November 2006 Orange County Catholic – 23 New Law Passed by Congress to Encourage Giving he Pension Protection Act that recently became law affects giving by people over 70 ½ years old. They may donate up to $100,000 from their IRAs in both 2006 and 2007 without paying income tax on these funds. Individuals with traditional IRAs or Roth IRAs may make tax free gifts to qualified 501 (c)(3) charities by direct transfer, but may not direct gifts to donor advised funds, charitable remainder trust, gift annuities or similar planned gifts. Donors may not claim an income tax deduction if they give in this manner. 401(k) and 403(b) plans, or other non-IRA plans do not qualify. Parishioners should check with their advisor to determine if they may transfer funds from other accounts into an IRA and then make Orange County Catholic T a charitable gift. A husband and wife having separate IRAs may each contribute up to the limit in both years of the program. Donors over 70 ½ may use this method for their regular charitable gifts during this period of time, or use it to make capital campaign gifts, pay off capital campaign pledges or to create permanent endowed funds for the parish through the Orange Catholic Foundation. In order to donate funds or other assets from an IRA, the donor must instruct his or her broker or investor to call the diocesan contact at Morgan Stanley (Tom Kleinbauer) and wire transfer the gift. The broker will need to know the DTC number for the Diocese (which is 0015) and the Diocesan account number (which is 242-047591-250) and give instructions to restrict the gift to your parish account for the purpose desired. This is the same procedure used to transfer stock or other assets for an outright or deferred gift that does not relate to this program, but does generate an income tax deduction if you itemize. Eligible donors (over 70 ½) may make such gifts before Dec. 31, 2006 to a parish (and or other charities) and then do it again next year.
