.3   INCLUSION IN BID

     This bid includes the removal of all “designated substances” as identified in the Designated
     Substance Report, prior to any work on site proceeding, the removal of the building additions
     as shown on the elevation drawing and as shown hatched on the plans. The bid includes the
     Selective Demolition as identified in Section 02222 of the Specification and the additional
     work as illustrated on the drawings provided. The bid includes the work required by a
     qualified electrical tradesman or electrical contractor (as appropriate), the work required by a
     qualified mechanical tradesman or mechanical contractor (as appropriate) and the work
     required by a qualified excavator or excavating contractor (as appropriate) all as described in
     the Tender Documents. The work includes the relocation of the existing, water meter and
     water service coming into the building, the permanent protection of the existing electrical
     service and the temporary protection of major building features such as the existing main
     stairs, boiler, H.W.T.‟s, baseboard heaters, wood base, cornice, plaster and woodwork or trim
     surrounding the existing doors and windows of the original house.

     If I/we the undersigned, receive written notification of the acceptance of this bid within thirty

1.1    QUALIFICATIONS OF BIDDERS
       .1     Bidders submitting a Bid may be requested to submit a “Contractor‟s Qualification
              Statement” (CCDC 1996) as part of the Tender review process. The Owner /
              Construction Manager reserves the right of interpretation of qualification information
              and any decisions made by the Owner / Construction Manager based upon its findings,
              which may affect the award of the Contract, shall be final.


1.2    COMPLIANCE
       .1     In submitting a bid, the bidder agrees to comply with all requirements of the
              Instructions to Bidders.
       .2     Failure to comply with any of the requirements of the Instructions to Bidders may
              cause a bid to be declared informal and such bid may be rejected, at the discretion of
              the Owner / Construction Manager.


1.3    TENDER DOCUMENTS
       .1     The following documents form the basis of this bid and shall be considered by
              bidders:

1.4    SCOPE OF WORK
       .1     The scope of this Contract is to complete the Demolition portion of the work only,
              including careful removal of some of the more recent building additions and selective
              demolition on the interior of the remaining building.
       .2     The Owner intends to undertake capital expenditures following this “Demolition
              Contract”, for Renovations and Alterations to the existing facility, referred to as
              “Bradburn House”, 293 London Street, Peterborough, Ontario. These Renovations and
              Alterations will result in a rental apartment complex providing up to 17 affordable
              housing units.
       .3     The work in this contract includes the abatement procedures to remove all toxic
              materials and identified designated substances for the purpose of making the site
              environmentally safe prior to the commencement of the actual Building Removals and
              Selective Demolition work. Bidders are to refer to the Designated Substances Survey.
              All work is to be in accordance with the authorities having jurisdiction.
       .4     Following the abatement procedures and the removal of all toxic materials and
              identified designated substances, the work in this contract also includes the removals
              of all additions to the original building, walls, doors, fixtures, and equipment as shown
              on the drawings and as otherwise described herein.


1.5    SITE CONDITIONS
       .1     The site is located at 293 London Street, Peterborough, Ontario.
       .2     Before submitting a bid, examine the site to fully ascertain existing conditions,
              circumstances and limitations affecting the work. No allowances will be made for
              additional costs arising out of failure to investigate existing conditions.
       .3     The original building is considered to be of historic and architectural significance,
              containing building features worthy of careful preservation and restoration.
       .4     The building is considered to be three (3) stories plus a basement in the Ontario
              Building Code.
       .5     The original building is masonry with wood frame interior partitions and floors. The
              other portions of this building, which include recent additions, are wood framed, some
              with brick veneer.

       .6     A site visit is scheduled for viewing on Friday, August 14, 2009 at 10:30 a.m. Please
              meet at the west side entrance in the parking lot at 293 London Street, Peterborough.


1.6    DEMOLITION PERMIT
       .1     Owner will apply for and pay for the demolition permit.


1.7    BID AND PERFORMANCE SECURITY

1.9    CLARIFICATION
       .1     Architect, Owner and Construction Manager will not be responsible for oral
              instructions.
       .2     Report to the Construction Manager all discrepancies, omissions, errors, departures
              from building by-laws or good practice, and points considered to be ambiguous or of
              dubious intent, so that the Construction Manager may, if he considers it necessary,
              issue instructions by addendum to all bidders prior to the bid closing date.
       .3     All addenda issued during the bid period shall become part of the bid documents and
              their receipt shall be acknowledged in the space provided on the Bid Form.
       .4     Direct questions arising during the bid period to the Construction Manager. All
              requests should be sent in writing via fax no later than five (5) working days
              prior to the tender closing.


