                                    January 24, 2006

The Regular Meeting of the Mayor and Council was held in Council Chambers and called
to order at 7:20 p.m. by Mayor McCarthy. He asked all present to participate in a moment
of silence, followed by a salute to the flag.

Adequate notice of this meeting was provided to the Cranford Chronicle and the Star
Ledger as advertised on January 5, 2006, informing the public of time and place
according to the provisions of the Open Public Meeting Law (Chapter 231, P.L. 1975).

                         ORDINANCE NO. 06-01
       AN ORDINANCE OF THE BOROUGH OF GARWOOD PROHIBITING
       REGISTERED SEX OFFENDERS FROM RESIDING OR LOITERING
       WITHIN 2,500 FEET OF ANY SCHOOL, PARK, PLAYGROUND,
       RECREATION AREA, DAY CARE FACILITY OR SCHOOL BUS STOP.

A motion to adopt Ordinance 06-01 was made by Councilman Schadewald, seconded by
Councilman Lombardo, whereupon Mayor McCarthy directed Roll Call, Council President
Villaggio-Aye, Councilman DeFilippo-Aye, Councilman Lombardo-Aye, Councilman Mitchell-
Aye, Councilman Schadewald-Aye, Councilman Tucker-Aye. All Ayes, Ordinance 06-01 was
adopted


COMMITTEE REPORTS

POLICE, PUBLIC HEALTH AND SAFETY: Councilman Schadewald, Chr.
On February 14th, Mayor and Council will be honoring Chief Lesak for his many years of
service. Also Captain William Legg will be sworn in to the position of Chief for the
Garwood Police Department.

STREETS AND ROADS: Councilman Lombardo, Chr.
READ BY: Fred Corbitt Superintendent of Public Works
On Saturday January 14, 2006 at 10:00 P.M. the Department of Public Works began salting
Borough streets. Sunday January 15, 2006 Borough lots and sidewalks were treated for ice and
roads were re-checked and salted as needed. The Department of Public Works 1995 Ford
pickup plow truck was picked up on January 16, 2006. Transmission replacement was not
needed and the truck is now back in service. All other Snow removal equipment is in good
working order and ready to respond if needed. Overtime for January 14 and 15, 2006 for 2 men
was 10 ½ hours. Pot holes are continuing to be repaired two to three days a week. Street
sweeping is being done daily weather permitting. Wednesday January 25, 2006 is the last
scheduled pickup for Christmas trees. January 13, 2006 Department of Public Works cleared a
blockage in the drainage system on Liberty Court caused by Leaves and other debris. January
18, 2006 Fania roofing Company repaired several leaks in Borough hall’s roof.

FIRE: Councilman Mitchell, Chr.
The membership of the Garwood Fire Department has elected the Officers for 2006.
Chief Rich Bonfanti, Assistant Chief Ed Silver, Captain Wayne Frew, First Lieutenant
Mike Tharaldsen, Second Lieutenant Paul Margeotes.

Tonight there are two applications for a Raffle Licenses. The committee recommends the
adoption of Resolution No. 06-151 for the application of one on-premise 50/50 raffle and one on-
premise merchandise raffle, to be held March 15, 2006, at the Westwood, by the Union High
School P.T.A..

RECREATION: Council President Villaggio, Chr.
The Recreation Committee has the following events planned. On February 9th there is
roller skating from 6:30 to 8:30 at Woodbridge Recreation Center and the Family Swim
will be held at the Cranford indoor pool on March 18th from 6:30 to 8:30.

Former President Phyllis Begasse celebrated her 100th Birthday on January 2, 2006. On
behalf of everyone we wish Phyllis the best and wish her a Happy Birthday. It would be
nice if we all could send her a letter of acknowledgement. She is a long time resident and
her son died in a war. She is a Gold Star Mother.

At this time Mayor McCarthy presented a resident of Garwood, Lt. Col. Andrew B.
Kuhtik with a Resolution acknowledging him for his dedicated service to the New Jersey
National Guard.


