					                        CITY COUNCIL REGULAR MEETING                           09-228
                                APRIL 21, 2009

       The City Council of the City of McKinney, Texas, met in regular session in

the Council Chamber of the Municipal Building on April 21, 2009 at 5:30 p.m.

       Council members present: Mayor Pro-Tem Bill Cox; Council members:

Gilda Garza; Geralyn Kever; Travis Ussery, Ray Ricchi; and Pete Huff. Absent:

Mayor Bill Whitfield.

       Staff present were: City Manager Frank Ragan; Deputy City Manager

Rick Chaffin; City Secretary Sandy Hart; Deputy City Secretary Lincoln

Thompson; Deputy Director of Development Services Brian James; Director of

Engineering Jack Carr; Executive Director of Finance/Administrative Services

Jennifer Fung; Parks, Recreation, and Open Space Director Lemuel Randolph;

Executive Director of Development Services John Kessel; Communications and

Media Manager Anna Folmnsbee; Communications and Marketing Director

CoCo Good; Deputy Director of Finance/Administrative Services Cindy Smith;

and Sergeant David Rodriguez.

       There were 6 guests present.

       Mayor Pro-Tem Cox called the meeting to order at 5:30 p.m. after

determining a quorum was present.        Invocation was given by Pastor Lee

Edwards, McKinney First Baptist Church. Mayor Pro-Tem Cox led the Pledge of

Allegiance.

       Mayor Pro-Tem Cox called for Citizen Comments:

       Ms. Marta Gore, 1821 Savannah Drive, McKinney thanked the City

Council for their quick action at the last Council meeting regarding the issue

relating to children’s safety along Berkshire Road. Ms. Gore requested that at

next month’s meeting that the Council consider that the permanent dynamic

signs between Cypress Crossing and Ridge Road be used as a school zone

dynamic speed sign.

       Council unanimously approved the motion by Council member Huff,

seconded by Council member Ricchi, to approve the following items:

09-218   Consider/Discuss/Act on a Resolution Establishing the School Zone

         Summer Hours for Each School Holding Summer School for 2009.

         380 from the University Pump Station to Approximately 800 Feet East

         OF PROPERTY RIGHTS NECESSARY FOR THE
         CONSTRUCTION OF THE HWY 380 WATER MAIN PHASE
         I LOCATED BETWEEN THE UNIVERSITY PUMP STATION
         AND APPROXIMATELY 800 FEET EAST OF HARDIN
         BOULEVARD; APPOINTING AN APPRAISER AND
         NEGOTIATOR AS NECESSARY; AUTHORIZING THE CITY
         MANAGER OF THE CITY OF McKINNEY, TEXAS, TO
         ESTABLISH   JUST   COMPENSATION      FOR    THE
         PROPERTY RIGHTS TO BE ACQUIRED; AND
         AUTHORIZING THE CITY MANAGER TO TAKE ALL

09-220   Consider/Discuss/Act on a Resolution to Adopt the Revised Investment

         Policy. Caption reads as follows:

09-221   Consider/Discuss/Act on a Resolution to award the bank depository

         contract to American National Bank, for the period beginning July 1,

         2009 and ending June 30, 2012. Caption reads as follows:

         A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

 09-222 Consider/Discuss/Act on a Resolution Authorizing the City Manager to

         Execute a Contract with LanArc Design, Inc. of McKinney, Texas for

         Design and Engineering Services for the Rowlett Creek Park

         Improvements. Caption reads as follows:

09-224    Consider/Discuss/Act on a Facilities Agreement to Reduce Parkland

          Fees for the McCutcheon Tract and to Give Credit for a Hike and Bike

          Trail

09-223    Mayor Pro-tem Cox called for Consideration/Discussion/Action on a

          Resolution for the Purchase of 2.08-acres of the Spain Tract. Parks,

          Recreation, and Open Space Director Lemuel Randolph stated that the

          relationship with the Trust for Public Land will be ending soon. Council

          unanimously approved the motion by Council member Huff, seconded

          by Council member Ricchi, to approve the Resolution for the Purchase

          of 2.08-acres of the Spain Tract. Caption reads as follows:

                      RESOLUTION NO. 2009-04-072 (R)

          A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
          McKINNEY, TEXAS, AUTHORIZING THE PURCHASE OF
          2.08 ACRES OF THE SPAIN TRACT

          Council member Ricchi stepped down from the dais.

09-225    Consider/Discuss/Act on a Roadway Impact Fee Credit Agreement

          between the City of McKinney, MEDC and Encore Wire Corporation.

          Council unanimously approved the motion by Council member Ussery,

          seconded by Council member Huff, to approve a Roadway Impact Fee

          Credit Agreement between the City of McKinney, MEDC and Encore

          Wire Corporation.

          Council member Ricchi returned to the dais.

09-226    Consider/Discuss/Act on Appointing a Member to the North Texas

          Municipal Water District Board.    Council unanimously approved the

          motion by Council member Kever, seconded by Council member

          Garza, to appoint Joe Joplin to serve for a two year term on the North

          Texas Municipal Water District Board beginning June 1, 2009.

      Mayor Pro-Tem Cox called for City Council and Manager Comments

      Council member Kever gave a shout out to Police Sergeant Marcos

Robles who she had the privilege of riding around with on Friday night. Ms. Kever

stated that it was an interesting evening and she had a renewed sense of

appreciation for our officers. “They have to quickly go from being on the offense

to being on the defense communicating with different individuals from smoking

violations, to drug situations, and to very violent situations.”

       Council member Garza announced that the City will be sponsoring a

Cinco de Mayo celebration at Old Settlers Recreation Center and Barney and Me

will be hosting a boxing tournament. Ms. Garza reminded everyone that election

day is May 9th with early voting starting on Monday, April 27 th. There will be a

candidate forum on May 4th at the McKinney Performing Arts Center.

       Council member Huff stated that this Thursday night will be a volunteer

recognition at the Heard Craig Hall.        Volunteer McKinney Center is a great

organization that pulls together an amazing number of volunteers that help

throughout our community.         Mr. Huff stated that this morning there was a

Volunteer Recognition at the Volunteer Center of North Texas. There was one

resident who was recognized for her work with Communities in Schools. The

Schools pay half of the Community in Schools (CIS) resource person to organize

volunteers to help kids that are struggling or don’t have real help at home. The

McKinney Independent School District had 9 CIS workers and only 6 schools in

the entire Dallas Independent School District.       Mr. Huff congratulated his wife

Nancy for being the recipient of the award today.

       Council member Ussery congratulated Nancy Huff for her recognition. Mr.

Ussery thanked City Secretary Sandy Hart and her staff for making his job

easier.

       Council member Ricchi thanked the Council for their vote last week for the

dynamic speed signs on Berkshire and for the speed cushion test on the other

side of Berkshire.   Mr. Ricchi stated that he is on a mission to lower the speed

limit to 25 mph in all residential areas in the city and to expand school zones Mr.

Ricchi stated that we are here to make sure that our children have a safer place

to live and walk to school.

       Mayor Pro-Tem Cox thanked City staff for continuing to go over and

above.

       City Manager Ragan had no comments.

       Mayor Pro-Tem Cox called for Citizen Comments and there were none.

      Council unanimously approved the motion by Council member Ricchi,

seconded by Council member Ussery, to adjourn the meeting. Mayor Pro-Tem

Cox adjourned the meeting at 5:55 p.m.
