INTRODUCTION Any proposal made by the INSURED to INSURERS containing particulars and statements made to the best of the INSURED’s knowledge and belief which, together with any other information which may have been supplied, shall form the basis of this insurance and are considered to be incorporated herein. In consideration of the INSURED having agreed to pay the premium shown in the SCHEDULE, INSURERS agree to provide the insurance described in this policy to the INSURED, subject to the terms, conditions, exclusions and limitations of this insurance. 2. INSURING CLAUSE INSURERS agree, subject to the terms, conditions, exclusions and limitations of this policy, to:(a) Compensate the INSURED under “Section A – Personal Accident” if during the PERIOD OF INSURANCE and the OPERATIVE TIME OF COVER an INSURED PERSON sustains BODILY INJURY up to the amount stated in the SCHEDULE; Indemnify the INSURED under “Section B – Travel” if during the PERIOD OF INSURANCE and the OPERATIVE TIME OF COVER an INSURED PERSON sustains BODILY INJURY or contracts SICKNESS or suffers a loss as defined in Sections B.1 – B.4. (b) 3. GENERAL DEFINITIONS For the purposes of this policy, the following definitions apply: (a) (b) (c) (d) (e) (f) (g) (h) ACCUMULATION LIMIT: The maximum aggregate amount INSURERS will pay in respect of all INSURED PERSONS for all claims arising from one event, source or original cause. APPOINTED REPRESENTATIVE: A solicitor or other suitably qualified person appointed to act for the INSURED PERSON or the INSURED PERSON’s personal legal representative in any legal proceedings. BODILY INJURY: Injury which is caused by accident and which within twelve months from the date of such accident shall result in the death or disablement of the INSURED PERSON. CHILDREN/CHILD: Any person who is unmarried and under 18 years of age or 23 if in full-time education. EXCESS: The first amount of each and every claim for which the INSURERS will not be liable. HAZARDOUS ACTIVITY: Any activity not forming part of the approved military WINTER SPORTS, training and championship competitions. INSURED: The Unit as stated in the policy SCHEDULE. INSURED JOURNEY: Any time during the PERIOD OF INSURANCE whilst an INSURED PERSON is travelling to a destination outside the United Kingdom the Channel Islands and the Isle of Man (or within the United Kingdom the Channel Islands and the Isle of Man if such travel includes an overnight stay &/or an internal flight) or Country of Domicile to participate in approved military WINTER SPORTS training and championship competitions from time of leaving an INSURED PERSON’s PLACE OF RESIDENCE until arrival back at an INSURED PERSON’s PLACE OF RESIDENCE. INSURED PERSON: Any person specified on the SCHEDULE aged between 16 and 65 years of age. Cover shall apply until the end of the PERIOD OF INSURANCE during which an INSURED PERSON attains 65 years of age. INSURER: W. R. Berkley Insurance (Europe), Limited INTERMEDIARY: Sandhurst Insurance Services Limited, 52 Maycross Avenue, Morden, Surrey SM4 4DA MATERIAL FACT: A fact which is likely to influence the INSURER in their assessment and acceptance of the insurance provided under this Policy MAXIMUM BENEFIT ANY ONE PERSON: The maximum benefit payable in respect of any one INSURED PERSON for all claims arising from one event source or original cause OPERATIVE TIME OF COVER: Whilst on an INSURED JOURNEY PERIOD OF INSURANCE: The period stated in Item 4 of the SCHEDULE and/or as revised by endorsement attaching to this policy. PLACE OF RESIDENCE: An INSURED PERSON’s home within the United Kingdom or a British Armed Forces base where an INSURED PERSON is posted anywhere in the world. PROPOSAL: Any signed Proposal Form and declaration and/or any information in connection with this contract supplied by or on behalf of the INSURED and/or the INSURED PERSON. SCHEDULE: The Schedule of Insured Persons and the Schedule of Benefits attached to this policy. SICKNESS: An illness of the INSURED PERSON which becomes manifest during the PERIOD OF INSURANCE and OPERATIVE TIME OF COVER and is perceived by a qualified medical practitioner to necessitate immediate medical treatment or repatriation. WINTER SPORTS: Means ski racing, biathlon, alpine and nordic competition events, all conducted to F.I.S., B.S.F. or home nation governing body rules and recreational downhill or cross-country skiing or snowboarding