On December 13, 2005, the Community Development Committee reviewed a draft ordinance for approval
of Wickes Furniture and a multi-tenant retail/restaurant building with drive-through at the southwest corner
of Randall Road. City staff has been working closely with the applicant, Robert Zacharias, on this project
since the fall of 2004 when two buildings fronting Randall Road were proposed, and the site north of
Target was not included. This concept was presented to the Community Development Committee in
October 2004. With the inclusion of the vacant property between Target and McKee Street, Mr. Zacharias
has maintained that this area remain visible from the corner of Randall Road and McKee Street,
necessitating the removal of the building holding the corner.

In general, the Committee supported the proposal, stating that tenants and development design fit the
context of Randall Road. The buildings and signs are designed well to work together visually and
functionally, using existing access and providing pedestrian connections to the McKee Street sidewalk and
the Target portion of the property. Site lighting was addressed in detail, specifically the Plan Commission’s
recommendation for metal halide lighting in place of the proposed high pressure sodium. The Committee
stated that high-pressure sodium lighting is the Council’s preference and would match the type of lighting
used for Target’s parking lot.

The Committee discussed the importance of including a windmill on the Randall Road frontage for this
development, and requested Mr. Zacharias install one. Mr. Zacharias informed the Committee that he is
bound by an operating easement agreement that does not address installation of a windmill. The many
parties to the agreement would need to agree to amend it accordingly. He committed to use his best efforts
to amend this agreement, but if unsuccessful, he would donate to the City $15,000.00 for the installation of
a windmill elsewhere on Randall Road.

No citizens were present to comment on the proposal. The Committee recommended approval of this
development proposal subject to several conditions. These conditions included in the attached Ordinance.

Please present the attached Ordinance 05-62 for approval at the December 19, 2005 City Council meeting.

WHEREAS, a Petition for a Conditional Use for a Planned Development and a Drive-
Thru Restaurant with Final Planned Development Plan Approval for the real estate
located on the southwest Corner of Randall Road and McKee Street, and legally
described as:
      LOT 1 OF WINDMILL PLACE SUBDIVISION UNIT 1, LOTS 4 AND
      5 OF WINDMILL PLACE SUBDIVISION UNIT 2, AND A PORTION
      OF LOT 3 FROM MCKEE STREET TO THE SOUTH PARCEL LINES
      OF LOTS 4 AND 5, ALL IN SECTION 20, TOWNSHIP 39 NORTH,
      RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN WITHIN
      THE CITY OF BATAVIA, KANE COUNTY, ILLINOIS. (PIN # 12-
      20-230-006,12-20-230-007, 12-20-230-008 AND 12-20-230-009),
(hereinafter referred to as “Property”), has been filed with the CITY of Batavia, an
Illinois municipal corporation (“CITY”) Robert Zacharias, Maxim Realty &
Development LLC, (“DEVELOPER”) and;

WHEREAS, the Batavia Plan Commission has held a public hearing on November 23,
2005, regarding the said petition in accordance with law; and

WHEREAS, following said hearing, the Plan Commission recommended approval of the
Conditional Use for a Planned Development and a Drive-Thru Restaurant with Final
Planned Development Plan Approval, with the following conditions:
   1. A deviation to Zoning Regulations Section 10-7-5-D to omit the required loading
      berth for the multi-tenant building

   2. A deviation to Zoning Regulations Section 10-8-12-4-B-1 to allow the site to
      contain two (2) freestanding signs, with the McKee Street sign to identify three
      (3) businesses on the subject property, as proposed

   3. A deviation to Zoning Regulations Section 10-8-12-4-B-2 to allow one (1)
      freestanding sign near the northeast corner of the property to contain 368 square
      feet and one (1) freestanding sign to the west on McKee Street to contain 140.25

       square feet, each as measured by a rectangle encompassing the furthest projection
       of the installation, as proposed

