Rental Contract G.G. Toy Hauler Rentals This contract is made on ______________________________, between ____________________ _______________________ Party one, of G.G. Toy Hauler Rentals, City of Anaheim State of California, and ________________________, Party two, Renter, City of _________________________, State of California. For Valuable consideration, the parties agree to the following: Party one agrees to: Rent a _____________________________________ Toy Hauler on __________________, 20___ to _____________________, 20___. Party Two agrees to: Rent a _____________________________________ Toy Hauler for the Cost of $ __________. Party Two agrees to provide a 50% deposit which is required to reserve the trailer. The deposit will go towards the rental fee of $ ________.The remaining balance is due in the form of cash, cashier’s check, or money order on date of pick up. A deposit in the amount of $500.00 for insurance deductible/ damage/cleaning will also be due on the day of pick up. The deposit will not be deposited if the trailer is returned with no damage and if all items that were with the trailer are returned in good condition. If the trailer has damage, missing items or not wiped down or swiped the check will then be deposited and an itemized receipt and refund will be sent to the customer/renter. The renter must dump the vehicle holding tanks there will be a $50 fee if the waste tanks have not been drained. Propane tanks must be refilled; if tanks are not filled a $50 fee will be charged. Additional Items:  Copy of Valid Driver’s License  Proof of liability insurance (We provide collision and comprehensive insurance on the Vehicle with a $500 deductible per occurrence, which the renter is responsible for. We do not provide liability insurance coverage on the Vehicle. Renter must provide liability insurance coverage on the towed Vehicle through the personal auto policy covering the towing vehicle. )  Renter must sign a Liability Waiver We make no warranties, express, implied or apparent, regarding the vehicle, no warranty of merchantability and no warranty that the vehicle is fit for a particular purpose. The following acts or uses of the vehicle are prohibited: a) towing the vehicle (i) by anyone who is not an authorized driver, or by anyone whose driving license is suspended in any jurisdiction; (ii) by anyone under the influence of drugs or alcohol; (iii) by anyone who obtained the vehicle or extended the rental period by giving us false, fraudulent or misleading information; (iv) in furtherance of an illegal purpose or under any circumstance that would constitute a violation of law other than a minor traffic citation; (v) to carry persons or property for hire; (vi) in any race, speed test or contest; (vii) to carry dangerous or hazardous * DO NOT WALK OR STAND ON ROOF * Page 1 0f 3 items or illegal materiel; (viii) outside the United States or Canada; (ix) when loaded beyond its capacity, as determined by the manufacturer of the vehicle; (x) when driven through or under an underpass or other structure without sufficient overhead or side clearance; (xi) when it is reasonable to expect you to know that further operation would damaged the vehicle; (xiii) in a manner that causes damaged to the vehicle due to inadequately secured cargo; (xvi) on unpaved roads; or, (b) failing to summon the police to any accident involving the vehicle that caused personal injury or property damage; (c) damaging the vehicle by your intentional, wanton, willful or reckless conduct; (d) damaging the vehicle by an animal transported in the vehicle (e) damaging the vehicle by sitting, standing or lying on the roof of the vehicle; (f) damaging the vehicle by placing tire chains, signs, lettering or painting on the outside of the vehicle; (g) damaging the vehicle by placing loudspeakers or other sound equipment on the exterior of the vehicle; and, (h) if the vehicle is equipped with an outside fuel station, using any fuel octane-rated higher than 87 you will indemnify, defend, and hold us harmless from and against any claim arising out of unsafe fueling practices committed by you or your agent. Renter shall be held liable for any and all damages including those that might exceed the damage/cleaning deposit. No smoking in trailers at any time, pets are allowed. An additional fee will be charged if pets damage interior/exterior. Damage caused by striking overhead objects sideswiping and undercarriage is considered negligence misuse or carelessness the renter is 100% liable. A spare tire is provided. We do not take responsibility for flat tires. The renter is responsible for repairs. In the event of an accident, a police report must be filed/submitted and G.G. Toy Hauler Rentals must be contacted . In the event the trailer is not returned on the agreed upon date and time, a revised daily rate of $200.00 shall be assessed until the trailer is returned. If trailer batteries are drained completely there is a $50.00 replacement cost to the renter. Renter must wipe down and sweep before returning the trailer to G.G. Toy Hauler Rentals. For your safety as well as others: all renters must have a brake controller & a 7 way plug installed on the vehicle that will be towing the trailer. We will provide you with a hitch, ball, sway bars, eq. etc. Deposits are non-refundable. If you contact us three weeks prior to your day of pick up and need to reschedule we will give you a full credit for another weekend. This does not apply for major holiday weekends No modification of this contract will be effective unless it is in writing and is signed by both parties. This contract binds and benefits both parties and any successors and assigns. Time is of the essence of this contract. This document, including any attachments, is the entire agreement between two parties. This contract is governed by the laws of the State of California. To assume and accept all risks, dangers, and hazards in connection with the rental of this trailer. 2. To waive any and all claims that I may have against G.G. Toy Hauler Rentals, and or representatives. 3. To release G.G. Toy Hauler Rentals for any and all liability for any loss, damage, injury, death or expense that I, my next of kin, spouse, family, pet, and friends may suffer or incur as a result of my renting this trailer due to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF G.G. TOY HAULER RENTALS and OR REPRESENTATIVES. 4. To hold harmless and indemnify G.G. Toy Hauler Rentals from any and all liability for property damage, personal injury, or death suffered by myself or by a third party as the result of my renting this trailer. 5. That this release and indemnity agreement shall be effective and binding on my heirs, next of kin, executors, administrators, and assigns, in the event of my death. I have read and understand this release and indemnity agreement prior to signing it and am aware by signing this document, I am affecting the legal rights and liabilities of myself, my heirs, next of kin, executors, administrators and assigns in relation to G.G.