in an area approved by the local service-de-piste between events. WAR: (i) invasion, acts of foreign enemies, hostilities (whether war be declared or not), civil war or any act condition or warlike operation incidental to War (ii) warlike action by a regular or irregular military force or civilian agents or any action taken by any government, sovereign or other authority to hinder or defend against an actual or expected attack (iii) insurrection, rebellion, revolution, attempt to usurp power, or popular uprising, or any action taken by governmental or martial authority in hindering or defending against any of these (i) (j) (k) (l) (m) (n) (o) (p) (q) (r) (s) (t) (u) AFCWS-2006 2 4. GENERAL CONDITIONS Applicable to all Sections of this policy unless stated to the contrary (a) As soon as practicable after the occurrence of an incident which may be the subject of a claim under this Policy (i) the INSURED PERSON shall give notice to INSURERS and supply without cost to INSURERS such certificates, receipts or evidence which thereafter may be required and where applicable, (ii) the INSURED PERSON shall seek the care of a qualified medical practitioner whose advice the INSURED PERSON must follow. (b) (c) (d) (e) (f) The INSURED PERSON shall give immediate notification to INSURERS of any alterations which materially affect the risk Insured. The observance of the terms of this policy shall be conditions precedent to any liability of INSURERS. If a claim is in any respect fraudulent or if any fraudulent means or devices are used by the INSURED PERSON or anyone acting on their behalf to obtain any benefit under this policy all benefits under this policy shall be forfeit. INSURERS may cancel this policy at any time by giving thirty days notice by recorded delivery letter to the INSURED at the INSURED’s last known address. The INSURED PERSON may cancel this policy within 14 days of receipt of the policy documentation by returning the documentation to the INTERMEDIARY. Subject to an INSURED PERSON not having commenced an INSURED JOURNEY and no claim being made a full return of premium shall be allowed. No return of premium shall be allowed after the 14 day cooling off period or following the commencement of an INSURED JOURNEY, whichever is the sooner. The INSURED PERSON shall take all reasonable care to avoid and prevent BODILY INJURY or SICKNESS and to maintain the safety of any ACTIVITY EQUIPMENT and/or SKI PASSES Insured. The receipt of final payment by the INSURED PERSON or their APPOINTED REPRESENTATIVE shall discharge INSURERS from any obligation under this policy This policy shall be governed by the law of England and Wales whose courts alone shall have jurisdiction in any dispute hereunder unless otherwise agreed. All sums Insured and limits stated in this policy are inclusive of VAT (where applicable). If at the time of a claim any other insurance policy or national programme covers the INSURED PERSON the INSURERS shall only pay a proportion of the claim which shall be determined by reference to the cover provided under each of the policies. Such condition shall not apply to benefits under “Section A – Personal Accident” which shall be payable in full. This policy and its SCHEDULE and any endorsements or memoranda attached thereto shall be read together as one document and any word or expression to which a specific meaning has been given shall bear the same meaning wherever it may appear. The INSURED PERSON shall observe travel advice provided by the Foreign & Commonwealth Office (FCO). No cover will be provided under any sections of this policy in respect of travel to a destination to which the FCO have advised against all travel unless agreed in writing by INSURERS. In the event that an INSURED PERSON is already within a destination on the date the FCO issues a warning against all travel to that destination cover will be maintained as stated in the SCHEDULE for a period of 7 days. Thereafter cover shall cease unless agreed in writing by INSURERS. Travel to destinations to which the FCO advise against travel unless on essential business shall be deemed a material fact and should be advised to INSURERS. GENERAL EXCLUSIONS Applicable to all Sections of this policy unless stated to the contrary INSURERS shall not be liable to pay compensation in respect of BODILY INJURY or SICKNESS or loss or damage or expense which arises directly or indirectly