APPLICATION.

Vendors must provide a CERTIFICATE OF LIABILITY INSURANCE naming Kiwanis Club of
Gulf Beaches and the City Of Treasure Island as additionally insured.

I AM APPLYING FOR THE APPROPRIATELY CHECKED BOOTH FOR THE 2009 MARDI
GRAS WEEKEND. ENCLOSED IS MY CHECK FOR THE PROPER AMOUNT.

 I WOULD LIKE TO OPERATE A FREE STANDING BOOTH ON FESTIVAL GROUNDS.

DEADLINE FOR ALL APPLICATIONS IS JANUARY 21ST, 2009

     Late Applications Postmarked by February 4th: ADD $50 LATE FEE
     Late Applications Postmarked AFTER February 4th: ADD $100.00 LATE FEE

These charges are required for all vending outside any private or city property within the festival
ground of Treasure Island Beach during the hours granted to the 2009 Mardi Gras Weekend by the
City Of Treasure Island.

                           2009 MARDI GRAS WEEKEND
                             RESTAURANT AGREEMENT
                              TERMS AND CONDITIONS

 . All food must be under a tent.
* Festival will provide tent as needed, for an additional charge.
. Festival will be unable to provide power.
. Generators will be permitted.
* Potable Water supply is not available.
. Vendors will provide their own tables, Chairs, etc.
. Overnight security provided, however vendors are responsible for their own property.
. Cooperation with local authorities is mandatory.
. No glass containers will be allowed. (Paper vs. plastic where applicable)
. Only one vendor per tent is allowed.
. Vendors must be ready at least ½ hour prior to Festival opening each day.
. Supplies can be brought in each day.
         a. Saturday 2/21 6:00 AM – 9:45 AM
         b. Sunday      2/22 8:00 AM – 9:45 AM
. Supplies can not be brought in during Festival hours!
. Vendors must remain for the entire two-day event.
. Equipment, decorations, etc. may not be removed until after 8:00PM on Sunday, 2/22.
. Vendors are responsible for collecting and reporting their own SALES TAX.
. Vendors must provide a CERTIFICATE OF LIABILITY INSURANCE naming Kiwanis Club of
Gulf Beaches and the City Of Treasure Island as additionally insured.
. All fees must be paid in full prior to the event.
. There will be no refunds due to no show, bad weather, cancellation, etc.
. One on site parking spot will be available for each restaurant.
. Any changes to submitted menu must be approved by the restaurant coordinator.

ALL THE ABOVE TERMS & CONDITIONS WILL BE STRICTLY ENFORCED.

                         Release and Hold Harmless Agreement

The undersigned, being over the age of eighteen (18) years, does hereby request Kiwanis Club
of Gulf Beaches., for permission to participate in the 2009 Mardi Gras Weekend. I
understand the benefit of this program / event and I agree to obey all instructions, orders,
commands given me by the officials in charge of the program/event. I acknowledge the risks
of participation in this program/event and I may be subject to physical injury or property
damage, whether caused by an intentional or unintentional act or omission. In full
consideration and acknowledgement of the risks of participation in this program/event, I
freely and voluntarily agree to participate in this program/event and accept the risks of so
doing.

In consideration of being allowed to participate in this voluntary program / event and
receiving the benefit thereof, I, myself, my heirs, personal representative, next of kin or
assigns, do hereby forever release, waive, discharge, hold harmless and covenant not to
sue the Kiwanis Club of Gulf Beaches, its officials, officers, agents, employees,
representative, assigns, and insurers, individually and collectively, hereinafter referred to as
"releasees", of and from all liability for any and all loss or damage, including personal injury,
property damage or death, whether caused by the negligence of the releasees or otherwise,
while I am in any way participating in the above described program/event.

I further acknowledge that I have read and fully understand this release and hold harmless
agreement, and that I have voluntarily executed the same without any further inducement or
promise not contained herein. I expressly agree that this agreement shall be construed as
broadly as permitted by the law of the State of Florida, and that if any part hereof is declared
invalid, the remainder shall remain in full force and effect.
