					The law is really very simple in most divorce cases. You will need to show the following
three things:


        1. That your marriage has become "insupportable." (This is done simply by stating this
        fact, which means that your marriage relationship is broken and can't be saved).
        2. How your property should be divided between you and your spouse.

        3. Who should have custody of your children, if any, and how they should be supported.

The Procedure
        The basic uncontested divorce process may be viewed as a five-step process:

       1. File court papers asking the judge to grant a divorce (which includes dividing             your
property and deciding how the children will be taken care of).

        Petition for divorce.This is nothing more than a written request for the judge to grant you a
        divorce, divide your property, and determine child support and custody. Petition forms are
        provided in appendix B of this book, and full instructions are also provided in later chapters.
        Once the Petition is completed, it is taken to the court clerk to be filed



        2. Notify your spouse that you are filing for divorce.

        Notifying your spouse. After you've prepared the petition you need to officially notify your spouse.
Even though your spouse may already know that you are filing for divorce, you still              need to have
him or her officially notified. This is done by having a copy of your petition           delivered to your
spouse. This may be done in various ways, which will be explained in           detail later.


       3. File papers explaining what you and your spouse have agreed upon with regard to
property division and child custody.


        4. Obtain a hearing date.
        Obtaining a hearing date.Once all of your paperwork is in order and has been filed, you need to
set a date for a hearing. A hearing is simply a meeting with the judge so that he or     she can give
you a divorce. This is usually done by the court clerk when you file your petition.

        5. Attend a hearing with the judge, and have the judge sign a decree granting the
        divorce.

        The hearing. Finally, you go to the hearing. The judge will review the papers you have
        submitted, and any additional information you have, and will make a decision about whether
        to grant the divorce, how your property should be divided, who should have custody of your
        children, and how the children are to be supported. If you and your spouse agree on these
        matters, the judge will simply approve your agreement.
About this Form: This is a no-fault divorce form for use within the State of Texas (ORIGINAL PETITION
FOR DIVORCE). Most courts will require that this form be completed and filed along with a Marital
Settlement Agreement. Please note that in Paragraph 5 (Grounds for Divorce), the Petitioner will need to
specify grounds for divorce that are recognized as valid within the State of Texas. Texas law recognizes
only the following grounds as sufficient for granting a no-fault divorce: (1) the marriage has become
insupportable because of discord or conflict of personalities that has destroyed the legitimate ends of the
marriage relationship and prevents any reasonable expectation of reconciliation; or (2) living separate and
apart without cohabitation for three years.

About this Form: This is a marital settlement agreement that may accompany the No-Fault Divorce form