1.10   SUBMISSIONS OF TENDERS

       .2     Fill in all blank spaces on the Bid Form, identifying the Appendices in ink, or
              typewritten, providing the information requested therein and ensure that all forms are
              signed by an authorized person or persons. Incorporated companies must affix their
              corporate seal under the signature of their authorizing signing officials.


1.11   TENDER ACCEPTANCE
       .1     Bids not received by the time stated for this submission may not be considered and
              may be returned unopened at the discretion of the Owner / Construction Manager.
       .2     Bid opening will not be public.
       .3     Incomplete or conditional bids may be rejected.
       .4     Lowest or any bid will not necessarily be accepted.
       .5     Bids shall be irrevocable and open to acceptance by the Owner / Construction
              Manager for a period of THIRTY (30) days from the date stated for their submission.
       .6     Owner / Construction Manager reserves the right to reject any and all Bids and Cancel
              the Project without notification should the Tender Results exceed the Owner /
              Construction Manager‟s budget and / or the Owner / Construction Manager being
              unsuccessful in securing sufficient funding to proceed with the construction of the
              project.


1.12   TENDER ANALYSIS
       .1     Within three (3) working days of notification by the Construction Manager, and prior
              to award of the Contract, the low bidder or bidders shall submit a Contractor‟s
              Qualification Statement (CCDC 1996) and a breakdown of the Bid Price as directed
              by the Construction Manager.
       .2     Requests for additional information shall in no way be construed as acceptance of a
              bid nor shall it affect the irrevocability of the bid for the time period stipulated.


1.13   GOODS AND SERVICES TAX (G.S.T.)
       .1     The Goods and Services Tax (G.S.T.) shall not be included in the “Stipulated Price”
              and will be identified separately on the Bid Form, calculated at five percent (5%) of
              the stipulated sum Tender amount.

1.14   DEFINITIONS
       .1     Where the word “provide” is used in these Tender Documents, it shall mean “supply
              and install” unless specifically and clearly indicated otherwise.
       .2     Wherever the words „acceptable”, “approved”, “reviewed”, “satisfactory”, “directed”,
              “selected”, “designated”, “required”, “submit”, “instructed”, “permitted‟ or similar
              words or phrases are used in the Tender Documents or referenced standards, it shall be
              understood, that “by” or “to” “the Consultant” follows, unless context clearly provides
              otherwise. All submissions for “acceptance”, “approval”, “review”, etc. “by” or “to”
              the Consultant shall be made through the Construction Manager.


1.15   TEMPORARY FACILITIES AND SERVICES
       .1     One existing washroom in the building is to remain and will be designated as a
              washroom to be used throughout the construction period. It is to remain available for
              the Contractor‟s use throughout the construction period. Maintain facilities in a clean,
              tidy and sanitary condition. Provide own paper products, as required.
       .2     The existing main power supply to the building is to remain. Be responsible for setting
              up all temporary power and lighting for this Contract, as required for completion of
              the demolition work this Contract. Power consumption will be paid for by the Owner
              if used responsibly.
       .3     The existing water supply to the building and existing sanitary and storm sewage
              systems, removing waste water from the building and property, are to remain
              throughout the construction period. Payment for water usage, used responsibly by the
              Contractor, will be paid for by the Owner.
       .4     Existing rooms, not affected by the demolition this Contract may be used by the
              Contractor, at no cost, for office space and for the storage of materials and tools.
       .5     The Contractor is to provide a temporary on site telephone or cell phone, whereby the
              Contractor may be reached at all times, within reason, by the Owner / Construction
              Manager and Architect.
       .6     Provide temporary fencing consisting of a 1.8m high metal hoarding to control access
              to and from the site. The fencing / hoarding will be required across the front (north
              side) and west side of the building only, secured to this existing accessory building at
              the rear of the property and extending to the top of the embankment / tree line to the
              east along the front of the property.