HEARING OF CITIZENS WHO WISH TO ADDRESS THE MAYOR AND
COUNCIL:

Ann Leonard, 536 Myrtle Avenue: Asked if she complains about a neighbor does the
police have to tell them who complained. Chief Lesak responded that this is public
record. She also asked about the procedure for installing driveways in the borough.
Council President Villaggio addressed her concerns.
Cheryl Pickett of 245 Fourth Avenue expressed concerns regarding rumors that the
Community Center is going to be built. Mayor McCarthy responded this project is still
being investigated. Mayor McCarthy stated he has appointed a citizens committee to re-
look at the project to make recommendations on how we should proceed or if we should
proceed at all. She also asked if there is truth to the rumor the town promised the
“MUSE” that the town would build a community center. Mayor McCarthy responded
that he is happy she is asking these questions so he can give her the facts and the rumor
has absolutely no truth whatsoever. She also asked the status of the Reverse 911 System
for the Police Department. Mayor McCarthy responded the town has applied for grant
money three times and was not successful, however is looking at alternative ways to fund
this service.
There was also discussion concerning disabled senior citizens that may need assistance.
Christina Ariemma recommended Ms. Pickett contact the Board of Health for
information. Mayor McCarthy stated he would have someone look into this.

Bruce Paterson of 325 Willow Avenue suggested asking Union County Freeholders for
grant money for the reverse 911 system. He also stated that the MUSE has its own center
within the complex. Mr. Paterson also expressed his concerns regarding the Rahway
Valley Sewerage Authority fees.

WHEREAS, the Mayor and Council of the Borough of Garwood have hereto adopted:
                                                      ORDINANCE NO. 05-25
           AN ORDINANCE FIXING THE SALARIES AND WAGES OF CERTAIN OFFICIALS AND
           EMPLOYEES OF THE BOROUGH OF GARWOOD, IN THE COUNTY OF UNION, STATE OF NEW
           JERSEY.
WHEREAS, said Ordinance reflects changes of salaries and/or hourly rates to be paid to said employees of the Borough of
Garwood for the year 2006.
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Garwood be and they are hereby
authorized and directed to execute checks on Borough funds for the purpose of paying the annual salaries and/or hourly rates to
the employees of the Borough of Garwood as set forth below and in the amount set forth opposite each job classification. Said
salaries to be paid bi-weekly less such deductions as in such cases made. The schedule of salaries hereafter set forth shall be
effective as of January 1, 2006, or pro-rated as the case may be.

BE IT RESOLVED, by the Mayor and Council of the Borough of Garwood, in the County of Union, State of New Jersey, that the
license to conduct an On-Premise 50/50 raffle and an On-Premise Merchandise raffle on March 15, 2006, to be held at The
Westwood, North Avenue, Garwood, NJ from 6:00 p.m. to 11:00 p.m. is hereby granted to Union High School P.T.A., pursuant to
Application Number RA 804 and Application Number RA 805.

WHEREAS, the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey hereby authorize the
following in accordance with state contract # T-1842 (A53680).

BE IT FURTHER RESOLVED, that the award of this quote is subject to the Borough Treasurer executing the appropriate
Certification of Funds.
                                                   RESOLUTION NO. 06-153
BE IT RESOLVED by the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey, hereby
authorizes the Municipal Clerk to sign a contract with:

