									       KNOX COUNTY INTERGOVERNMENTAL COMMITTEE


       The Knox County Intergovernmental Committee met in Regular
Session on Tuesday, February 17, 2009 at 10:00 a.m. in the Main Assembly
Room of the City-County Building, Main Avenue. Those members present
were Commissioners Norman, McKenzie, Saunders, Lambert, Armstrong,
Broyles, Leuthold, Carringer and Brown. Also present were Mr. Bill
Lockett, Knox County Law Director, Mr. Joe Jarret, Knox County Chief
Deputy Law Director, Mr. Richard Walls, Knox County Internal Auditor,
Mr. Bruce Wuethrich, Director, Engineering and Public Works, Ms. Ann
Acuff, Knox County Accounting/Budget Director and news media.
       Commissioner Norman, Vice-Chairman, presided.
       The following proceedings were had and entered of record to-wit:

       Mrs. Angie Nesbitt, Minutes Clerk to the Knox County Clerk called
the roll.

IN RE:        AMENDMENTS TO THE AGENDA:
       Without objection, Commissioner Norman amended the agenda as
follows:
       Add to the agenda R-09-2-804 – Consideration of a Resolution of the
Commission of Knox County, Tennessee approving a contract not to exceed
$229,442.00 with Trane U.S. Inc. for an investment Grade Energy Audit.

       Defer to the March Intergovernmental Committee R-09-2-603 -
Consideration of a Resolution of the Commission of Knox County,
Tennessee approving the Indigent Primary Care Services Agreement in the
amount of $1,650,000.00 between Knox County, Tennessee and Cherokee
Health Systems for the provision of Indigent Primary Care Services for adult
enrollees in the Knox County Indigent Care Program.

       Defer to the March Intergovernmental Committee O-09-1-101 –
Consideration of an Ordinance of the Commission of Knox County,
Tennessee approving amendments to the Knox County Beer Laws on second
reading.

        Defer to the March Intergovernmental Committee R-09-2-501 –
Consideration of a Resolution of the Commission of Knox County,
Tennessee approving an agreement with the Helen Ross McNabb Center,
Inc., to provide $200,000 for the construction of sixteen (16) one-bedroom
efficiency apartments for the chronically homeless.

IN RE:        RE-ORGANIZATION OF THE INTERGOVERNMENTAL
COMMITTEE:
        Re-Organization of the Intergovernmental Committee was before the
Intergovernmental Committee.
        Commissioner Leuthold nominated Commissioner Tony Norman for
Chairman of the Intergovernmental Committee. Commissioner Saunders
seconded the motion and upon voice vote the motion carried 9-0-0-0.
        Commissioner Tony Norman was appointed Chairman of the
Intergovernmental Committee.

        Commissioner Leuthold nominated Commissioner Sam McKenzie for
Vice-Chairman of the Intergovernmental Committee. Commissioner
Lambert seconded the motion.
        Commissioner Saunders nominated Commissioner Amy Broyles for
Vice-Chair of the Intergovernmental Committee and upon roll call vote
Commissioner McKenzie passed, Commissioner Broyles voted for
Commissioner McKenzie, Commissioner Norman voted for Commissioner
McKenzie, Commissioner Saunders voted for Commissioner Broyles,
Commissioner Leuthold voted for Commissioner McKenzie, Commissioner
Lambert voted for Commissioner McKenzie, Commissioner Carringer voted
for Commissioner Broyles, Commissioner Armstrong voted for
Commissioner McKenzie, Commissioner Brown voted for Commissioner
McKenzie.
        Commissioner McKenzie received 6 votes.
        Commissioner Broyles received 2 votes.
        Commissioner McKenzie passed.
        Commissioner Sam McKenzie was appointed Vice-Chairman of the
Intergovernmental Committee.

        Commissioner Norman moved to nominate Commissioner Amy
Broyles as Secretary of the Intergovernmental Committee. Commissioner
Saunders seconded the motion and upon voice vote the motion carried
9-0-0-0.
       Commissioner Amy Broyles was appointed Secretary of the
Intergovernmental Committee.

IN RE:       CONSIDERATION OF APPROVAL OF MINUTES OF
THE PREVIOUS MEETING:
       Consideration of approval of minutes of the previous meeting was
before the Intergovernmental Committee.
       Commissioner McKenzie moved to approve the minutes of the
previous meeting on January 20, 2009. Commissioner Saunders seconded
the motion and upon voice vote the motion carried 9-0-0-0.

       Consideration of a Resolution of the Commission of Knox County,
Tennessee honoring Kelly Tipton for winning the News Sentinel Knox
County Spelling Bee Championship was before the Intergovernmental
Committee.
       Commissioner Brown moved to recommend approval to the full

AND HONORING THE 20TH ANNUAL BLACK CHURCH WEEK OF

       Consideration of a Resolution of the Commission of Knox County,
Tennessee recognizing and honoring the 20th Annual Black Church Week of
Prayer for the Healing of AIDS was before the Intergovernmental
Committee.

