LEGAL NOTICE If you purchased a credit score or credit monitoring from ConsumerInfo.com or any Experian Entity, you could get a benefit from a class-action settlement. To see if you are a Class Member and to obtain full notice of the Settlement, the required procedures, the Effective Date, the deadlines, your obligations, and your options, you must visit www.browningsettlement.com. This Notice is only a brief summary. A settlement has been given preliminary approval in a class-action lawsuit about credit monitoring and credit scores. If you qualify, you may complete a Registration Form to receive a benefit, or you can exclude yourself from the settlement, or object to it. The United States District Court for the Northern District of California authorized this notice. Before any benefits are issued, the Court will have a hearing to decide whether to finally approve the settlement. benefit but prior to the expiration of the 60-day, settlement-benefit period, you will be billed at the then-applicable rate, which is currently $9.95, for each month that you continue your membership. The Defendants have also agreed not to make certain statements on particular websites. HOW DO YOU GET THE BENEFIT? If you are a Class Member, a detailed notice available online contains everything you need to obtain your settlement benefit once the settlement takes effect. Just complete the Online Registration Form at www.browningsettlement.com, or mail the Registration By Mail Form to the Browning Settlement Administrator, P.O. Box 91141, Seattle, WA 98111-9241, as instructed in the detailed online notice, no later than 60 days after the effective date of the settlement. The notice specifically describes the required procedures, the effective date of the settlement, the deadlines, your obligations, and your options. WHO’S INCLUDED? You may be a Class Member and could get a benefit if you entered into an agreement over the Internet with ConsumerInfo or any Experian Entity to purchase any Credit Check or Credit Check Monitoring (which were formerly known as CreditCheck® Monitoring Service), Credit Manager (including Yahoo! Credit Manager), Triple Alert, or Triple Advantage credit-monitoring product, or you paid for a credit score sold on a website that also sold one of those credit-monitoring products, between June 17, 1998 and December 27, 2006, and you did not later receive a complete refund. Full information on who qualifies as a Class Member can be found at www.browningsettlement.com, or 1-800-399-4322. WHAT ARE YOUR OTHER OPTIONS? If you don’t want to be legally bound by the settlement, you must exclude yourself by May 15, 2007, or you won’t be able to sue, or continue to sue, about the claims released in this case. If you exclude yourself, you can’t receive a benefit from this settlement. If you stay in the settlement, you may object to it by May 15, 2007. The detailed online notice explains how to exclude yourself or object. The Court will hold a hearing in this case (Browning v. Yahoo! Inc., ConsumerInfo.com, and Experian North America, Inc., No. C04-01463 HRL) on July 31, 2007, to consider whether to finally approve the settlement and a request by the lawyers representing all Class Members for no more than $2,550,000 in attorney’s fees and costs. The lawsuit was filed claiming that Defendants violated a federal statute known as the Credit Repair Organizations Act, and also making claims for unjust enrichment, constructive trust, and conspiracy. The Defendants deny that they did anything wrong. The Court did not decide which side was right, but both sides agreed to the settlement. WHAT DOES THE SETTLEMENT PROVIDE? ConsumerInfo has agreed to provide all Class Members with the opportunity to obtain their choice of either a credit score or 60 days of credit monitoring.
