                            BOARD OF EDUCATION MEETING

                                          MINUTES


       The Board of Education of the Fontana Unified School District held a       Regular
Regular Meeting on February 5, 2003, at the John D. Piazza Education Center,      Meeting
9680 Citrus Avenue, Fontana, California. Present at the meeting were: Dr. D.      02-05-03
Wayne Ruble, President; Mr. Rick McClure, Clerk; Mrs. Kathy Binks, Member;
Mr. Gus Hawthorn, Member; Ms. Laura Abernathy Mancha, Member; Dr.
Karen Harshman, Superintendent; Mr. Emmanuel J. D’Souza, Associate
Superintendent, Business; Ms. Fran Mazzolini, Associate Superintendent,
Educational Services; and Dr. Patricia Peoples, Associate Superintendent,
Administrative Services. The President called the meeting to order at 4:00 p.m.



       The President called a Closed Session at 4:01 p.m.        The meeting      Closed

       Visitors present at the meeting were: Mr. Sam Poindexter, President,       Visitors
Fontana Teachers Association; Mr. John Avalos, President, School Police           Present
Officers Association; Mr. Tony Micciche, President, United Steelworkers of
America, Local 8599; and interested employees and members of the community.



       The meeting was opened by the Pledge of Allegiance to the Flag of the      Pledge of

        On motion made by Ms. Laura Abernathy Mancha, seconded by Mrs.               Minutes
 Kathy Binks, and carried, the Board approved the minutes of the Board of            Approved
 Education Regular Meeting of January 15, 2003.



        Dr. Harshman, on behalf of the Board of Education, presented a plaque        Achievements
 to Mr. Bryan Malloy, Principal, and Mr. Dick Bruich, Head Football Coach of         Acknowledged
 Henry J. Kaiser High School, recognizing the football team’s achievement of
 being the CIF Division 3 Champions, California State Champions, and Sunkist
 League Champions for the 2002 football season.

         Dr. Ruble commented that the Board will begin to recognize all school
 teams, academic and athletic, that achieve championship status at the state level
 in the future.



        Mr. Leonard Valdepeña, Fontana Relay For Life Co-Chairperson, and
 Laura Rimat, Special Events Manager for the American Cancer Society,
 presented Dr. Harshman with two statewide awards for the May 2002 Fontana
 Relay for Life event; a 1st place award for “Per Capita Income”, and the
 “Greatest Growth” award.

       Dr. Harshman commented that these awards were really deserved by
 Fontana Unified School District employees and members of the community who
 worked to make last year’s Relay For Life such a success.



      The President called the Hearing Session to order and called for               Visitors’
 comments from visitors.                                                             Comments

       Tony Orlich spoke on the support of dictatorships in other countries by
 America, and about sanctions on Iraq.


        Cathy Leonard, a RSP teacher at Fontana A. B. Miller High School,
 spoke on the issue of continuous substitute teachers in RSP teaching positions at
 A. B. Miller, and on the 20-day substitute rule for special education. She asked
 the Board for attention to this matter.

        Dr. Harshman responded that there was no freeze on the hiring of
 classroom teachers, and that the series of substitutes was due to the lack of
 replacement teachers.

         Ms. Gayle Hinazumi, Director of Special Services, stated that hiring         Visitors’
 recommendations from a recent job fair had been made, and that candidates for        Comments,
 those positions were going through reference checks. She clarified that state        continued
 policy stipulates that substitutes for special education classes may remain in one
 assignment for no longer than 20 days unless they hold a Special Education
 credential. She also stated that the district had a Memorandum of Understanding
 with the Fontana Teachers Association to provide special education teachers
 with an additional stipend for caseloads of more than 28 students.

        Mr. McClure asked if there was any way for teachers or the district to
 apply for an emergency credential.

        Dr. Harshman responded that she would look into that possibility.

        Ms. Mancha asked whether the district was asking teachers to break the
 law by requesting them to handle caseloads of more than 28 students.

         Mr. Poindexter responded that the teachers union had previously filed a
 complaint with state on caseload, and that the state agreed the district had been
 in violation. Correction was necessary and done via individual school plans.
 The teachers did not agree that this correction was appropriate; and the Fontana
 Teachers Association agreed with the teachers on this issue. The timeline for
 the additional pay was also slow. Mr. Poindexter then stated that there was also
 a control problem in classrooms with many substitute teachers.