       .7     Provide for the supply, erection and removal of temporary site fencing / site hoarding,
              with access gates as indicated on the site plans, or as required by the Ministry of
              Labour and the City of Peterborough.


1.16   RECYCLE AND RE-USE
       .1     Carefully remove all existing materials, fixtures and equipment as shown.
       .2     Wherever possible, reuse existing materials, fixtures and equipment on this site. Store
              for later reuse at discretion of Owner / Construction Manager: otherwise remove from
              the site.
       .3     If removed from the site, contact “ReStore”, at 780 Erskine Avenue in Peterborough, a
              retail outlet for recycled materials, operated by Peterborough and District Habitat for
              Humanity, at (705) 742-8572. Enquire if these are materials they can use; and then
              arrange for pickup by ReStore and co-operate with the pickup by ReStore (if materials
              can be used by them).
       .4     Contractor is encouraged to salvage all materials, and to make materials available to
              others who might be able to use materials, or offer materials to a recycling outlet, prior
              to removing materials to a land fill site. Materials that cannot be used by ReStore,
              cannot be sold or given away, and cannot be re-used are to be removed from the site.


1.17   PROJECT CONTROL
       .1     Construction will be carried out under a Construction Management System with the
              successful Demolition Contractor entering into a contract with the Owner arranged by
              the Construction Manager on behalf of the Owner.
       .2     The Construction Manager for the purpose of this Contract will be considered the
              General Contractor.
       .3     The Construction Manager will co-ordinate all Contractors in the implementation of
              the overall construction process.
       .4     The Construction Manager will assign a Site Supervisor to be on site at all times
              during construction.
       .5     The Construction Manager will submit a Notice of Project to the Ministry of Labour.
       .6     Direct all queries to the Site Supervisor.

1.18   DRAWINGS
       .1     Upon award of contract, successful bidder will be provided with sufficient sets of
              documents, as is deemed reasonably required for construction.


1.19   SCHEDULE
       .1     The contractor must provide sufficient manpower and equipment to complete their
              work within normal working hours. The normal working hours on site are from 7:00
              a.m. to 5:00 p.m. Mondays to Fridays. No weekend work or evening shifts will be
              permitted unless specifically requested and co-ordinated with the Construction
              Manager.
       .2     Work is to commence by mid September 2009 and is to be completed eight (8) weeks
              later, in November 2009.
       .3     A detailed schedule, showing how the contractor anticipates completion in the
              scheduled time above, is to be submitted within five (5) working days of award of the
              contract.
       .4     The first Construction Project meeting, is to be held within the first week of
              commencement; and will be held at least every two (2) weeks thereafter, and more
              often if deemed required, at the discretion of the Owner / Construction Manager.


1.20   FORM OF CONSTRUCTION CONTRACT
       .1     The Construction Contract between the Owner and the Contractor is The Standard
              Construction Document CCA 17, 1996 (Reprinted 1999), Stipulated Price Contract for
              Trade Contractors on Construction Management Projects, consisting of the
              Agreement, Definitions and General Conditions.
       .2     Bidders are expected to be familiar with the content of The Standard Construction
              Document CCA 17, 1996, Stipulated Price Contract. If Bidders require a review of the
              document, the document can be viewed at the office of the Construction Manager,
              located at 781 O‟Brien Drive, Peterborough, Ontario, and on line on the website of the
              architect at www/gregggordonarchitect.ca. Alternatively,
       .3     A contract may be arranged by Purchase Order by the Construction Manager, at the
              discretion of the Owner.

