CONFIRMATION OF MINUTES – SPECIAL MEETING - 5TH MARCH, Confirm. 2007 (B) Minutes Ald. Hill moved and Ald. Hollister seconded that the Minutes of the Special Meeting of Council held on the 5th day of March, 2007 as circulated be taken as read and confirmed. CARRIED UNANIMOUSLY. APOLOGIES (2417) There were no apologies. 6511. LEAVE OF ABSENCE (2418) Leave of Ald. Wilson moved and Ald. Matthews seconded that the Leave of Absence Absence in respect of Ald. B.L. Cole be noted. Goodwin moved and Ald. Hollister seconded that the report Briefing advising of Workshop/Briefing Sessions held since the last Council Sessions meeting be received and the information noted. CARRIED UNANIMOUSLY. 6513. STANDING ORDERS (199) PUBLIC PARTICIPATION IN COUNCIL Standing MEETING (2421) Orders Ald. Konetschnik moved and Ald. Cole seconded that the report advising that there have been no responses forwarded since the last Council meeting be received and noted. CARRIED UNANIMOUSLY. 6514. LICENCES (190) Licences USE OF COUNCIL LAND FOR CARPARKING PURPOSES 1 MERSEY ROAD (9019) (1) (2423) Ald. Matthews moved and Ald. Hill seconded that Council receive the Corporate Services Departmental report and: 1. Grant to Spreyton Primary School a licence to use all that piece of land contained in Certificate of Title Volume 124782/27 for the purposes of car parking associated with the adjacent Spreyton Primary School, such licence to continue for a period of one year, unless renewed on condition that Council has the right to determine the licence upon three months written notice given to the school. 2. Advise the school that there is a spoon drain running from East to West through the centre of the Public Open Space which may render the site unusable during wet periods. CARRIED UNANIMOUSLY. 6515. Matthews seconded that Council receive the Corporate Services Departmental report and that Ald. K.J. Whittle be declared appointed as the Council’s elected representative to the Devonport Recreation Centre Controlling Authority, replacing Ald. R.N. Barden. CARRIED UNANIMOUSLY. 6516. COMMITTEE (54) Committee APPOINTMENT OF COMMITTEE MEMBER - DEVONPORT REGIONAL GALLERY ADVISORY SPECIAL COMMITTEE DEVONPORT REGIONAL GALLERY ADVISORY SPECIAL COMMITTEE (13366) (3) (2425) Ald. Hollister moved and Ald. Goodwin seconded that Council - 5151 - 19th March, 2007. receive the Corporate Services Departmental report and adopt the recommendation of the Devonport Regional Art Gallery Advisory Special Committee, accepting the resignation of Nelder Hunt and appointing Alister McCrae as a member of the Committee in accordance with Section 24 of the Local Government Act 1993. CARRIED UNANIMOUSLY. 6517. LEASES (133) Leases PREMIUM FRESH TASMANIA - PERMISSION TO UTILISE PART OF COUNCIL ROAD RESERVE PA2006.0127 PREMIUM FRESH TASMANIA EXTENSION TO VEGETABLE WASHING & PACKAGING AND CARPARKING (21615) (4) (2426) Ald. Kent moved and Ald. Whittle seconded that Council receive the Corporate Services Departmental report and agree to Premium Fresh Tasmania’s request to utilise 3.5 metres of Council road reserve at 221 Forthside Road in order to erect 60 metres of acoustic barrier in accordance with Planning Application Approval No. 2006.0127 subject to: (i) a formal License Agreement being entered into between Devonport City Council and Premium Fresh Tasmania Pty. Ltd. for an annual licence fee structure determined by an Independent Valuer for an initial term of 5 years with the option for an additional 5 years. (ii) Any costs incurred preparing the Licence to be borne by Premium Fresh Tasmania Pty. Ltd. (iii) Premium Fresh Tasmania Pty. Ltd. maintaining the designated area in accordance with Council standards and PA2006.0127. AS A PROCEDURAL MOTION Ald. Matthews moved and Ald. Hollister seconded that the matter lay on the table in order to ascertain feedback from Premium Fresh Tasmania Pty. Ltd. on whether it wished to proceed with the Licence Agreement, given an annual licence fee is required. The motion was CARRIED. TREES (330) Trees PROPOSED WORKING PARTY - DEVELOPMENT OF STRATEGIC PLAN - STREET AND PARK TREES - NOTICE OF MOTION - ALD. R.M. GREEN STREET AND PARK TREES WORKING PARTY (21201) (5) (2427) Ald. Green moved and Ald. Konetschnik seconded that the Engineering Services Departmental report be received and Council seek public comment in relation to the following documents: 1. Devonport City Council Guidelines for the Planning, Design & Construction of Public Open Space; 2. Devonport City Council Public Open Space Standards & Technical Notes; and 3. Devonport City Council Victoria Parade Parklands Master Plan. CARRIED UNANIMOUSLY. 6519. FENCES (101) Fences FENCE – 70-72 TASMAN STREET – APPLICATION FOR VARIATION TO FENCING POLICY 70-72 TASMAN STREET (5763) (6) (2428) Ald. Hollister moved and Ald. Goodwin seconded that Council receive the Engineering Services Departmental report and agree to the construction of a 1.8m high fence along the existing splayed property boundary at 70-72 Tasman Street and advise the owners accordingly. CARRIED UNANIMOUSLY. 6520. TREES (330) Trees PETITION FOR REMOVAL OF TREES – GLEN COURT TREE PRUNING (19044) (7) (2429) Ald. Wilson moved and Ald. Hill seconded that the Infrastructure Services Departmental report be received and (i) Council receive a petition from twenty-two residents of Glen Court, Devonport seeking the removal of the existing mature trees in Glen Court; and (ii) that a report be provided to a future meeting of Council on the subject matter of the petition. CARRIED UNANIMOUSLY. 6521. TOURISTS (320) Tourists DECLARATION OF STATUS AS A RECREATION VEHICLE FRIENDLY TOWN CAMPERVANS/MOTORHOMES (21550) (8) (2430) Ald. Wilson moved and Ald. Matthews seconded that Council receive the Development and Community Services Departmental report and agree in principle to submit a request to become a Recreation Vehicle Friendly Town and subject to satisfactory arrangements being made. Cole seconded that Council receive the Development and Community Services Departmental report and (i) form a Committee of three Aldermen to hear submissions in relation to the application to amend sealed plan Vol 147558 Fols 2-67, 116- 141, 157-168, 1001-1004 and 2000; and (ii) furthermore delegate authority to the appointed Committee to make a decision on the matter.