                                Newton, NJ 07860
Term of contract: April 1 to October 1, 2006
Cost of contract: $1,950.00
The service includes all labor and materials and the NJDEP permit application fee.
For vegetation control in the Garwood Brook.
                                                   RESOLUTION NO. 06-154
WHEREAS, Dennis K. Lesak has served the Borough of Garwood for twenty-eight years and was sworn as Patrolman in the
Garwood Police Department on February 1, 1978 and appointed as Chief of Police on June 1, 2000, and has faithfully served
every rank in the Garwood Police Department except Captain; and
WHEREAS, Chief Lesak and his father, the late James J. Lesak, Sr., are the only father and son team in the history of the
community to work together on the force at the same time; and
WHEREAS, Chief Lesak’s eagerness to assume responsibility along with his desire to serve the residents of our community has
been displayed through his loyal and dedicated service and his outstanding leadership is genuinely noted and appreciated; and
WHEREAS, on February 1, 2006, after twenty-eight years of devoted service to the Borough, Dennis will take his much
deserved retirement.
NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Garwood, County of Union, State of
New Jersey, do hereby publicly commend Chief Lesak for the capable and efficient performance of all his duties, and
“Congratulate” Dennis on his retirement and extend to Dennis and Debbie “Best Wishes” for the future and in their new home;
and
BE IT FURTHER RESOLVED that the Mayor, Council, and Municipal Clerk be and they are hereby authorized to affix their
signatures to this Resolution, which shall be presented to Chief Dennis K. Lesak.
                                                   RESOLUTION NO. 06-155
BE IT RESOLVED, by the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey that William
D. Legg be and is hereby appointed Chief of the Garwood Police Department in the Borough of Garwood, effective February 1,
2006, at an annual salary of $83,546.00.
                                                   RESOLUTION NO. 06-156
BE IT RESOLVED, by the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey that Leonard
DiStefano be and is hereby appointed Captain of the Garwood Police Department in the Borough of Garwood, effective February
1, 2006, at an annual salary for 2006 of $79,047.00.
                                                   RESOLUTION NO. 06-157
BE IT RESOLVED, by the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey that Bruce
D. Underhill be and is hereby appointed Lieutenant of the Garwood Police Department in the Borough of Garwood, effective
February 1, 2006, at an annual salary for 2006 of $75,428.00.
                                                   RESOLUTION NO. 06-158
BE IT RESOLVED, by the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey, that
Michael Wilson be and is hereby appointed Sergeant for the Garwood Police Department in the Borough of Garwood, effective
February 1, 2006, at an annual salary for 2006 of $72,413.00.
                                                   RESOLUTION NO. 06-159
WHEREAS, New Jersey’s public schools serve more than 1.2 million children from Kindergarten through Grade 12; and
WHEREAS, The direction of public education in New Jersey is charted locally by individual school boards, whose 4,800
members serve as advocates for public education as they work with administrators, teachers, parents and local residents; and
WHEREAS, Boards of education provide accountability to the democratic system of governing the schools by communicating
the needs of the district to the community while impressing upon administrators the public’s expectations for the school district;
and
WHEREAS, School board members receive no remuneration for their services; and
WHEREAS, The Mayor and Council is justly proud of the academic, athletic and social achievements of the students in our
community; and
WHEREAS, The New Jersey State Board of Education and the New Jersey School Boards Association have declared January
2006 to be School Board Recognition Month, a time that all residents might acknowledge the contributions made by our local
school board members.

