     REGULAR MEETING OF OCTOBER 11, 2006

     The Regular Meeting of the Council of the Rural Municipality of Rockwood was held October
     11, 2006 in the Council Chambers in Stonewall, Manitoba. All Councillors present with Reeve
     Thievin in the Chair.

1.   ACCEPTANCE OF THE AGENDA:

             THIEVIN – PERSOAGE - BE IT RESOLVED THAT the Council of the Rural
     Municipality of Rockwood approve the Agenda of the October 11, 2006 Regular Meeting of the
     Council of the Rural Municipality of Rockwood.

                                                            RESOLUTION # 253/06 – CARRIED.

            CAMPBELL – POPOFF - BE IT RESOLVED THAT the Council of the Rural
     Municipality of Rockwood approve the Added Agenda of the October 11, 2006 Regular
     Meeting of the Council of the Rural Municipality of Rockwood.

                                                            RESOLUTION #254/06 – CARRIED.

2.   ADOPTING THE MINUTES:

             DYKSTRA – CAMPBELL - BE IT RESOLVED THAT the Minutes of the Regular
     Meeting of September 13, 2006 of the Council of the Rural Municipality of Rockwood are
     hereby adopted.

            KRATZER – PERSOAGE – BE IT RESOLVED THAT the Minutes of the Special
     Meeting of September 27, 2006 of the Council of the Rural Municipality of Rockwood are
     hereby adopted.

3.   REPORTS OF THE COMMITTEES:

     LEGISLATIVE & FINANCE – Councillor Dykstra

     -    Reported on the Finance meeting of October 10, 2006
     -    C.P. Rail line – Council would like to send a letter expressing an interest in purchasing the
          abandoned line

     a)      Finance Report:

           DYKSTRA – POPOFF - Accounts Payable on Finance Report 10/06, being Manual
     Cheques M118-M127 and Computer Cheques 1455-1620 including Direct Deposits, for the
     amount of $279,475.27 be approved for payment.

                      POPOFF – DYKSTRA – BE IT RESOLVED THAT WHEREAS the
              Stonewall RCMP Detachment is desirous of purchasing a portable laser detection devise
              to apprehend drivers who exceed the speed limit throughout the detachment area;

              AND WHEREAS the Stonewall RCMP Detachment is requesting, in its letter dated
              September 25, 2006, that the Rural Municipality of Rockwood contribute financial
              assistance in the amount of $392.12 towards the cost of the portable laser detection
              devise, being $4,606.00 plus GST;

              NOW THEREFORE BE IT RESOLVED THAT the Council of the Rural Municipality
              of Rockwood authorize a contribution of $392.12 towards the purchase of the portable
              laser detection by the Stonewall RCMP Detachment.

         Dowsett, Developers, requested in their letter of October 5, 2006, a Final Acceptance Certificate
         for Phase I of their development under Agreement #23/05, executed August 25, 2006;

         AND WHEREAS an on-site inspection of Phase I was made October 10, 2006 by the
         Transportation Department for the Rural Municipality of Rockwood;

         AND WHEREAS the Transportation Department advised that the Phase I of the development
         has met the terms and conditions of Agreement #23/05, executed August 25, 2006;

         NOW THEREFORE BE IT RESOLVED THAT the Council of the Rural Municipality of
         Rockwood authorize the issuance of a Final Acceptance Certificate for Phase I of the
         development under Agreement #23/05.

                District, inspected the older building (garage) and submitted a letter, dated October 10,

                NOW THEREFORE BE IT RESOLVED THAT the Council of the Rural Municipality
                of Rockwood grant Ronald F. Beheyt & Debbie L. Maluga-Beheyt, Registered Owners
                & Applicants, permission to locate an older building (garage) onto Lot 8, Plan 18612 in
                Pt. SE ¼ 28-13-2E, 76046 PTH 7, Roll #103490, CT #103490, subject to the following
                conditions:

1.       That a Performance Agreement be entered into by Ronald F. Beheyt & Debbie L. Maluga-
         Beheyt, Registered Owners & Applicants, (hereinafter referred to as the Developers) evidencing
         their “Letter of Intent”, dated September 21, 2006, and David Klausen’s, Building Inspector for
         the South Interlake Planning District, letter dated October 10, 2006; AND THAT the
         Developers must provide the Municipality with a Letter of Credit, or any other form of security
         approved by the Municipality, in the amount of $3,500.00, for the purpose of insuring that the
         Developers comply with all terms and provisions of the Performance Agreement;

2.       That the said Performance Agreement be registered as a Caveat against the Subject Property
         evidencing this Agreement; and

3.       That all legal costs incurred by the Municipality regarding the Performance Agreement and the
         Caveat shall be the responsibility of Ronald F. Beheyt & Debbie L. Maluga-Beheyt, Registered

              4622, (Michaluk), of the NE ¼ 32-17-2E, Roll #378300, subject to the following
              conditions:

              1.     That the Applicant/Owner provide a land description prepared by a Manitoba
                     Land Surveyor and pre-approved by LTO Survey Department;

              2.     That the Applicant/Owner submit confirmation in writing from the Chief
                     Administrative Officer of the Rural Municipality of Rockwood that taxes on the
                     land to be subdivided for the current year plus any arrears have been paid or
                     arrangements satisfactory to Council have been made;

              3.     That the Applicant/Owner obtain a Variance Order to vary the site area of the
                     balance of title;

                (Vandekerckhove), of Lots 19/22, Block 1, Plan 1208 in Pt. NE ¼ 11-13-2E, Roll
                #45300, subject to the following conditions:

                1.     That the Applicant/Owner provide a 2 Lot Plan prepared by a Manitoba Land
                       Surveyor: Lot 1 = Lots 19, 20 & Pt. Lot 21; Lot 2 = Balance of Lot 21 and Lot
                       22;
