CHANNEL SEVEN “CHRISTMAS LIGHTS” PROMOTION TERMS AND CONDITIONS By entering the “Christmas Lights” competition, you are agreeing to the following terms and conditions: 1. STANDARD TERMS 1.1 Information on how to enter this game of skill promotion forms part of the terms of entry. 2. WHO CAN ENTER? 2.1 Subject to clause 2.2, entry is open to all residents of the Perth metropolitan region where the Channel Seven signal is received. 2.2 Employees and their immediate families of Seven Network (Operations) Limited, West Australian Newspapers Ltd, Consolidated Broadcasting Systems (WA) Pty Ltd , Synergy and Ontel Communications Pty Ltd, and their associated agencies and companies are not eligible to enter. Christmas light displays that feature corporate advertising material or messages will not be eligible to enter. 3. HOW TO ENTER 3.1 Tier 1: The “Best Christmas Lights” competition commences at 9am (Perth time) on Monday 24 November 2008 and concludes at 9am (Perth time) on Wednesday 24 December 2008. In order to enter Tier 1 of the competition, people must complete the coupon published in The West Australian on Monday 24 November, Wednesday 26 November, Friday 28 November, Monday 1 December, Wednesday 3 December, Friday 5 December, Monday 8 December or Wednesday 10 December 2008 and post the completed coupon, together with a photograph, DVD or VHS video of their decorated home, to Best Christmas Lights Competition, Channel Seven Perth, PO Box 1, Tuart Hill WA 6939 by 5pm (Perth time) on Monday 15 December 2008. Tier 1 entries will be judged on visual impact, creativity and Christmas spirit. Entrants in Tier 1 may only enter once. Three Tier 1 entrants will be chosen as finalists. Safety Warnings: • Entries must be contained within the entrant’s private property and not encroach onto public land nor onto neighbour’s property. The Promoters request that entrants be mindful of neighbours and their quiet enjoyment of the street, and that they comply with all relevant laws in the creation and display of their entry, as well as with any reasonable direction given by the promoters, local council or police with respect to the display of their entry. • The misuse of electricity can cause injury or death. Entrants must not use any indoor lighting products outside and must comply with the safety instructions of all electrical products used. Electrical safety is paramount and must be exercised at all times. NB: misuse of electricity could lead to your disqualification from the competition. Inspections by qualified electricians to check the safety of the entrants display are encouraged. • Entrants must plan to ensure road safety of their display. For safety and security reasons the Promoters recommend that Christmas Lights displays are designed to be removed and secured overnight. The security of all aspects of the displays is the sole responsibility of the entrant. • Ultimately, you as the home owner or resident are responsible for your display. We would recommend that people not be invited on to your property as that would considerably increase any potential risk you may have. The Promoters accept no responsibility for any actions or incidents relating to or occurring during the Christmas Lights promotion at or near the property of any individual entrant. It is advised that you ensure that your home insurance policy protects you in relation to anything you propose doing as part of your participation in the Christmas Lights. 3.2 Tier 2: Tier 2 of the competition (the “Nightly” competition) commences at 6.00pm (Perth time) on Monday 8 December 2008 and concludes at 5.00pm (Perth time) on Friday 19 December 2008. In order to enter, viewers must watch SEVEN NEWS on Channel Seven Perth each week night from Monday 8 December 2008 to Thursday 18 December 2008, when footage of a house entered in the “Christmas Lights” competition will be featured during “Jeff’s Weather Segment” in SEVEN NEWS. Viewers will be invited to ring 1902 559 717, register the answer to the question: “In which Perth suburb was tonight’s Christmas house?” along with their name, address and daytime telephone number. Each entry will be charged at 55 cents (including GST), though call costs may be higher from mobile phones. Entrants in Tier 2 may enter as many times as they like, however may only win once. Entries for each night’s question will close at 5pm (Perth time) the following day, except for Friday 19 December 2008 which will close at 5pm (Perth time) on Monday 29 December 2008. 3.3 Tier 3: The “People’s Choice” competition commences at 6.00pm (Perth time) on Friday 19 December 2008 and concludes at 9am (Perth time) on Wednesday 24 December 2008. The three Tier 1 finalists will be featured in a competition spot to be aired between Friday 19 December and 9am Wednesday 24 December 2008 and published in “The West Australian” on Saturday 20 December 2008. Viewers will be asked to phone 1902 557 772 to vote for House 1, 1902 557 774 to vote for House 2 or 1902 557 775 to vote for House 3 and register their name, address and daytime phone number. Entrants in Tier 3 may enter as many times as they like. Tier 3 entries must be received by 9am (Perth time) on Wednesday 24 December 2008. 