NOW THEREFORE, BE IT RESOLVED, the Mayor and Council of the Borough of Garwood, County of Union, State of
New Jersey does hereby commend the service of the Garwood Board of Education members to our community and its children;
and be it further
RESOLVED, That the Mayor and Council proclaims January 2006 as SCHOOL BOARD RECOGNITION MONTH in the
Borough of Garwood, and urges all citizens to join in recognizing the dedication of local school board members, past and
present, as we work together to improve educational opportunities for our children.
                                                    RESOLUTION NO. 06-160
BE IT RESOLVED, by the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey hereby
authorize Police Commissioner William Schadewald to sign the release to transfer firearm Serial Number EVL963US to Chief
Dennis Lesak.
                                                    RESOLUTION NO. 06-161
BE IT RESOLVED, by the Mayor and Council of the Borough of Garwood, County of Union, State of New Jersey hereby
appoints Rosabla Comas, Esq., 466 Orchard Street, Cranford, NJ 07016, as Alternate Prosecutor for 2006.
                                                    RESOLUTION NO. 06-162
WHEREAS, Rich and Alice Lefebvre have faithfully and conscientiously served the citizens of the Borough of Garwood as
owners of Crafty Kitchen and have served the businesses of Garwood as President and Members of the Garwood Chamber of
Commerce; and
WHEREAS, Rich and Alice have been in business for many years and are well known amongst the towns people and have also
put an enormous amount of time and effort into the Chamber, organizing and running many events for the businesses and citizens
of the Borough; and
WHEREAS, after many years in business Rich and Alice are retiring and sadly Crafty Kitchen is closing, however regretful, we
celebrate and rejoice for Rich and Alice as they close this chapter of their lives and begin a new one; and
WHEREAS, the Governing Body of the Borough of Garwood wish to publicly acknowledge and commend them in their success
and for their loyal dedicated service to the businesses and people of the Borough of Garwood.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Garwood do hereby “Congratulate”
Rich and Alice on their retirement and do hereby express "Best Wishes" to Rich and Alice in the coming years; and
BE IT FURTHER RESOLVED that the Mayor, Council, and Municipal Clerk be and they are hereby authorized to affix their
signatures to a copy of this resolution, which shall be presented to Rich and Alice Lefebvre.
                                                    RESOLUTION NO. 06-163
WHEREAS, in accordance with N.J.S.A 40:14B-66 municipal authorities shall cause an annual audit of its accounts to be made,
and for this purpose it shall employ a registered municipal accountant of New Jersey or a certified public accountant of New
Jersey to conduct an annual audit and provide other required accounting services and therefore the Mayor and Council have
determined that there exists a need for professional auditing and consultant services to provide Auditing/Consultant services of a
specialized nature to the Borough; and
WHEREAS, the Mayor and Council of the Borough of Garwood advertised on January 12, 2006 and received proposals on
January 23, 2006 under a fair and open process in accordance with P.L. 2004, c.19, as amended by P.L. 2005, c.51; and
WHEREAS, the said Governing Body has determined that such services are professional services as defined in the Local Public
Contracts Law of the State of New Jersey; and
WHEREAS, the Local Public Contracts Law requires that a notice stating the nature, duration, services and amount of each
contract awarded as a professional services contract be printed once in the official newspaper of the municipality;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Garwood:
           1.        That the Mayor and Borough Clerk be and are hereby authorized and directed to execute an agreement with
                     Suplee, Clooney & Company, 308 East Broad Street, Westfield, NJ 07090, for the provision of professional
                     auditing and consulting services for the Borough of Garwood; and
           2.        That said Contractor shall receive fees not to exceed $39,750.00 for 2006 Statutory Audit, $3,675.00 for
                     2006 Financial/Debt Statement, 2007 Municipal Budget, $375.00 per Preparation of Supplement Debt
                     Statements, $900.00 Borough’s Deferred Compensation Plan, which are included in proposal dated January
                     20, 2006; and
           3.        That the Borough Clerk be and is hereby authorized and directed to maintain this resolution and the
                     professional services contract on file and available for public inspection in the Office of the Borough Clerk;
                     and
           4.        That the Borough Clerk is hereby authorized and directed to publish a copy of this notice as required by law.


A motion to adopt Consent Agenda was made by Council President Villaggio, seconded
by Councilman Lombardo, whereupon Mayor McCarthy directed Roll Call, Council
President Villaggio-Aye, Councilman DeFilippo -Aye, Councilman Lombardo-Aye,
Councilman Mitchell-Aye, Councilman Schadewald-Aye, Councilman Tucker-Aye.

ADJOURNMENT

Mayor McCarthy announced the Regular Meeting of the Mayor and Council will be held
on TUESDAY, FEBRUARY 14, 2006, in Council Chambers at 7:15 p.m. Workshop
Session to start at 7:00 p.m.

The Mayor and Council of the Borough of Garwood will acknowledge the
Retirement of Police Chief Dennis K. Lesak on Tuesday, February 14, 2006, at 6:30
p.m., in Council Chambers, followed by the swearing in of Captain William D. Legg
as Garwood’s 8th Chief of Police. Public attendance is welcomed.

At 7:55 p.m., a motion to adjourn was made by Councilman Lombardo, seconded by
Council President Villaggio. All Ayes.
