HOUSING CONTRACT AND LEASE AGREEMENT

THIS CONTRACT and LEASE AGREEMENT (hereafter referred to either as "AGREEMENT") dated
between the Kettering-B Chapter of the Delta Chi Fraternity (hereafter called "CHAPTER") and
(hereafter called "TENANT") constitutes an agreement for rental in the
Kettering Delta Chi Chapter House, (hereafter called "HOUSE") located at 1421 West Third Ave, Flint, Michigan 48504
with mutually acceptable benefits, requirements, stipulations and privileges by and between the CHAPTER and the
TENANT, as hereafter provided.
1. CHAPTER OBLIGATIONS
A. The CHAPTER agrees to rent a room space (hereafter called "APARTMENT") to TENANT and maintain the
general structure and areas of the HOUSE in which the APARTMENT is located in accordance with the laws
and regulations of the City of Flint, Genesee County, the State of Michigan, the United States of America and
Kettering University, if applicable.
B. The CHAPTER and their agents shall have the right at all reasonable times during this lease to enter the
APARTMENT or the HOUSE in which the APARTMENT is located for the purpose of inspecting or repairing
the APARTMENT or the HOUSE in which the APARTMENT is located (this right of inspection shall extend to
all building and improvements thereon.)
C. The CHAPTER reserves the right to have keys to the APARTMENT at all times.
D. The CHAPTER reserves the right to refuse entrance to the APARTMENT or common areas of the premises
to anyone that is not in contract with CHAPTER for leased space.
E. The CHAPTER reserves the right to restrict access to TENANT and his guests in any common areas of the
premises at any time (reasonable access to the APARTMENT will be maintained during the lease period.)
2. TENANT OBLIGATIONS - The TENANT agrees to abide by the constitution and by-laws of The Delta Chi
Fraternity, Inc. - an international fraternity, the rules and regulations of the CHAPTER, the rules and regulations of
the Interfraternity Council at Kettering University, and the laws and regulations of the City of Flint, Genesee
County, the State of Michigan, the United States of America, and Kettering University, if applicable.
A. Room Rent - The TENANT agrees to pay the CHAPTER the following:
a. $1200 for a single occupant room;
b. $1000 for a double occupant room;
c. $800 for a triple occupant room;
For the lease period beginning October 6, 2008 and ending December 20, 2008. Any extensions to these
dates must be cleared with the CHAPTER two weeks before the beginning or ending date of the lease,
whichever date is relevant to the requested extension.
B. Rules - The TENANT agrees to accept and retain the room space assigned for the period stated below and
maintain said room and its contents in good condition in accordance with the following CHAPTER rules:
a. The APARTMENT shall be kept clean and free of trash. Housing Committee reserves the right to judge
the cleanliness of the APARTMENT. If it fails the basic standards there will be a three day grace period
to clean, then it will be judged again. If it fails a second time there will be a three day grace period to
clean, then it will be judged again. If it fails a third time there will be a three day grace period to clean,
then it will be judged again. If it fails a fourth time there will be a $20 fine given to the TENANTS of that
APARTMENT that will taken from each of their housing security deposits;
b. No alterations or improvements shall be made to any room or public area of the HOUSE without prior
written approval of the CHAPTER;
c. No safety chains or other door locking hardware shall be allowed on any door other than those doorknobs
and deadbolt locks presently installed by the CHAPTER;
d. No construction shall be allowed that will divide the APARTMENT into sections;
e. No large nails shall be used, only small finishing nails shall be used in walls or ceilings to hang pictures,
f. No building materials other than paneling or molding shall be attached to walls or ceilings;
g. Rugs may be used, but may not be secured to the room floor;
h. Hot plates, space heaters and other such devices are not allowed;
i. Pets are permitted in the HOUSE or APPARTMENT only with a three-fourths (75%) affirmative vote in a
Chapter Meeting. Pets that Members may have allergies to are not allowed under any circumstance.
j. Alcohol and illegal substances are not allowed in the HOUSE or the APARTMENT at any time;
k. Tobacco use is not allowed in the HOUSE or the APARTMENT at any time;
I. No firearms or other deadly weapons, including Air-Soft guns, BB guns, pellet guns, paintball guns, or any
other projectile-firing item of any kind, are permitted in the HOUSE at any time;
m. When rooms are vacated, they shall be cleared of everything except beds, dressers, desks and other
CHAPTER property. The TENANT must have his room signed out by the housing chairmen of the
n. Rugs shall be rolled up and the floors swept;
o. TENANTS that share APARTMENTS will also share weekly cleaning responsibilities. One group of
TENANTS will have off each week and the rest of the chores will be distributed. Housing Committee will
inspect at the end of the week each duty for its completion. If incomplete a $20 fine will be taken out of
each of their housing security deposits.
p. If the room is not properly cleaned at the end of the term a fee will be assessed to the TENANTS of the
apartment. Fees assessed in the main room, kitchen, and bathroom will be split between the TENANTS.
