RECESS MEETING                                              APRIL 18, 2006

       BE IT REMEMBERED that the Mayor and Board of Aldermen of the City
of Pass Christian, Mississippi, met on the above date at 948 East Second Street, Pass
Christian, Mississippi, at 6:00 P.M.

      Present: Mayor Pro Tem Leo “Chipper” McDermott, Aldermen: Joseph
Piernas, Anthony Hall, Lou Rizzardi and Huey Bang; Deputy City Clerk Donna
Burgess, and Chief Administrative Assistant Malcolm Jones, Police Chief John
Dubuisson and Fire Chief Rich Marvil.


       Absent: Mayor Billy McDonald and Vikki Goff, City Clerk.

       There being a quorum present to transact business of the City of Pass
Christian; the following proceedings were had and done:

      On motion of Alderman Hall, seconded by Alderman Rizzardi, carried
unanimously, emergency was redeclared.

       On motion of Alderman Hall, seconded by Alderman Rizzardi, carried
unanimously, the agenda was amended to hear from Lieutenant Hess, U.S. Coast Guard
regarding debris removal from the waterways.

        On motion of Alderman Piernas, seconded by Alderman Rizzardi, carried
unanimously, request from Mike Pavlisick, Road Foreman, to get Mr. Edward Fournier a
cell phone to be used during working hours, due to the fact that he is the maintenance
man for the whole city, was approved.

      On motion of Alderman Piernas, seconded by Alderman Rizzardi, carried
unanimously, discussion of Execution of Order was tabled.

      On motion of Alderman Hall, seconded by Alderman Rizzardi, carried
unanimously, Home Depot locating an office in Pass Christian was discussed.

       On motion of Alderman Rizzardi, seconded by Alderman Piernas, the matter of
amending the agenda to allow Home Depot to locate on City of Pass Christian property
was tabled.

       Voting Aye: Alderman: Rizzard, Piernas and Bang.

       Voting Nay: Alderman: Hall.

      On motion of Alderman Hall, seconded by Alderman Rizzardi, carried
unanimously, appointing someone to fill the position on the Park Commission vacated by
Huey Bang was discussed.

      On motion of Alderman Bang, seconded by Alderman Rizzardi, carried
unanimously, Renee Brooks was appointed to fill the unexpired term vacated by Huey
Bang on the Park Commission.

        On motion of Alderman Piernas, seconded by Alderman Hall, removing
temporary sewer line from 1592 East 2nd Street or compensation for having the sewer line
on said property was discussed. Exhibit W-1.

        On motion of Alderman Rizzardi, seconded by Alderman Bang, carried
unanimously, City Attorney/Chief Administrator Malcolm Jones was authorized to
negotiate with the property owners of 1592 East 2nd Street, regarding temporary sewer
lines crossing said property

        On motion of Alderman Rizzardi, seconded by Alderman Bang, a third meter
reader for WPSCO was tabled.

       Voting Yea: Alderman: Rizzardi, Piernas and Bang.

       Voting Nay: None.

       Abstaining: Alderman Hall.

       On motion of Alderman Piernas, seconded by Alderman Rizzardi, carried
unanimously, the recommendation from John Campton, City Engineer, to approve the
proposed change order number 3, in the total amount of $8,400.00, for water service for 5
houses on Highway 49, was discussed and accepted. Exhibit W-7.

       On motion of Alderman Hall, seconded by Alderman Rizzardi, carried
unanimously Project Agreement and attachments for Natural Resources Conservation
Service removal of debris from certain ditches was approved and proper signatures were
authorized. Exhibit W-8.

        On motion of Alderman Piernas, seconded by Alderman Rizzardi, carried
unanimously, repair of Road Department truck, in the amount of $2168.00, by Rocking C
Truck Sales, was ratified.
This is the only truck public works has. Exhibit PW-1

         On motion of Alderman Hall, seconded by Alderman Rizzardi, clarification of
lateral transfer of Philip T. Piernas from Harbor Patrol to Code Inspector with regard to
salary was discussed. Exhibit C-1.

       Alderman Piernas recused himself

       Voting Nay: None.

        On motion of Alderman Hall, seconded by Alderman Bang, request from Philip
T. Piernas for payment of mileage or issuance of a Fuelman card for use with his personal
vehicle was discussed. Exhibit C-2.
Alderman Piernas recused himself

       Voting Aye: Aldermen: Rizzardi, Hall and Bang.

       Voting Nay: None.

       Motion carried.

       On motion of Alderman Hall, seconded by Alderman Bang, payment for mileage
was approved for Philip T. Piernas, for use of his personal vehicle to conduct business for
the Pass Christian Code Department, and that Philip T. Piernas is to be issued a City
vehicle to be used while conducting City business and said vehicle is to be parked at the
Code Department when not in use.

Alderman Piernas recused himself

       Voting Aye: Aldermen: Rizzardi, Hall and Bang.

       Voting Nay: None.

       On motion of Alderman Hall, seconded by Alderman Piernas, carried
unanimously, refund check from Puckett, in the amount of $20,000.00 was accepted.

       On motion of Alderman Hall, seconded by Alderman Piernas, carried
unanimously, SBA was authorized to use building behind Code office to assist citizens of
Pass Christian/Long Beach, and the City Attorney is authorized to obtain an agreement.

       On motion of Alderman Hall, seconded by Alderman Bang, carried unanimously,
matter of paving Bielenberg Street was discussed.