   4. A deviation to Zoning Regulations Section 10-8-12-4-B-3 to allow one (1)
      freestanding sign to be 29 feet tall near the northeast corner of the property and
      one (1) freestanding sign to be 23 feet tall along McKee Street , as proposed

   5. The Wickes building entrance canopy to be green to match the arch detail

   6. The multi-tenant building to have all awnings/canopies to be of the same brown
      color as shown in the color elevations

   7. The multi-tenant building to have all wall signs to be individual letters/logos, and
      not a box sign

   8. Window signage limited to a maximum of 10% of any divided glass area and
      placed in the vertical center of an aggregate divided glass unit.

   9. All pole and wall pack lights to be fully shielded fixtures that direct light down,
      have the light source parallel to the ground, and have the bulb and lens not drop
      below the housing. These are to be metal halide lights.

   10. Dedication of McKee Street and the intersection of Randall Road as
       recommended by staff; and


WHEREAS, on December 13, 2005, the Community Development Committee
recommended approval of the Conditional Use for a Planned Development and a Drive-
Thru Restaurant with Final Planned Development Plan Approval, with the following
conditions:

   9. High pressure sodium lights shall be utilized for all pole and wall pack lights
      rather than the proposed metal halide lights
   10. The applicant shall use his best efforts to engage all parties to the existing
       operating easement agreement that affect this site to amend the agreement to
       allow installation of a windmill. In the event such agreement is reached, the
       applicant shall, prior to the issuance of the first certificate of occupancy on the
       property, install a windmill of the City’s choosing on the property at a location to
       be agreed upon with the City, with the cost of such windmill and installation not
       to exceed $15,000. If, after 9 months following the adoption of this Ordinance,
       said agreement cannot be amended to allow such an installation, the applicant
       shall submit a donation to the City in the amount of $15,000.00, prior to issuance
       of the first certificate of occupancy on the property, to be used by the City to
       install a windmill elsewhere along Randall Road.
WHEREAS, the City Council of the CITY has received the recommendation of the both
the Batavia Plan Commission and the Community Development Committee and has
considered same;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF BATAVIA, KANE COUNTY, ILLINOIS, as follows:

SECTION 1:        APPROVAL OF CONDITIONAL USE FOR PLANNED
                  DEVELOPMENT AND A DRIVE-THRU RESTAURANT WITH
                  FINAL PLANNED DEVELOPMENT PLAN APPROVAL

Conditional Use for a B-3 Arterial Oriented Commercial Planned Development and a
Drive-Thru Restaurant with Final Planned Development Plan is granted for the Property
located on the southwest corner of Randall Road and McKee, and legally described
above, subject to the variations, deviations, authorizations and restrictions provided
herein.

SECTION 2:        DEVELOPMENT OF THE PROPERTY

It is contemplated that the Property will be developed by DEVELOPER. Regardless of
whether Developer or a third party acquires or develops any specific portion of the
Property, the development of the Property shall be carried out in conformity with the
development standards hereinafter set forth in this Ordinance, the Plans and the Batavia
Municipal Code, as hereafter defined.

       Commission and the Community Development Committee of the CITY and are

       The above exhibits hereinafter are referred to as the “Final Plans”. The Final
       Plans are approved by the CITY in their entirety and any provision or
       requirements contained in any ordinance, regulation, directive or procedure of the
       CITY exclusive of this Ordinance, in conflict with any aspect or element of the

Final Plans, shall be deemed varied hereby so as to conform with and permit the
development, use, maintenance and operation of the Property.
B.     SUBSEQUENT PLAN APPROVAL
The following plans for the Property have not been submitted to or reviewed by
the CITY for the Property and will be subject to subsequent final approval by the
CITY:

           •   Final Engineering Plans Submitted for Construction

The CITY shall, when reviewing and approving any Final Plans for Construction,
apply sound and accepted planning and engineering principles and requirements.