from or in connection with or is aggravated by: (a) (b) (c) WAR (whether declared or not) discharge, explosion or use of a weapon of mass destruction employing nuclear fission or fusion, or chemical, biological, radioactive or similar agents, by any party at any time for any reason radioactive contamination. AFCWS-2006 3 POLICY SECTION A PERSONAL ACCIDENT 6. SECTION A - PERSONAL ACCIDENT (a) COVER If during the PERIOD OF INSURANCE and the OPERATIVE TIME OF COVER the INSURED PERSON sustains BODILY INJURY the INSURERS will pay the INSURED PERSON up to the amount stated in the SCHEDULE. (b) DEFINITIONS (i) LOSS OF LIMB: 1. in the case of a leg permanent physical severance at or above the ankle or permanent and total loss of use of a complete foot or leg 2. in the case of an arm permanent physical severance at or above the wrist or permanent and total loss of use of a complete hand or arm. LOSS OF SIGHT: Permanent and irrecoverable loss of sight: 1. in both eyes if the INSURED PERSON’s name is added to the Register of Blind Persons 2. in one eye if the degree of sight remaining after correction is 3/60 or less on the Snellen Scale (which means seeing at 3 feet what an INSURED PERSON should see at 60 feet). (ii) (iii) LOSS OF SPEECH OR HEARING: Permanent total and irrecoverable loss of speech or hearing. (iv) PERMANENT TOTAL DISABLEMENT: Total and absolute disablement caused other than by LOSS OF LIMB, LOSS OF SIGHT, LOSS OF SPEECH or LOSS OF HEARING, which will entirely prevent the INSURED PERSON from engaging in any and every kind of occupation for the remainder of his life. (c) EXTENSIONS (i) DISAPPEARANCE If during the PERIOD OF INSURANCE and OPERATIVE TIME OF COVER the INSURED PERSON disappears and after twelve months it is reasonable to believe such INSURED PERSON has died as a direct result of injury caused by an accident then compensation under Benefit A.1 will become payable subject to a signed undertaking that if the INSURED PERSON is subsequently found to be alive the compensation paid will be refunded to INSURERS. (ii) EXPOSURE If during the PERIOD OF INSURANCE and OPERATIVE TIME OF COVER the INSURED PERSON suffers death or disablement as a result of exposure to the elements the INSURER will consider that as being BODILY INJURY. (d) CONDITIONS (i) Compensation will be payable under only one of benefits A.1 or A.2 or A.3 in respect of all BODILY INJURY sustained by an INSURED PERSON arising from any one event, source or original cause. (ii) Benefit A.1 shall be limited to £7,500, or the amount shown in the SCHEDULE whichever is the lesser, in respect of an INSURED PERSON who is a CHILD, other than where the CHILD is between 16 years of age and 18 years of age at the time of sustaining BODILY INJURY and is gainfully employed by the INSURED. (e) EXCLUSIONS INSURERS shall not be liable to pay any claim:(i) in respect of BODILY INJURY which arises directly or indirectly from or in connection with or is aggravated by:1. an INSURED PERSON a. committing a criminal act b. taking part in civil commotion or riot c. committing or attempting to commit suicide or intentional self injury or being in a state of insanity d. taking drugs (unless taken in accordance with treatment prescribed by a registered qualified medical practitioner other than for drug addiction), suffering from solvent abuse or alcoholism 2. an INSURED PERSON engaging in military naval or air services or operations (other than reserve or volunteer training as a member of one of the officially recognised United Kingdom volunteer reserve forces) 3. an INSURED PERSON engaging in air travel other than as a passenger in a licensed passenger carrying aircraft operated by a licensed commercial air carrier or military aircraft and for no other purpose 4. participating in any HAZARDOUS ACTIVITY other than WINTER SPORTS unless specifically shown on the SCHEDULE in respect of BODILY INJURY which arises directly or indirectly from or in connection with or is aggravated by sickness or disease (not resulting from BODILY INJURY) or any gradually operating cause (ii) (iii) after the expiry of the PERIOD OF INSURANCE during which the INSURED PERSON attains 65 years of age (iv) exceeding the:1. ACCUMULATION LIMIT 2. MAXIMUM BENEFIT ANY ONE PERSON as stated in the SCHEDULE AFCWS-2006 4 POLICY SECTION B TRAVEL 7. SECTION B.1 – EMERGENCY MEDICAL AND TRAVEL EXPENSES IMPORTANT NOTICE As soon as