                        RELEASE AND INDEMNITY AGREEMENT
The undersigned, in consideration of the Pompano Beach Historical Society
providing us with space for the display and sale of our various products,
goods and other valuable wares, do hereby release the Pompano Beach
Historical Society, the City of Pompano Beach and any of their members,
employees, directors or volunteers from any liability for the loss or damage
of product, personal injury or property damage.

Further, I acknowledge full responsibility for all my activities at the
Pompano Beach Saturday Green Market and for those assisting me and I agree to
defend, hold harmless and indemnify the Pompano Beach Historical Society and
the City of Pompano Beach, for any damages, attorney’s fees or costs of any
legal action resulting from any claims in which they, their members,
employees, agents or volunteers are made parties defendant. This Release and
Indemnity Agreement applies for the duration of the Pompano Beach Saturday
Green Market as scheduled and to any claims made within the applicable Statue
of Limitations for a loss occurring during that time period.

I have been supplied with, read and understand the Pompano Beach Green Market
Rules & Regulations and agree to abide by those Rules & Regulations.
Furthermore, I understand that any violation of these rules, or acting in a
manner to cause hazards to the public, will cause immediate revocation of my
Pompano Beach Saturday Green Market permit. I agree to sell only those
products approved by the Pompano Beach Historical Society’s Saturday Green
Market management.

            LICENSING, PERMIT AND INSURANCE REQUIREMENTS

LICENSING REQUIREMENT:

1) Broward County Occupational License

2) If you are a horticultural, agricultural or farm producer selling products
grown by you, you are required to have a GROWERS PERMIT, which can be
obtained from the Agricultural Extension Office in the County where the crops
are grown.

PERMIT REQUIREMENT:

1) If you are in the business of manufacturing, processing, packing, holding,
preparing or selling food at wholesale or retail, you must obtain a FOOD
PERMIT from the State of Florida Department of Agriculture and provide the
Saturday Green Market management with a copy.

INSURANCE REQUIREMENTS:

Each vendor must provide an original certificate of Insurance naming the
Pompano Beach Historical Society and the City of Pompano Beach as additional
insured for the dates and location of the Pompano Beach Historical Society
Saturday Green Market, showing general liability insurance with a combined
single limit of $100,000.00 for bodily injury and property damage. (The
Pompano Beach Historical Society and the City of Pompano Beach do not carry
insurance policies to cover individual vendors).
If you are in the business of manufacturing, processing, packing, holding,
preparing or selling foods at wholesale or retail you must provide the
Pompano Beach Historical Society and the City of Pompano Beach a copy of your
PRODUCT LIABILITY INSURANCE naming the Pompano Beach Historical Society and
the City of Pompano Beach as additional insured.
        POMPANO BEACH SATURDAY GREEN MARKET

                                       RULES AND REGULATIONS

BOOTH SPACE:
   The Green Market will provide appropriate booth space based on site-plan considerations and reserves the
     right to assign, limit quantity of, or relocate space rented by a vendor.
   Assigned booth space must be occupied by opening time (8:00 AM), or said space may be made available
     to another vendor.
   Fees for booth space are non-refundable if vendor should chose to stop participating in the Saturday Green
     Market.
   Sharing or sub-letting of booth space is not permitted. Requests for exceptions require prior approval.

VENDOR EQUIPMENT & SUPPLIES:
    Pompano Beach Saturday Green Market will provide a standard booth space (minimum space is 10’ x 10’,
     unless otherwise specified)..
    Each vendor is responsible for equipment and supplies required to do business at the Green Market site,
     such as tents, tables, chairs, presentation/display materials, signs, scales, broom/dustpan, cash boxes, and
     promotional materials.
    Vendors are required to have available weights or other methods of securing tents against strong winds.
    Electricity can be made available by advanced request (the use of electricity may affect the location of a
     vendors booth space). The Pompano Beach Green Market reserves the right to add a surcharge for use of
     electricity.
    Scales used to weigh products must meet the standard of the Florida Dept. of Agriculture and Consumer
     Services.
    All vendor signage must remain within the limits of the individual selling space and not conflict with other
     vendor displays.

SET-UP, BREAKDOWN, CLEAN-UP :
    Vendors may begin set-up two hours prior to opening and must be completed by 8:00 AM.
    Breakdown is not permitted before 1:00 PM. (unless inclement weather prevails) and must be completed by
      2:00 PM
    Vendors are responsible for removing all items from their booth and leaving their area clean.

VEHICLES
    No vehicles are allowed on the Saturday Green Market street site during operating hours (access or
     parking).
    It is the vendor’s responsibility to find parking for their vehicles (there is plenty of free parking close-by
     the Green Market). The Green Market will not assign vendor parking spaces.

