28 total easements. We typically paid $1 for easement that runs 16.5 feet from high water mark on either side of stream or in later cases, 33 feet from the centerline. Easements typically run for 20 years. In general the easement holder has the right to develop the stream, protect the banks, put up signs, and to plant trees, plants, or shrubs to protect the streambank. In some case there is a right to put up fences and to provide for livestock crossings. There does not appear to be any specific maintenance responsibilities for the BE easements though we have historically brushed the banks and stream. On German Valley and on Deer Creek, there is an operation and maintenance plan under which TU agrees to periodic replacement of stone, removal of obstructions from streambank, periodic removal of woody vegetation from streambank, and inspection of seeded areas for erosion and repair/reseed as necessary. The German Valley easements are not recorded as of Oct. 2006. They are basically all the stream from Mayflower Road to the Iowa Cty line. All of our easements on BE Creek will expire in the next 2-10 years. This document is a summary of documents we have, information from Pat Sutter, and information from the DNR public easement CD provided by Kurt Welke. There are summaries in the file by an unknown person and by the DNR intern Maura Camosse which are consistent with the above table.