C.     ZONING AND LAND USE
Except as otherwise provided in this Conditional Use Ordinance, the development
and use of the Property shall comply with the standards established under the B-3
Arterial Oriented Commercial District zoning classification with a Conditional
Use for a Planned Development.

If there is any conflict between the regulations of the Batavia Municipal Code, as
amended from time to time, and this Conditional Use Ordinance, this Conditional
Use Ordinance shall govern. In conjunction therewith, the CITY hereby approves
the following standards to be applied to the Property under said zoning
classifications.


D.     CONSTRUCTION OF BUILDINGS AND APPURTENANCES WITHIN
       THE PROPERTY.


The DEVELOPER and/or its successors and assigns, shall have the right to
construct buildings, driveways, utility lines, detention facilities and other
appropriate improvements within such lot, provided that same comply with the
Batavia Municipal Code, or as otherwise provided in this Ordinance. The party
seeking to construct such improvements upon any subdivided lot therein, shall
first obtain a building permit, and such other required permits therefore, from the
CITY in compliance with the applicable provisions of the Batavia Municipal
Code, as hereby amended. Field tiles, in encountered during construction, shall
be rerouted and rejoined or directed to the storm sewer system.

       E.      LANDSCAPING.
       The Property shall be landscaped in substantial compliance with the Final
       Landscape Plan.


       F.      WINDMILL.
       The developer shall use his best efforts to engage all parties to the existing
       operating easement agreement that affect this site to amend the agreement to
       allow installation of a windmill. In the event such agreement is reached, the
       applicant shall, prior to the issuance of the first certificate of occupancy on the
       property, install a windmill of the City’s choosing on the property at a location to
       be agreed upon with the City, with the cost of such windmill and installation not
       to exceed $15,000. If, after 9 months following the adoption of this Ordinance,
       said agreement cannot be amended to allow such an installation, the applicant
       shall submit a donation to the City in the amount of $15,000.00, prior to issuance
       of the first certificate of occupancy on the property, to be used by the City to
       install a windmill elsewhere along Randall Road.


SECTION 3:         CHANGES TO THE PLANNED DEVELOPMENT.

The Property shall be developed in substantial compliance with the approved Final Plan
of Planned Development. Changes to the Planned Development as approved shall be
evaluated and processed as follows:
       A.      DEFINITIONS
       Major Changes. Major changes shall include any changes to the Planned
       Development which require an amendment of this Ordinance, or any other change
       for which a public hearing is required by law or by the Batavia Municipal Code,
       except as specifically provided herein.
       Minor Changes. Minor changes shall include any change not defined herein as a
       major change or a technical change.
       Technical Change. Technical changes shall include any change to the plans and
       specifications, which is determined by the Director of Community Development,


       City Engineer, Director of Public Works, Building Inspector, or Fire Chief, as the
       case may be, to be:
            in substantial compliance with the Plans as approved by the City Council;
            in compliance with the Batavia Municipal Code, as amended, except as
            specifically varied herein; and
            in compliance with good engineering, building or planning practice.

       B.     PROCEDURES
       Major changes may be approved by the City Council after public hearing and
       recommendations by the Plan Commission pursuant to submittal and processing
       of a petition to amend the Conditional Use as a Planned Development and a
       petition for preliminary plan approval, as set forth in the Batavia Municipal Code.
       Minor changes may be approved by the City Council without Plan Commission
       review or public hearing.
       Technical changes may be approved by the Director of Community Development,
       City Engineer, Director of Public Works, Building Inspector or Fire Chief, as the
       case may be.
SECTION 4:        INCORPORATION OF EXHIBITS

All exhibits attached to this Ordinance 05-62 are hereby incorporated herein and made a
part of the substance hereof.

SECTION 5:       This Ordinance 05-62 shall become effective from and after its
passage and approval in accordance with law.

PRESENTED to the City Council of the City of Batavia, Illinois, this 19th day of