MEMORANDUM OF AGREEMENT BETWEEN KNOX COUNTY AND
THE BUREAU OF ALCOHOL, TOBACCO, FIREARMS, AND
EXPLOSIVES (ATF) FOR THE PURPOSE OF REIMBURSEMENT OF
OVERTIME SALARY COSTS IN PROVIDING RESOURCES TO
ASSIST ATF: R-09-2-301:
      Consideration of a Resolution of the Commission of Knox County,
Tennessee approving a Memorandum of Agreement between Knox County
and the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) for
the purpose of reimbursement of overtime salary costs in providing

      Commissioner Brown moved to recommend approval to the full

COUNTY AND THE UNITED STATES MARSHALS SERVICE (USMS)
FOR THE PURPOSE OF REIMBURSEMENT OF OVERTIME
SALARY COSTS: R-09-2-302:
      Consideration of a Resolution of the Commission of Knox County,
Tennessee approving a Memorandum of Understanding (MOU) between
Knox County and the United States Marshals Service (USMS) for the
purpose of reimbursement of overtime salary costs was before the
Intergovernmental Committee.
      Commissioner Brown moved to recommend approval to the full

of Knox County, Tennessee approving a Memorandum of Understanding
(MOU) between Knox County and the United States Marshals Service
(USMS) for the purpose of reimbursement of overtime salary costs.
Commissioner McKenzie seconded the motion and upon voice vote the

of $5,250,000.00 for Fiscal Year 2009-2010 was before the

      Commissioner Brown moved to recommend approval to the full
Commission R-09-2-602 - Consideration of a Resolution of the Commission
of Knox County, Tennessee approving the Knox County Indigent Care
Program in the amount of $5,250,000.00 for Fiscal Year 2009-2010.

SERVICES THROUGH THE TENNESSEE REFUGEE MEDICAL

       Consideration of a Resolution of the Commission of Knox County,
Tennessee renewing the Medical Screening Services Agreement between
Siloam Health Services, LLC and Knox County Health Department for the
provision of medical screening services through the Tennessee Refugee
Medical Assistance Program was before the Intergovernmental Committee.
       Commissioner Brown moved to recommend approval to the full
Commission R-09-2-604 - Consideration of a Resolution of the Commission
of Knox County, Tennessee renewing the Medical Screening Services

Tennessee approving the Unclaimed property balance of accounts remitted
to the State Treasurer under the Unclaimed Property Act was before the
Intergovernmental Committee.
       Commissioner Brown moved to recommend approval to the full

of Knox County, Tennessee approving the Unclaimed property balance of
accounts remitted to the State Treasurer under the Unclaimed Property Act.

Tennessee adopting the State Open Records Commission’s Public Records
Fee Schedule was before the Intergovernmental Committee.
       Commissioner Brown moved to recommend approval to the full

of Knox County, Tennessee adopting the State Open Records Commission’s
Public Records Fee Schedule. Commissioner McKenzie seconded the

COMMISSION OF KNOX COUNTY, TENNESSEE CONVEYING THE
SURPLUS PROPERTY ON THE EASTPORT ELEMENTARY SCHOOL
SITE (LOT 2 ON ATTACHED SURVEY) TO THE HOUSING
AUTHORITY FOR THE DEVELOPMENT OF ELDERLY HOUSING,
AS PHASE 1 OF A STRATEGIC INVESTMENT PLAN IN THE FIVE
POINTS COMMUNITY: R-09-2-901:
       Consideration of a Resolution of the Commission of Knox County,
Tennessee conveying the surplus property on the Eastport Elementary
School site (lot 2 on attached survey) to the Housing Authority for the
development of elderly housing, as Phase 1 of a Strategic Investment Plan in
the Five Points Community was before the Intergovernmental Committee.
       Commissioner Brown moved to recommend approval to the full
Commission R-09-2-901 - Consideration of a Resolution of the Commission
of Knox County, Tennessee conveying the surplus property on the Eastport
Elementary School site (lot 2 on attached survey) to the Housing Authority
for the development of elderly housing, as Phase 1 of a Strategic Investment

DISTRIBUTION OF ECONOMIC STIMULUS MONIES IN FULL OR
IN PART DIRECTLY TO LOCAL GOVERNMENTS: R-09-2-905:
       Consideration of a Resolution of the Commission of Knox County,
Tennessee encouraging Senator Lamar Alexander, Senator Bob Corker and
Representative John Duncan, Jr. to support the distribution of economic
stimulus monies in full or in part directly to local governments was before
the Intergovernmental Committee.
       Commissioner Brown moved to recommend approval to the full
Commission R-09-2-905 - Consideration of a Resolution of the Commission
of Knox County, Tennessee encouraging Senator Lamar Alexander, Senator
Bob Corker and Representative John Duncan, Jr. to support the distribution
of economic stimulus monies in full or in part directly to local governments.
Commissioner McKenzie seconded the motion and upon voice vote the