4. PRIZES 4.1 Tier 1: The winner will receive a cheque for $10,000 and the two runners up will each receive a cheque for $2,500. 4.2 Tier 2: There will be nine nightly winners, each winning $1,000. 4.3 Tier 3: The winner will receive a cheque for $1,000. 4.4 The maximum prize value is $25,000. 4.5 The winners are responsible for all other expenses including all costs associated with decorating homes, including but not limited to cost of decorations, installation, removal, repairs, cleaning, running costs or damage caused by their erection. 4.6 In participating in the competition, entrants agree to participate and co- operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed and having their house filmed and photographed. The winner agrees to grant the Promoters a perpetual and exclusive licence to use such footage and photographs, as well as their actual entries (whether on VHS, DVD or photograph) in all media worldwide and the winner will not be entitled to any fee for such use. The winners agree they will not, and will ensure that their companions do not, sell or otherwise provide their story and/or photographs to any media or other organisation. 4.7 Prizes cannot be transferred. Winners should seek independent financial advice about any tax implications that may arise from the prize winnings. 4.8 Full details of prizes can be obtained by telephoning Channel Seven Perth on 9344 0777. 5. HOW TO WIN 5.1 Tier 1: From the photographs, DVD’s and VHS entries received, a selection of houses will be chosen by a panel of judges selected by the promoter on Tuesday 16 December 2008, based on visual impact, creativity and Christmas spirit. That culled selection will then be filmed. Edited footage of each of these houses will be shown to another panel of judges, comprising of children aged between 6 and 16 years. (Children will be selected by the promoters.) The children’s preliminary judging stage will take place at Channel Seven Perth from 10.00am (Perth time) on Thursday 18 December 2008. The children’s three most popular choices will then become the finalists of the competition and will be featured in a competition spot to be aired on Channel Seven Perth between Friday 19 December 2008 and 9am Wednesday 24 December 2008 and published in The West Australian on Saturday 20 December 2008. The competition spot will ask people to vote for their favourite house and the winner of the competition will be the house that receives the most votes (see rules for Tier 3). The winner and runners up will be notified by a phone call on the day of the draw and by letter. The winner’s name will also be announced during SEVEN NEWS on Wednesday 24 December 2008. 5.2 Tier 2: Each weekday from Tuesday 9 December to Friday 19 December 2008, one name will be drawn at random from all correct entries received. The draw will take place at Channel Seven Perth, off Dianella Drive, Dianella at 5.05pm. The name of the person drawn will be announced during SEVEN NEWS and the winner will be notified of their win the following weekday by phone. 5.3 Tier 3: A name will be drawn at random from all entries who voted for the winner of “Tier 1”. The draw will take place at Channel Seven Perth on Wednesday 24 December 2008 at 9.05am (Perth time). The winner’s name will be announced on Channel Seven that night and once the announcement has been made the person will have 30 minutes to call the station on 9344 0777 to claim their prize. If the person fails to call the station within the 30 minutes timeframe, there will be a redraw and the initial winner forfeits their prize and will have no claim. The redraw will take place on Monday 29 December 2008 at 9am (Perth time). 5.4 The promoter’s decision is final and the promoter will not enter into correspondence regarding the result. 6. NO LIABILITY 6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions. 6.2 Seven Network (Operations) Limited & affiliates, West Australian Newspapers Ltd, Consolidated Broadcasting Systems (WA) Pty Ltd , Synergy, Ontel Communications and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail. 6.3 Seven Network (Operations) Limited & affiliates, West Australian Newspapers Ltd, Consolidated Broadcasting Systems (WA) Pty Ltd , Synergy, Ontel Communications and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss or claim that may occur: a) during the creation of a Tier 1 entry; b) as a result of the creation and/or display of the Tier 1 entry itself; c) during the draw and/or judging and/or filming; d) whilst undertaking any travel won on or connected with their entry into the draw; or e) in the participation in any prize; f) as a consequence of late, lost or misdirected mail; g) as a consequence of telephone malfunction; h) due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person. 7.
