VACATION RENTAL AGREEMENT
This Vacation Rental Agreement (the “Agreement”) is made as of Jan 1, 2000 (the “Effective Date”) by and between OBC Property Management LLC and XXX (the “Renter”) for the rental of the house (the “Property”) located at 42 Trimingham Lane, Rosemary Beach, FL 32413. RENTAL PERIOD. Your arrival date is Nov 4 and your departure date is Nov 14 (the “Rental Period”).
BASE RENTAL CHARGE. 7% FLORIDA SALES TAX. 4% COUNTY BED TAX. TOTAL CHARGES. SECURITY DEPOSIT.

ADVANCE RENT DEPOSIT. A rent deposit of 50% of the Base Rental Charge (excludes Sales Tax and Bed Tax and Security Deposit). We will process this deposit by use of Visa, MasterCard, American Express or Discover. The remaining balance (Total Charges + Security Deposit – Advance Rent Deposit) is due 14 days prior to your arrival and payable by check, money order, cashier’s check or credit card. SECURITY DEPOSIT. The Security Deposit of $600 may be applied to Renter’s damage to the Property and its contents (if any) or other Renter’s breach of this Agreement. The Owner will endeavor to promptly return the Security Deposit provided that all rules and regulations stated herein were observed. CANCELLATIONS AND REFUNDS. The Advance Rent Deposit will not be refunded unless the Property is re-rented for the same Base Rental Charge and Rental Period reserved by the Renter. If refunded, there will be a $100.00 cancellation fee withheld from the Advance Rent Deposit. Refunds of the Advance Rent Deposit and/or the Total Charges will not be given for late arrivals, early departures or inclement weather conditions. In the event of a hurricane, refunds will be made only in the event of a mandatory evacuation by governmental authorities. Refunds will be granted for the period of the issuance of the mandatory evacuation. Important Information About Your Stay
Please read carefully the following information about the Agreement and your stay.
CHECK IN / CHECK OUT. Check-in is after 4 pm CST on the first day of the Rental Period. Check-out is before 10 am CST on the last day of the Rental Period. PARKING. A 2-car parking pad is provided on the Property. Additional parking is available at the tennis courts or in the Town Center. Recreational Vehicles, Boats, Trailers and Jet Skis are not allowed to park on the property. MAINTENANCE. Please report any maintenance needs for the Property to our Property Manager. While we apologize for any inconvenience of a mechanical failure or utility outage, we will not be able to offer a discount or refund. LINENS/TOWELS/SUPPLIES. Although linens are furnished, please bring your own beach towels and blankets, as linens are not to be removed from the house. Any lost or damaged linens will be deducted from the Security Deposit. An initial supply of paper products, trash liners, bathroom tissue and soap is provided. ENTRY BY OWNER. Owner or Owner’s agents may enter the Property under the following circumstances: in case of emergency; to make any necessary repairs. Owner will notify renter with at least 24 hours notice of Owner’s intent to enter except in case of emergency. RULES AND REGULATIONS. The Security Deposit may be forfeited and the Renter may be asked to vacate the Property immediately, with no refund for a breach of this Agreement, which includes the failure to follow the rules below. 1. Smoking of any kind in the Property or from the decks is prohibited. 2. Pets are NOT allowed in the Property or on the site. 3. Large house parties or excessive noise are not allowed. 4. The number of people staying on the Property may not exceed 10. 5. Do not have or use fireworks, firecrackers on the Property or on the site. 6. No furnishings or equipment from the Property may be taken to the beach or off site. 7. Do not leave windows and doors open while the air conditioning is on; as this may cause the HVAC units to freeze up and not work properly. 8. All applicable laws as well as Rosemary Beach neighborhood association rules and covenants must be observed. ADULT ONLY RENTAL. The Property will not be rented to vacationing students or singles under the age of 25, unless accompanied by and adult guardian or parent who remains on the Property for the duration of the stay. Reservations made under false pretenses will be subject to forfeiture of all monies paid. CONSTRUCTION. As you look forward to your vacation with us at Rosemary Beach, we would like to remind you that Rosemary Beach is a growing town and while in the final phase of construction, there are still parts that are under construction. Specifically, there is a home under construction down the street from us and Rosemary is adding to the Town Center. There will be no refunds given due to the status of construction around the Property. POOL AND PROPERTY SAFETY. As the pool on the Property is private, there are no lifeguards on duty. For the safety of all, the Renter must keep the pool area secured at all times to prevent unaccompanied children and non-swimmers from access. All pool, deck, steps and other areas of the Property can be slippery when wet. Renter (and Renter ensures that his or her guests) will take responsibility for their own safety, by among other things limiting alcohol intake and watching where they place their feet. The Renter assumes the responsibility that Renter and all guests will strictly observe all pool rules, which forbid any diving, jumping or running around the pool. The Renter understands and assumes the risk that failure to abide by safety rules is a breach of this Agreement and can cause serious injury or death. KEYS. After receipt of the Total Charges and Security Deposit, the Owner will provide the code to the lockbox on Property containing keys. TELEPHONES. The Property contains 7 telephones with free local and nationwide long distance calling. WIFI INTERNET. The Property contains equipment that uses the WiFi standard (802.11b and 802.11g). You will need to bring your own laptop and it will need to have built-in WiFi or a WiFi card. Most WiFi equipment will be compatible. However, we can make no guarantees as to compatibility of your equipment. NO ASSIGNMENT OR SUBLETTING. Renter may not assign or sublease all or part of this Agreement. LIMITATION OF LIABILITY. To the maximum extent allowed by the law, Owner is not liable for Renter’s property left behind or for any consequential, incidental, special, punitive, exemplary or indirect damages from any cause whatsoever, regardless of whether they were foreseeable. Owner’s maximum aggregate liability arising out of the rental of the Property to Renter is limited to the amount of rental fees paid by Renter during the Rental Period. The Owner is not undertaking to provide any security and is not responsible for any loss or theft of the Renter’s property. INDEMNIFICATION. To the maximum extent allowed by the law, the Renter agrees to indemnify, hold harmless, and at the Owner’s option, defend the Owner and its officers, members, contractors and representatives from all liabilities, claims, actions, damages, costs, and expenses that Renter or Renter’s guests may have or bring against any one or more of the Indemnified Parties or that arise from the Renter’s rental of the Property under this Agreement, including any Claims based on negligence, action, or inaction of any of the Indemnified Parties. GOVERNING LAW. This Agreement will be governed by the laws of Florida, without regard to conflicts of law principles. COMPLETE AGREEMENT. This Agreement contains the entire agreement between the parties and there are no other promises, terms or conditions, whether oral or written, other than contained herein. This Agreement may be modified only in a writing signed by both parties.