         Mr. Tony Micciche referred to the agenda item regarding the incentive        Bargaining Unit
 for early retirement being offered to certificated teachers, and how in the past     Representatives’
 when these incentives had been made available they were also offered to              Comments
 classified and other bargaining units. He commented that when this information
 is shared late prior to Board meetings, employees and the public do not have the
 time to see it and understand what is being proposed, and that their rights were
 not being upheld.

         Dr. Ruble responded that Mr. D’Souza was looking into the possibility of
 offering such a program to classified and management personnel and would
 report back to the Board.

         Mr. Poindexter stated that he wanted to make clear that while the            Bargaining Unit
 Fontana Teachers Association was not opposed to other bargaining unit requests       Representatives’
 for such an incentive, that the incentive was not being offered as a gift, it was    Comments,
 being offered as an incentive for long-term, higher-paid teachers to leave the       continued
 district so they could be replaced by lower-paid, non-tenured teachers. The
 resultant savings then could be used to cover benefits and salaries for next year,
 and could help reduce out of pocket benefits expenses for all employees in the
 future. He pointed out that at the same time this incentive was being offered to
 teachers, he had been given information on increased class sizes and teacher
 workloads. This would impact the remaining employees more than the retiring
 certificated employees if the incentive were extended to other units.

        Mrs. Binks expressed her concern that this retirement incentive would
 take experienced employees away from the district.

         Mr. Poindexter responded that this was all about the dollars in response
 to the budget cuts from the state; it was not meant to take away from the value of
 the employees.

        Mr. McClure stated that it was only with greatest of reluctance that he
 would support the incentive offering, as many of the district’s best teachers
 would be enticed to leave the classroom, but that the situation was unavoidable
 and really not something the Board wanted to do.

        Ms. Linda Young requested that if the incentive were to be offered to the
 other employee units that the savings to the district also be shown, as that was
 the purpose of the incentive being offered to teachers.



         Dr. Dayton Gilleland, Director, High School Education, presented a           Aiming
 report on the Aiming Higher: Fontana High Schools for the 21st Century               Higher Report
 program and its intentions to better prepare students for success beyond high
 school.

        Mr. Hawthorn requested that the new A-G requirements pertaining to
 graduation be displayed on Channel 17.


         On motion made by Mr. Rick McClure, seconded by Mr. Gus Hawthorn,            Transfer of
 and carried, the Board approved that all present and future ownership and rights     Ownership
 to all District copyrighted curriculum and assessment materials, including but       Approved
 not limited to curriculum guides, grading standardization guides, report card
 templates and various assessments, be transferred in full to the Fontana
 Educational Institute.

         On motion made by Mrs. Kathy Binks, seconded by Mr. Rick McClure,         Funding
 and carried, the Board approved submission of the 2002-2003 Consolidated          Application
 Application for Funding Categorical Aid Programs Part II, in the amount of        Approved
 $17,086,597.00 to the California State Department of Education for the
 following programs: Title I, Part A and D, Neglected or Delinquent Program;
 Title II, Part A Teacher Quality; Title II, Part D Technology; Title II, Part A
 LEP; Title IV, (SDFSC); Title V, (Innovative Strategies); School Improvement
 K-8; EIA-LEP; 10th Grade Counseling; Miller-Unruh; TUPE; AB1113, AB658;
 Peer Assistance Review.



       The recommendation to approve the Final Categorical Budget and              Recommendation
 Schoolwide program for Alder Middle School was deleted from the agenda.           Deleted / Plans

 and carried, the Board approved the Final Categorical Budgets and Schoolwide
 Program Single Plans for Student Achievement for Canyon Crest, Citrus,
 Cypress, Date, Hemlock, Juniper, Live Oak, Locust, Mango, Maple, North
 Tamarind, Oak Park, Oleander, Palmetto, Poplar, Virginia Primrose, Randall-
 Pepper, Redwood, Shadow Hills, South Tamarind, Tokay, and West Randall
 Elementary Schools; Almeria, Fontana, Sequoia, Southridge and Harry S.
 Truman Middle Schools; Fontana, Henry J. Kaiser and Fontana A. B. Miller
 High Schools; Eric Birch and Citrus Continuation High Schools.



        On motion made by Mrs. Kathy Binks, seconded by Mr. Gus Hawthorn,          Awards Plans
 and carried, the Board approved plans and budgets for Awards funding as           and Budgets

          On motion made by Mr. Gus Hawthorn, seconded by Ms. Laura                Recommendation
 Abernathy Mancha, and carried, the Board approved amending the following          Amended
 recommendation to change the date for eligible employees to submit their intent
 to retire from March 14, 2003 to March 21, 2003.