is practicable after the occurrence of BODILY INJURY or SICKNESS that is likely to result in an EMERGENCY MEDICAL EXPENSES claim for hospital treatment or the incurring of EMERGENCY TRAVEL EXPENSES the INSURED or INSURED PERSON must contact the 24/7 FirstAssist Operations Centre in the United Kingdom on: Telephone: +44 (0)20 8763 4814 Facsimile: + 44 (0)20 8763 3035 Email address: international.ops@firstassist.co.uk (a) COVER If during the PERIOD OF INSURANCE and OPERATIVE TIME OF COVER the INSURED PERSON sustains BODILY INJURY or contracts SICKNESS then INSURERS will indemnify the INSURED in respect of EMERGENCY MEDICAL EXPENSES and EMERGENCY TRAVEL EXPENSES necessarily incurred in returning to the INSURED PERSON's Country of Domicile up to the amount stated in the SCHEDULE. (b) DEFINITIONS (i) EMERGENCY MEDICAL EXPENSES: All reasonable costs necessarily incurred outside the INSURED PERSON’s Country of Domicile for medical, surgical or remedial treatment given or prescribed by a qualified medical practitioner and hospital or nursing home treatment and ambulance charges which cannot be reasonably delayed until the INSURED PERSON’s return to their Country of Domicile including dental expenses in respect of emergency treatment only. (ii) EMERGENCY TRAVEL EXPENSES: All reasonable additional costs necessarily incurred in travel, accommodation and emergency repatriation of the INSURED PERSON and/or of a close business associate, relative or friend (less any saving by or recovery available to the person concerned) to travel with or remain with the INSURED PERSON as a direct consequence of the INSURED PERSON having suffered BODILY INJURY or SICKNESS and where the qualified medical practitioner treating the INSURED PERSON advises that the INSURED PERSON be so accompanied. INSURERS will pay up to £20,000 to cover “Search & Rescue” charges necessarily incurred to get an INSURED PERSON to a hospital or clinic as a result of BODILY INJURY or SICKNESS. (c) EXTENSIONS (i) FUNERAL COSTS In addition to the benefits contained herein INSURERS will pay up to a maximum of £2,000 for the funeral costs incurred in the burial or cremation of the INSURED PERSON's body and/or the reasonable cost of transporting such body or the INSURED PERSON's ashes to the INSURED PERSON's Country of Domicile. WORLDWIDE EMERGENCY MEDICAL ASSISTANCE An Emergency twenty-four hour assistance service is available relating to the following aspects of travel:Medical Emergencies (including repatriation to the INSURED PERSON's Country of Domicile). Lost baggage - help trace lost personal possessions if the INSURED PERSON provides a luggage tag number and a Property Irregularity Report. Advice on how and where to contact the local Consulate/Embassy. General advice and guidance for relatives and employees and/or the employer of the INSURED PERSON if hospitalised abroad (NB: medical information will be divulged to the INSURED PERSON's next of kin only). In the event of an Emergency you must contact the 24/7 FirstAssist Operations Centre: Telephone: +44 (0)20 8763 4814 Facsimile: + 44 (0)20 8763 3035 (ii) Email address: international.ops@firstassist.co.uk (d) EXCLUSIONS INSURERS shall not be liable to pay any claim in respect of:(i) any EMERGENCY MEDICAL EXPENSES incurred:1. in the United Kingdom or in the INSURED PERSON’s Country of Domicile 2. without the prior consent of FirstAssist (ii) BODILY INJURY or SICKNESS which arises directly or indirectly from or in connection with or is aggravated by:1. childbirth 2. pregnancy within 2 months of the expected date of birth 3. an INSURED PERSON a. committing a criminal act b. taking part in civil commotion or riot c. committing or attempting to commit suicide or intentional self injury or being in a state of insanity d. taking drugs (unless taken in accordance with treatment prescribed by a registered qualified medical practitioner other than for drug addiction), suffering from solvent abuse or alcoholism 4. an INSURED PERSON engaging in military naval or air services or operations (other than reserve or volunteer training as a member of one of the officially recognised United Kingdom volunteer reserve forces) 5. an INSURED PERSON engaging in air travel other than as a passenger in a licensed passenger carrying aircraft operated by a licensed commercial air carrier or military aircraft and for no other purpose 5 AFCWS-2006 6. participating in