PART 1 – GENERAL
1.1    General Instructions
       .1     The general intent is to completely remove all materials shown on the drawings to be
              removed from the site, including designated substances identified in the Designated
              Substance Report.
       .2     Include all equipment necessary (cranes, conveyors, hoists and scaffolds, garbage
              chutes) and disposal bins.
       .3     Prior to any work beginning on site, the site must be cleared of all “designated
              substances”, as identified in the Designated Substance Report and found acceptable by
              the Environmental Engineer. See 1.4, this Section.
       .4     Materials removed from the building are to be removed in such a manner that they can
              be re-used. In the first instance, removed materials are to be salvaged for the Owner
              and stored in the two sheds at the back of the property (south side). In this first
              instance the Owner will elect to re-use the materials, give the materials away for free
              or sell the materials by auction. In the second instance the Owner may relinquish their
              interest in the material in which case the contractor may offer the materials for pickup
              by ReStore at 780 Erskine Avenue in Peterborough, 705 -742-8572. If ReStore cannot
              accept the materials, the materials may be sold or given away for use by others. Only
              those materials that cannot be sold or are not taken away from the site by others are to
              be taken to the Peterborough Landfill site, Bensfort Road in Otonabee – South
              Monaghan Township, this Contract, where the materials are to be sorted for recycling,
              as directed at that location. Metals to be recycled may be taken to a local
              independently operated metal recycle business.
       .5     Include the removal of all rubble and debris and to legally dispose of these materials
              off-site, and to the regulations of authorities having jurisdiction.
       .6     Co-operate and co-ordinate the access, hoisting and scheduling of selective interior
              demolition works with the Construction Manager and other Contractors.
       .7     Provide and co-ordinate the installation of temporary covers, railings, supports and
              other protection as required and as directed by the Construction Manager.
       .8     Provide all measures to ensure the structural integrity of the existing facility and
              ensure the safety of all personnel on site.

       .9     If any existing features noted to remain are damaged, restore it to the original
              condition or as directed.
       .10    Protect all the existing building features to remain as noted in the documents and in
              accordance with applicable local regulations.
       .11    Unless specifically noted, carefully remove, clean, store and turn over to the Owner /
              Construction Manager any material / equipment that is specified to be salvaged. The
              decision on the items to be recycled / re-used will be determined at a pre-Construction
              Site meeting on the basis of possible final condition of the materials.
       .12    Where existing structures or walls are noted to be removed or new openings are to be
              made in the existing structure, include for shoring and bracing as required to safely
              support the existing structure (walls and floors) until new structural elements are
              installed in place. Include for needling and pinning as required for the installation of
              new lintels in existing walls. Provide demolition shop drawings with temporary
              support system, stamped by a Professional Engineer, where required.
       .13    Include for providing weatherproof partitions / enclosures for all exterior openings
              when existing structures / windows are removed. Co-ordinate the work with the
              Construction Manager and prevent all unauthorized accesses through the new
              openings.
       .14    Locate / cap all utilities entering / exiting the building as required.
       .15    All cutting and patching required by the mechanical and electrical trades, to be
              provided by this Demolition Contractor, unless specifically noted otherwise.


1.2    Work Included
       .1     Designated substance removal is part of this package. Designated Substance Removal
              is to be carried out by pre-approved and qualified sub-contractors, of this contractor,
              as part of the work this contract.
       .2     All interior selective demolition work as indicated on the drawings.
       .3     All exterior demolition work as indicated on the drawings.
       .4     Retain the services of a qualified electrician or electrical sub-contractor, as part of this
              Contractor‟s workforce.

       .5     Retain the services of a qualified plumber or plumbing sub-contractor, as part of this
              Contractors workforce.
       .6     Retain the services of a qualified pipe fitter / heating sub-contractor, as part of this
              Contractor‟s workforce.
       .7     Provide temporary lighting in all rooms and areas, throughout the existing building.
              Existing fixtures may be used for temporary lighting as is, if undisturbed by the work
              of this phase, or re-wired as required, this Contract. Carefully remove all other lighting
              fixtures, this contract, for re-use, at the discretion of the Owner / Construction
              Manager: otherwise remove from the site as per the Instructions to Bidders and item
              1.1, General Instructions, this Section.
       .8     Provide temporary power, as required in all rooms and areas, throughout the existing
              building, sufficient for power tools and other power requirements. Provide new
              temporary distribution panels, re-use or re-connect existing distribution panels, as
              required and as necessary. Remove all existing surface mounted wiring throughout the
              building. Remove all surface mounted power outlets, controls, switches, and other
              minor electrical devices.
       .9     Existing main power to the building is to remain. The main Basement Level electrical
              equipment and all components in the present Electrical Room are to remain as existing
              and are not to be modified, this Contract. Retain the existing wiring from the present
              Electrical Room to the distribution panels. See also 1.5 this Section.
       .10    Existing exit lighting, fire pull stations, bells, horns, and other similar fire alarm
              equipment, not affected by the work of this contract, and not affected by the removal
              of walls, may remain as existing. Fire alarm equipment, early warning and safety
              equipment affected by the work of this contract, is to be carefully removed this
              contract for re-use at the discretion of the Owner / Construction Manager: otherwise
              remove from site as per the Instructions to Bidders and item 1.1, General Instructions,
              this Section.
       .11    Existing battery and emergency light packaged units are to be left in place, unless
              specifically identified on the drawings to be removed, or they have to be removed due
              to the removal of supporting walls.
       .12    Existing electrical baseboard heating and small wall fan heaters are to be left as
              existing, except where specifically identified on the drawings to be removed.