DISPLAY AND PRESENTATION
    Vendors are responsible for display and presentation of their products in an attractive and effective manner
    All items must be priced with signage clearly visible to customers
    Safety factors regarding equipment used in display (tables, etc.) are vendor’s responsibility.

SATURDAY GREEN MARKET CANCELLATION POLICY
    Should a particular week’s Green Market have to be canceled due to severe weather conditions, vendors
     will be notified of management’s decision to cancel or delay opening by 6:00 AM. Saturday morning.
    A telephone message advising vendors of the decision will be recorded and can be retrieved by calling
     (954) 782-3015.
VENDOR ATTENDANCE
    All vendors who have reserved space and are unable to attend on a given Saturday should advise the
     Saturday Green Market chairperson , Claudia DuBois (954) 913-3236 24 hours in advance of the
     Saturday Green Market.

PAYMENT SCHEDULE
    Discounted annual fees are applicable only if paid on or before opening day.
    Unless other arrangements are made, vendors choosing to pay on a weekly basis must make their payments
     each week at or prior to the Green Market.
    Those vendors whose payments are two weeks in arrears will not be allowed to set up at the Green Market
     the following week.

MISCELLANEOUS SATURDAY GREEN MARKET RULES
    Gambling is not allowed.
    The sale, use or possession of alcoholic beverages is not allowed.
    Vendors are responsible for collecting their own sales tax.

Additional rules and guidelines may be added, or modifications made to existing rules and guidelines, at the
discretion of the Green Market management. Although the Green Market management will strive to provide
vendors with adequate warning, additions, changes and modifications may be made without notice.



                                            PRODUCT ELIGIBILTY:
                         (All products are subject to Green Market management approval).

The following products may be sold at the Pompano Beach Saturday Green Market:

    PRODUCE
        Grade A quality produce only
        Organic produce
        Preference will be given to local, county and state growers.

    FRUITS
        All fresh fruits including fresh squeezed juices, Grade A only.
        Preference will be given to local, county and state growers.

    BAKED GOODS
        Breads
        Pastries, cookies, pies, etc.
        Bagels, muffins, scones

    FRESH SEAFOOD
        All types of fresh seafood, fish and shellfish

    MEAT & POULTRY
       Fresh, smoked and cured meat and poultry products
       Gourmet items, grain-fed, organic, deli and sausages.

    DAIRY PRODUCTS
        Local and imported cheeses, fresh eggs.
        Specialty butter, cheeses, yogurt and ice cream.

GOURMET – SPECIALTY PREPARED FOODS
    Fresh pasta and sauces, pate, soups and salads and stocks.
    Ethnic specialty foods.

SPECIALTY PROCESSED FOODS
    Jams, jellies, relishes, sauces, mustards, salad dressing, salsa, etc.
    Infused vinegars and oils, olives, pickles.

GRAINS & NUTS
    Rice, beans, grains, dried and roasted nuts.

SPECIALTY BEVERAGES
    Coffee (regular, as well as cappuccinos, lattes, etc.), smoothies and teas.

RESTAURANT/FOOD PREPARED VENDOR
    All processed foods must be prepared in a licensed kitchen and be covered under Vendor’s Product
      Liability Insurance.
    A limited number of spaces will be made available for high quality food vendors and restaurants to
      provide Green Market shoppers with fresh breakfast, lunch, and snack items
    Canned and bottled beverages will be sold exclusively by the Pompano Beach Historical Society.
      Vendors are not permitted to sell canned or bottled soft drinks or waters. If you have a beverage to
      sell, please contact the Green Market management.

PLANTS, FLOWERS & TREES
    All types of fresh and potted plants
    Fresh herbs
    Palm, fruit and native Florida trees
    Fresh-cut flowers, showing no deterioration or age.

CONFECTIONARY
    Dried fruits
    Candies

ARTS & CRAFTS
    The Pompano Beach Saturday Green Market wishes to keep the Green Market “Green” and to
      concentrate primarily on fresh fruits and vegetables, plants and flowers. As a result, the only crafts
      allowed for consideration are items which compliment food products and that are made from natural
      products.
    The Green Market will consider original art, including jewelry, photography, hand made items and
      candles, if sold by the artist and/or owner. Eligibility will be based on space available, quality and
      subject matter, at the sole discretion of the Green Market management.
    From time to time the Green Market will have special themed events at which art and crafts that are
      appropriate to that theme may be allowed.
    Potential vendors are encouraged to discuss with the Green Market management items that may fall
      into this category for a determination of eligibility.

NOT ACCEPTABLE
    All items not listed above should be considered not acceptable, especially commercially mass-
      produced products. If you are in doubt about your product, please contact the Green Market
      management for a determination of eligibility.