        On motion made by Mr. Rick McClure, seconded by Mrs. Kathy Binks,          Supplemental
 and carried, the Board approved the offering of a Supplemental Employee           Employee
 Retirement Plan (SERP) for certificated non-management employees who have         Retirement
 completed 15 years of service and will be age 55 as of June 30, 2003. (Copy       Plan Approved

        On motion made by Mrs. Kathy Binks, seconded by Mr. Rick McClure,          Waiver
 and carried, the Board approved submission to the California Department of        Request
 Education of Form J-13A, Request for Allowance of Attendance because of           Approved
 Emergency Conditions, related to the closure of Mango Elementary School on
 January 21, 2003 due to a police investigation related to the death of a school
 employee on the campus.



         On motion made by Mr. Rick McClure, seconded by Mrs. Kathy Binks,         Contract
 and carried, the Board approved a contract with PacMed for review services to     Approved
 be used by the Workers’ Compensation Department for the 2002/03 school year
 in a total amount not to exceed $60,000.00.

       On motion made by Ms. Laura Abernathy Mancha, seconded by Mr. Gus           Architectural
Hawthorn, and carried, the Board approved an award for architectural services to   Services
HMC Architects for Elementary School #28, the withdrawal of said award to          Approved
LPA Architects, and award of the contract to provide architectural services for
placement of pre-approved Modtech buildings at the following sites to WLC

Elementary School, Redwood Elementary School; and authorized Emmanuel J.

       On motion made by Mrs. Kathy Binks, seconded by Mr. Rick McClure,            Bid Awarded
and carried, the Board awarded Bid No. 02/03-1068 - Hazardous Material
Abatement, to Total Environmental Industries, the lowest overall responsible
bidder, for a total estimated cost of $100,000.00 through June 30, 2003, and
authorized Betty Fraser, Director of Purchasing, to sign the necessary documents.

              and authorized Betty Fraser, Director of Purchasing, to sign the
              necessary documents.


        b.    One Custom Two-Story Modular Building Complex from
              Modetch, Inc., for Fontana Middle School, unilizing the Val Verde
              Unified School district Bid No. 99-01-A, at a total cost of
              $1,398,343.98, plus $43,348.66 tax on 40% only, for a grand total
              of $1,441,692.64, and authorized Betty Fraser, Director of
              Purchasing, to sign the necessary documents.

              High School, utilizing the Val Verde Unified School District Bid      Buildings

       Mr. D’Souza announced that the Ted J. Porter dedication ceremony would         Administrator
be held before the next Board meeting on February 19, 2003.                           Comments

        Dr. Ruble reminded the audience that people from the community were
invited to attend dedication and groundbreaking ceremonies.

      Ms. Mazzolini commented on the bulletin boards highlighting the Fast
ForWord program at Chaparral Elementary.



        Mrs. Binks extended congratulations to those teachers who were selected       Board
for recognition in the “American Teachers Who’s Who”; to the Henry J. Kaiser          Member
ROTC for the job well done on their recent military ball; to the Henry J. Kaiser      Comments
football team; and to Sara Najarro for her appointment as Principal of Mango
Elementary. She then commented that the recent $220,000.00 spending proposal
for death row inmates did not sit well with her, particularly in light of the
educational budget cuts. She asked for a call to action in opposition of this
proposal, and stated her opinion that one voice or vote does count.

        Mr. McClure expressed his concern about the proposal for schools
regarding the budget. Although he was encouraged about how the legislature was
willing to extend a portion of the cuts to the next year, the Governor was
threatening to veto that action. He stated that he was very proud of the district’s
accomplishments of the past few years; and how some of the best teachers were
being encouraged to retire because the district can’t afford them anymore. He
made a plea to legislators to keep cuts to a minimum and as far away from the
classroom as possible.



        Dr. Harshman commented that budget workshops were being conducted             Superintendent
with district administrators and school principals to decide how the district’s       Comments
necessary budget cuts would be made, and that recommendations from those
workshops would be taken to the Board sometime in the near future. She noted
that next year would be an uncertainty in terms of the amount of the budget and
cuts, and that the district was trying to be proactive.

       Dr. Harshman then announced that the next Board meeting of the Fontana
Educational Institute was scheduled for February 18, 2003 at 5:00 p.m.