any HAZARDOUS ACTIVITY other than WINTER SPORTS unless specifically shown on the SCHEDULE (iii) BODILY INJURY or SICKNESS which arises directly or indirectly from or in connection with or is aggravated by any gradually operating cause (iv) any expenses incurred if an INSURED PERSON is travelling or intending to travel against the advice of a qualified medical practitioner or for the purpose of obtaining medical treatment or medical advice (v) any expenses incurred for any pre-existing condition or ailment prior to the commencement of an INSURED JOURNEY (vi) any expenses incurred for Emergency dental expenses exceeding £100 (vii) any expenses incurred after twelve calendar months from the time of incurring the first expense (viii) any expenses incurred after the expiry of the PERIOD OF INSURANCE during which the INSURED PERSON attains 65 years of age (ix) any EMERGENCY TRAVEL EXPENSES incurred without the prior approval of FirstAssist (x) costs which a qualified medical practitioner has agreed can be delayed until after the INSURED PERSON has returned home (xi) the EXCESS as detailed in the Schedule. 8. SECTION B.2 – ACTIVITY EQUIPMENT (a) COVER If during the PERIOD OF INSURANCE and the OPERATIVE TIME OF COVER the INSURED PERSON sustains accidental loss or damage of ACTIVITY EQUIPMENT then INSURERS will indemnify the INSURED on behalf of the INSURED PERSON in respect of such loss or damage up to the amount stated in the SCHEDULE. (b) DEFINITIONS ACTIVITY EQUIPMENT: Specialist equipment specifically required for an INSURED PERSON to compete in WINTER SPORTS including skiwear, competition skis, biathlon equipment, rifles and associated equipment owned by an INSURED PERSON or for which an INSURED PERSON has specific responsibility. PAIR OR SET: Two or more items of ACTIVITY EQUIPMENT which are complimentary or used or worn together. UNATTENDED: ACTIVITY EQUIPMENT other than skis not left within sight and reach of an INSURED PERSON. (c) CONDITIONS (i) The INSURED PERSON shall take all reasonable precautions to prevent the loss, theft or damage of ACTIVITY EQUIPMENT. (ii) INSURERS shall be entitled to take and keep possession of any property and to deal with salvage of such following a loss under this Policy. (iii) INSURERS have the option to repair or replace any property damaged or lost for which they are liable but the payments shall not exceed the Limits stated below. (iv) Any claim for skis left UNATTENDED shall be restricted to 50% of the amount stated in the SCHEDULE and then only if it is proven that the skis were left in split locations. (d) EXCLUSIONS INSURERS shall not be liable for:(i) loss or damage due to moth vermin wear and tear atmospheric or climatic conditions or gradual deterioration mechanical or electrical failure or any process of cleaning restoring repairing or alteration (ii) more than:1. £500 for any one article or PAIR OR SET of any kind whether they are solely or jointly owned 2. £600 in total for skis, bindings, biathlon equipment and kit 3. 80% of the original purchase price for skis less than six months old 4. 70% of the original purchase price for skis more than six months old and less than one year old 5. 60% of the original purchase price for skis more than one year old and less than two year old 6. 40% of the original purchase price for skis more than two years old and less than three years old (iii) any claim for:1. skis over three years old 2. standard kit, baggage and personal possessions 3. ACTIVITY EQUIPMENT left UNATTENDED away from an INSURED PERSON’s accommodation or secure equipment store except for ACTIVITY EQUIPMENT left between 6.00 am and 11.00pm local time in the locked boot or covered luggage area of a motor vehicle where entry was gained by violent and forcible means 4. items more specifically insured elsewhere 5. documents of any kind (iv) losses not reported to either the police or transport carrier within twenty-four hours of discovery of loss (v) loss due to confiscation or detention by customs authority (vi) property belonging to the INSURED (vii) unsubstantiated losses (viii) the EXCESS as detailed in the SCHEDULE. SECTION B.3 – SKI PASS (This Section is only applicable if shown as OPERATIVE in the SCHEDULE and the appropriate premium has been paid) (a) COVER If during the PERIOD OF INSURANCE and OPERATIVE TIME OF COVER the INSURED PERSON suffers accidental loss, theft or destruction