in principles by the Cabinet and was submitted to the Office of State and the Office of Public Services Reform
Committee.