While fees assessed to personal room shall be paid by the TENANT of that room.
q. At any time, the stairwells and hallways must be kept free of any obstruction(s) for safety reasons, such
as blocking traffic during a fire, creating a trip hazard, etc.
r. No person may store anything in the boiler room.
s. Only one parking space is permitted per TENANT. If TENANT has guest(s) over to the house, they must
either have their guest(s) park them in or the guest(s) must park at the Kettering University Parking Lot.
C. Security Deposit
a. The TENANT agrees to pay CHAPTER a security deposit of $200 per APARTMENT to serve as bond
against damages done to the HOUSE for which the TENANT or any guest of the TENANT is directly
b. Any damage in excess of $200 shall be charged to the TENANT by special assessment.
c. Any damage to the HOUSE for which no known individual can be held responsible will be borne by all
TENANTS, upon the authority of the CHAPTER.
d. The security deposit, or unused portion thereof, shall be returned to the TENANT by the CHAPTER no
later than ninety (90) days after termination of this AGREEMENT or held over if a new AGREEMENT is
signed for a subsequent term(s).
D. Damages - TENANT shall use the APARTMENT and leased premises exclusively for residential purposes,
under penalty of forfeiture and damages.
E. Liability - TENANT shall protect the CHAPTER from all liability arising during the lease term from injury to
person or property, occasioned wholly in part by an act or omission of the TENANT, or his guests, assignees,
F. Claims - The TENANT shall protect the CHAPTER from all claims, and against all loss, damage, or expense,
arising out of any failure of the TENANT in any respect to comply with and perform the requirements and
provisions of this AGREEMENT.
A. The CHAPTER accepts no responsibility for the damage, theft or loss of monies, valuables, or any personal
B. No item of a dangerous, flammable or explosive character that might unreasonably increase the danger of fire
in the APARTMENT or that might be considered hazardous by any responsible insurance company, will not
be allowed in the APARTMENT or HOUSE at any time.
A. Without prior written consent of the CHAPTER, the TENANT shall not assign this lease, sublet or grant any
concession or license to use the APARTMENT or any part thereof.
B. Consent by the CHAPTER to an assignment or subletting shall not be deemed or construed to be consent to
any subsequent assignment or subletting.
C. An assignment, subletting, concession or license without prior written consent of the CHAPTER, or an
assignment or subletting by operation of law, shall be void and this lease shall be terminated at the
5. TERMINATION - Violation of this CONTRACT shall be only in the event that:
A. The TENANT leaving because of serious illness, death in the family, service to his country, marriage or other
good cause found to be satisfactory to the CHAPTER. Termination for any other reason will result in the
TENANT being held responsible for payment of all duly charged amounts for which he is obligated will be
refunded to the TENANT on a pro rate basis;
B. The TENANT fails to observe any provision of this CONTRACT;
C. The HOUSE being rendered uninhabitable by the CHAPTER, in which case the payment of room will be
refunded to the TENANT on a pro rate basis.
D. Graduation of TENANT at KETTERING UNIVERSITY will be refunded to the TENANT on a pro rate basis.
A. The covenants and conditions contained herein shall apply to and bind the heirs, legal representatives, and
assigns of the parties hereto, and all covenants are to be construed as conditions of this lease.
B. If TENANT breached any condition of this lease, the CHAPTER may repossess the APARTMENT pursuant
to judicial process, and the CHAPTER shall have other rights as allowed by law.
C. If the CHAPTER is compelled to incur any expenses including reasonable attorney's fees in instituting and
prosecuting any action or proceeding by reason of any default of the TENANT or non-payment of rent by
TENANT hereafter, the sums so paid by CHAPTER with all interest, costs, and damages shall be deemed to
be additional rent hereafter. Amounts due under this clause shall accrue interest at the rate of 10% per annul
D. This contract by and between the CHAPTER and the TENANT shall be for the period beginning