       .13    Remove the existing fresh air make-up air system and heat recovery units, providing
              fresh air to the corridors.
       .14    Except as noted below, carefully remove all existing plumbing fixtures including
              toilets, wall hung sinks, vanity sinks, kitchen sinks, urinals, baths, showers, and other
              similar plumbing fixtures, for reuse on this site or sale, at the discretion of the Owner /
              Construction Manager: otherwise fixtures are to be taken to ReStore in Peterborough.
              Take only to land fill site if fixtures are unsuitable for re-use on this site or by others.
              All existing plumbing to and waste lines from all removed plumbing fixtures are to
              remain, for the purpose of the Tender. All existing plumbing to and waste lines from
              all removed plumbing fixtures are to be further examined following removal of the
              fixtures to determine their potential for re-use. Remove or retain as directed at that
              time. A Contemplated Change Notice will be issued at that time if the existing
              plumbing is to be removed. Existing plumbing vent stacks that can be re-used, due to
              their location, and are buried within existing walls to remain, may remain in place for
              later re-use at the discretion of the Owner / Construction Manager. Remove all
              plumbing from the site as per the Instructions to Bidders and item 1.1, General
              Instructions, this Section.
       .15    Remove all existing non-load bearing partition walls, as shown on the drawings to be
              removed.
       .16    Remove all drapery, closet rods, shower curtains, shower curtain rods, blinds, tracks
              and valances.
       .17    Except as otherwise noted, remove all millwork, shown dashed on the drawings or
              identified on the drawings to be removed.
       .18    Remove all towel bars, washroom accessories, medicine cabinets, and similar items
              and store for re-use this project, at the discretion of the Owner / Construction
              Manager: otherwise remove from the site as per the Instructions to Bidders and item
              1.1, General Instructions, this Section.
       .19    Carefully remove the existing wood stairs and railings, where noted on the drawings
              between the first floor and the third floor levels. Where full flights of stairs can be
              removed, offer flights of stairs to ReStore. Offer railings and balusters to ReStore, as
              well. Do not disturb the existing main wood stair, which is to remain.
       .20    Protect and maintain the existing plaster wall and ceiling finishes in the original home.

       .21    Carefully remove existing doors and hardware. Store for later re-use in the building, at
              the discretion of the Owner / Construction Manager: otherwise offer to ReStore, offer
              for re-use, sell or otherwise, remove from site as per the Instructions to Bidders and
              item 1.1, General Instructions, this Section.
       .22    Except as otherwise noted, existing windows, existing wood sills and casings and
              stained glass windows are to remain. Protect existing windows and adjacent surfaces
              and features, as required, from damage this Contract.
       .23    Remove all lay in 2‟ x 4‟ ceiling panels and grid.
       .24    Remove all washroom exhaust grilles, washroom exhaust ducting and exhaust
              equipment.
       .25    Remove all existing portable fire extinguishers.
       .26    Remove all signage, directories, identification plates, name plates, bulletin boards,
              mirrors, and other similar features hanging on and secured to the walls.
       .27    Remove all supply air diffusers, ducting, related heat recovery equipment, wiring and
              controls.
       .28    Remove existing Security Alarm and Door Alarm Systems, including all equipment
              and wiring.
       .29    Protect and maintain, except where otherwise indicated on the drawings, existing fire
              alarm system, including pull stations, horns / bells, detectors and end of line resistors.
       .30    Remove thermostats. Remove switches, controls and plugs where indicated on the
              drawings. Remove speakers. Remove all surface mounted conduit, wiring and wire
              mould.
       .31    Except as otherwise noted, retain existing telephone system and telephone wiring
              throughout.
       .32    Remove carpeting, and sheet vinyl flooring, generally throughout.
       .33    Existing electrical distribution panels, unless otherwise indicated, are to remain.
       .34    Remove all existing appliances, including stoves and under the counter refrigerators.
       .35    Remove all debris and leave the building and site in a safe, clean, tidy and dry
              condition.