       On motion of Alderman Hall, seconded by Alderman Rizzardi, carried
unanimously, discussion was held regarding having the City assist citizens with demo of
housing that FEMA would not allow the Corps of Engineers to demo.

       On motion of Alderman Piernas, seconded by Alderman Bang, Public Works
Department to assist citizens with demo of housing that FEMA will not allow the Corps
of Engineers to demo was tabled.

       Voting Aye: Alderman Rizzardi, Piernas and Bang.

       Voting Nay: Alderman Hall.

       Motion carried.

      On motion of Alderman Rizzardi, seconded by Alderman Piernas, carried
unanimously, 4 way stop on the corner of Fleitas and Second Street was discussed.

        On motion of Alderman Rizzardi, seconded by Alderman Piernas, the agenda
item to consider a 4 way stop on the corner of Fleitas and Second Street was amended to
include authorizing Chief Dubuisson and City Engineer to study same.

       Voting Aye: Alderman Rizzardi and Piernas.

       Voting Nay: Alderman Hall.

       Abstained: Alderman Bang.

       Motion carried.

        On motion of Alderman Hall, seconded by Alderman Rizzardi, carried
unanimously, payment to Arnold Electric Company, in the amount of $205.00, for
electrical work at Gospel Singers of America was approved.

        On motion of Alderman Hall, seconded by Alderman Bang, carried unanimously,
City Attorney/Chief Administrator Malcolm Jones gave an update on Cedar Avenue
water tower.

      On motion of Alderman Bang, seconded by Alderman Rizzardi, carried
unanimously, of April 25 was moved to April 26, 2006.

      On motion of Alderman Rizzardi, seconded by Alderman Bang, carried
unanimously, waiving utility bill for Gospel Singers was discussed.

         Motion of Alderman Rizzardi to waive utility bill for Gospel Singers died due to
lack of second.

       Voting Aye: Alderman: Rizzardi.

       Voting Nay: Alderman: Piernas, Bang and Hall.

      On motion of Alderman Piernas, seconded by Alderman Bang, carried
unanimously method of extending hours for Code Office was discussed.

       On motion of Alderman Piernas, seconded by Alderman Rizzardi, carried
unanimously, Gene Peralta, Code Department Manager, was authorized to extend the
hours of the Code Department on a trial basis.

       On motion of Alderman Hall, seconded by Alderman Piernas, carried
unanimously, request from Willie Mae Johnson to bring a house trailer to her property
located at 365 Davis Avenue was discussed.

       On motion of Alderman Hall, seconded by Alderman Rizzardi, R.O.W. survey
along Second Street was discussed.

       Motion of Alderman Rizzardi to request Code Officer to enforce ordinances
regarding R.O.W. died for lack of second.

      On Motion of Alderman Rizzardi, seconded by Alderman Piernas, carried
unanimously, vacating that part of West Second Street platted R.O.W. between Church
Avenue and Henderson Avenue was tabled.

       On motion Alderman Rizzardi, seconded by Alderman Piernas, lease agreement
with Robert and Shelly Bentz for temporary T-ball field was approved, with no rent to be
paid by City and the City to provide liability insurance coverage. Exhibit A-16.

       Alderman Hall abstained from voting.

       Voting Aye: Alderman: Rizzardi, Piernas, Bang

       Voting Nay: None

      On motion of Alderman Piernas, seconded by Alderman Rizzardi, carried
unanimously, May 7-13, 2006 was declared Goodwill Industries Week. Exhibit A-19.

       On motion of Alderman Piernas, seconded by Alderman Rizzardi, carried
unanimously, proposals for drop off fee for new site closer to City limits for abandoned
vehicles and vessels was discussed.

         On motion of Alderman Piernas, seconded by Alderman Rizzardi, Proposal for
drop off fee for new site closer to City limits for abandoned vehicles and vessels was
approved and item 19 on the agenda was amended to include Meaute Road for drop off
site for larger vehicles.

       Voting Aye: Alderman: Rizzardi, Piernas, Bang.

       Voting Nay: Alderman: Hall.

Motion carried unanimously.

      On motion of Alderman Piernas, seconded by Alderman Rizzardi, carried
unanimously, April 23-29, 2006, was proclaimed Gulf Coast Crime Victim’s Rights
Week.

       On motion of Alderman Hall, seconded by Alderman Rizzardi, claims docket was
approved, with the claims to Harrison County Waste to be held.

       Alderman Hall abstained from voting

       Voting Nay: None

        On motion of Alderman Hall, seconded by Alderman Rizzardi, rates for Pass
Christian Harbor will remain the same as prior to Hurricane Katrina.

       Alderman Hall abstained from voting.

       Voting Aye: Alderman Rizzardi, Piernas and Bang.

       Voting Nay: None.

       Motion carried.

       On motion of Alderman Rizzardi, seconded by Alderman Piernas, carried
unanimously, sending someone to Planning and Development Conference, April 25-28,
2006 in Tunica, MS was discussed.

       On motion of Alderman Rizzardi, seconded by Alderman Hall, Alderman Piernas
and a designee to be appointed by the Mayor, was authorized to attend the Planning and
Development Conference, April 26-28, 2006 in Tunica, MS. Cost to include lodging and
$310.00 for registration.

       On motion of Alderman Hall, seconded by Alderman Rizzardi, the meeting was
recessed until April 26, 2006.
