									SMALL CLAIMS COURT INFORMATION SHEET
Small Claims Court is provided to decide money disputes in an informal setting. The jurisdictional limit for Small Claims Court in Montgomery County is $10,000.00. Only a judgment for a monetary amount can be granted. The person or company initiating the suit is the Plaintiff. The person, firm or corporation being sued is the Defendant. The filing fee is determined by the defendant’s address. If the address is located in Montgomery County, the total amount due when filing your suit is $97.00. If the defendant’s address is not in Montgomery County, call our office for the correct procedure for filing. Small Claims Courts can schedule a trial date after the defendant has been served a citation. However, a judgment does not guarantee that the Plaintiff will successfully collect. For information regarding after judgment remedies consult an attorney. The suit will be heard by the Judge unless either side requests a jury trial and pays the jury fee of $5.00. A jury consists of six people selected according to the manner prescribed by law. The jury panel will hear the case and determine the judgment. Both parties may represent themselves or employ an attorney. After judgment has been rendered, either side may appeal it. A proper appeal should be filed in our office no later than ten (10) days from the date the judgment letter is signed. The entire file and the original documents will be transferred to the County Clerk’s office in Conroe for a trial de novo (new trial).