of a SKI PASS then INSURERS will indemnify the INSURED PERSON for such loss up to the amount stated in the SCHEDULE. (b) DEFINITIONS SKI PASS: Pre-booked and pre-paid skis pass permitting access to a ski area for a specified period of time. (c) CONDITIONS (i) The INSURED PERSON shall take all reasonable precautions for the safety of any SKI PASS. (ii) The INSURED PERSON shall take all reasonable steps to recover any SKI PASS lost or stolen. (d) EXCLUSIONS INSURERS shall not be liable for:(i) the loss, theft or destruction of a SKI PASS that is not:1. in the possession of an INSURED PERSON 2. locked in an INSURED PERSON’s accommodation 3. or deposited in a safe or safe custody box (ii) more than a pro rata proportion of the value of the SKI PASS for the remaining duration of period purchased originally (iii) any loss not reported to either the Police within twenty-four hours of discovery of loss (iv) loss due to confiscation or detention by the Police or local authorities (v) unsubstantiated losses (vi) the EXCESS as detailed in the SCHEDULE. 10. SECTION B.4 - PERSONAL LIABILITY (a) COVER INSURERS will indemnify an INSURED PERSON against legal liability for damages in respect of:(i) BODILY INJURY to any third party (ii) accidental loss of or damage to tangible property happening during the PERIOD OF INSURANCE and the OPERATIVE TIME OF COVER. INSURERS will also pay:(i) all costs and expenses recoverable by a claimant from the INSURED PERSON (ii) all costs and expenses incurred with the written consent of INSURERS (b) CONDITIONS No admission offer promise payment or indemnity shall be made without the written consent of INSURERS who shall be entitled to take over and conduct in the INSURED PERSON’s name the defence or settlement of any claim or to prosecute in the INSURED PERSON’s name for its own benefit any claim for indemnity or damages or otherwise and shall have full discretion in the conduct of any proceedings and in the settlement of any claim and the INSURED PERSON shall give all information and assistance as INSURERS may require. Every letter, claim, writ, summons and process shall be forwarded to INSURERS immediately on receipt. Written notice shall also be given to INSURERS immediately the INSURED PERSON shall have notice of any prosecution or inquest in connection with any circumstances which may give rise to liability under this Section. INSURERS may at any time pay to the INSURED PERSON in connection with any claim or series of claims the Limit shown in the SCHEDULE (after deduction of any sum(s) already paid) or any lesser amount for which such claim(s) can be settled and upon such payment being made INSURERS shall relinquish the conduct and control of and be under no further liability in connection with such claim(s) except for the payment of costs and expenses recoverable or incurred prior to the date of such payment. (c) EXCLUSIONS This benefit does not cover liability arising out of:(i) BODILY INJURY sustained by:1. the INSURED PERSON or any member of the INSURED PERSON’s family 2. any person who is under a contract of service with the INSURED PERSON and which arises out of and in the course of such person's employment with the INSURED PERSON (ii) loss or damage to property owned by or in the care custody or control of the INSURED PERSON his or her family the servants or agents or employees of the INSURED or INSURED PERSON (iii) the possession ownership or use of any land or buildings or out of the ownership of any animal (iv) the possession ownership or use of any mechanically propelled vehicle aircraft hovercraft, or watercraft (v) the possession ownership or use of firearms other than specific competition equipment AFCWS-2006 7 (vi) the INSURED PERSON’s criminal wilful or malicious act or omission or insanity or his or her being under the influence of intoxicating liquor or drugs (other than drugs taken in accordance with treatment prescribed and directed by a registered qualified medical practitioner other than for drug addiction) (vii) the INSURED PERSON’s trade business or profession (viii) any express term of any contract unless such liability would have attached to the INSURED PERSON notwithstanding such term (ix) any circumstances for which indemnity is provided under any other contract of insurance in the name of either the INSURED or the INSURED PERSON (x) the transmission of any communicable disease or virus.