       .36    Remove the existing wood stairs that extends from the first floor level to the third
              floor level, including all flights of stairs, handrails, guard rails and intermediate
              landings between the main floor levels. Provide a protective guard across all openings
              to floor areas at 42” height and ensure that floor construction is sound along all newly
              exposed edges. Extension of existing floors across openings at the second and third
              floor levels, by others.
       .37    Remove the existing brick chimney extending up presently from the roof about .750
              mm, to a point below the finished roof structure. Provide a new roof structure and
              asphalt shingle roof to match the adjacent surfaces and ensure that the area is
              watertight.


1.3    Work Not Included
       .1     Demolition of site features, paving, trees etc, by others as required.
       .2     Removal and re-location of existing major mechanical and electrical equipment and
              devices in renovated areas as identified in 1.2 this Section.
       .3     Removal of existing roofing.
       .4     Removal of any structural elements, shown shaded on the drawings. Except as
              otherwise noted above, the removal of any exterior walls, insulation or finishes as well
              as the removal of any interior partitions shown in solid line on the drawings.
       .5     Removal of the existing white marble fire place mantel, frontal cover piece and metal
              cover plate. This work to be performed “by Others”. DO NOT disturb marble or metal
              finishes.


1.4    Report by Environmental Engineer
       .1     A Designated Substance Report has been prepared by Building Survey Consultants of
              Mississauga, Telephone No. 905-569-3340. Contact Mr. Dan Panzer, Environmental
              Engineer.
       .2     Upon completion of this abatement work, the Owner will retain the services of the
              Environmental Engineer to review the site and to provide a letter of acceptance,
              stating that there are no longer any materials on site that would potentially be
              dangerous to or unhealthy for a site worker.

       .3     The Owner will engage and pay for the Environmental Engineer to perform this
              review.
       .4     If the work is not completed to the satisfaction f the Environmental Engineer, work is
              to be continued by this Contractor until all designated materials have been removed to
              the satisfaction of the Environmental Engineer.
       .5     The second and any subsequent visits required by the Environmental Engineer will be
              paid for by the Demolition Contractor responsible for the removing of the designated
              materials.
       .6     Provide 48 hours advance notice to the Environmental Engineer of when the review
              work is required.


1.5    Existing Condition Review
       .1     Following the removal of all designated substances and prior to any further demolition
              work proceeding, conduct a survey of the property to determine the present condition
              of all features and finishes, including in particular, plaster, cornice detailing, interior
              columns and arch details, main wood stair finishes, windows, white marble fireplace
              and metal coverings, wood trim surrounding windows and doors in original building
              and original tall wood base.
       .2     Include in survey, Construction Manager, Owner, and Architect.
       .3     Provide 48 hours prior notice to all participants.
       .4     Upon completion of the demolition work of this Contract, conduct a similar survey of
              the above features by the same individuals.
       .5     Finishes and features found damaged, marked, cracked or broken, resulting from the
              demolition contract work will be refinished, repaired or restored to original condition,
              as found just prior to the demolition work of this contract, by others. Cost of the
              refinished, repair or restoration will be borne by the Demolition Contractor, except
              only if it can be shown that the damage was caused beyond his control.


1.6    Protection
       .1     Construct a temporary wood framed 2” x 4” wall in front of and alongside of the
              existing main wood stairway to a 42” minimum height. Use the frame to cover both

              sides of the existing balustrade / railing a minimum 3/8” OSB continuous panel on
              both sides of the balustrade /railing without actually securing the panelling to the
              balustrades / railing for the full height of the stairs.
       .2     Provide protective 3/8” minimum thickness OSB panelling on all original wood sills,
              wood base, wood window and/or door trim, all plaster cornice details, plaster columns,
              beams and arches and other features being identified as architecturally significant and
              worthy of preserving.
       .3     Cover all windows with a 6 mil plastic cover and tape seal to wall for protection of
              glass and vinyl frame.
       .4     Provide minimum 6 mil plastic covers, curtains and screens to prevent cross
              contaminations, to contain areas with designated substances to be removed and to
              minimize the spread of dust and debris
